6362 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
64-SECTION 1. AMENDATORY 21 O.S. 2021, Section 1172, is

101+1172 of this title that can be shown to be the proximate cause of
102+the attempted suicide of the victim of such offense shall, upon
103+conviction, be guilty of an offense under subsection A of this
104+section.
105+SECTION 2. AMENDATORY 21 O.S. 2021, Section 817, is
106+amended to read as follows:
107+Section 817. A. Any person guilty of aiding suicide shall ,
108+upon conviction, be guilty of a felony pun ishable by a fine not to
109+exceed Five Thousand Dollars ($5,000 .00), imprisonment in the State
110+Penitentiary custody of the Department of Corrections for not less
111+than seven (7) years , or by both such fine and imprisonment.
112+B. Any person guilty of a felony o ffense pursuant to Section
113+1172 of this title that can be shown to be the proximate cause of
114+the suicide of the victim of such offense shall, upon conviction, be
115+guilty of an offense under subsection A of this section .

144+Section 1172. A. It shall be unlawful for a person who to, by

146196 6. In conspiracy or concerted action with other persons, makes

149199 platform solely to harass any person at the called number(s) number

151-7. Commit an act of bullying, as defined in Section 24 -100.3 of

153201 B. As used in this section , “telecommunication” :
154202 1. “Online platform” means a website or online application that
155203 is open to the public, allows a user to create an account, an d
156204 enables users to communicate with other users for the primary
157-purpose of posting information, comme nts, messages, or images;
158-2. “Telecommunication” and “electronic communication” mean
159-means any type of telephonic, electronic , or radio communications,
160-or transmission of signs, signals, data, writings, images and
161-sounds, or intelligence of any nature by telephone, including
162-cellular telephones, wire, cable, radio, electromagnetic,
163-photoelectronic, or photo-optical system or the creation, display,
164-management, storage, processing, transmission , or distribution of
165-images, text, voice, video, or data by wire, cable, or wireless
166-means, including the Internet. The term includes a:
205+purpose of posting information, comments, messages, or images; and
206+2. “Telecommunication” and “electronic communication” mean any
207+type of telephonic, electronic , or radio communications, or

209253 under this section is a continuing offense and shall be deemed to

212256 D. Except as provided in subsec tion E of this section, any

245-E. 2. Any person who is convicted of a second offe nse under the
246-provisions of subsection A of this section shall be guilty of a
247-felony punishable by a fine not to exceed One Thousand Dollars
248-($1,000.00), or by imprisonment in the custody of the Department of

299341 3. Willfully exceed the limits of authorization and damage,
300342 modify, alter, destroy, copy, delete, disclose or take pos session of
301343 a computer, computer system, computer network, data or any other

303345 4. Willfully and without authorization, gain or attempt to gain
304346 access to a computer, computer system, computer network, data or any
305347 other property;
306348 5. Willfully and wi thout authorization use or cause to be used
307349 computer services;
308350 6. Willfully and without authorization disrupt or cause the
309351 disruption of computer services or deny or cause the denial of
310352 access or other computer services to an authorized user of a
311353 computer, computer system or computer network, other than an
312354 authorized entity acting for a legitimate business purpose with the
313355 effective consent of the owner;
314356 7. Willfully and without authorization provide or assist in
315357 providing a means of accessing a computer, computer system, data or
316358 computer network in violation of this section;
317359 8. Willfully use a computer, computer system, or computer
318-network to annoy, abuse, threaten , or harass another per son, or
360+network, or other electronic device or system to annoy, abuse,
361+threaten, or harass another person;
362+9. Willfully use a compu ter, computer system, or computer
363+network, or other electronic device or system to put another person
364+in fear of physical harm or death; and

347-subsection A of Section 1172 of this t itle;
348-9. Willfully use a compu ter, computer system, or computer
349-network, or other electronic device or system to put another person
350-in fear of physical harm or death; and
351391 10. Willfully use a computer, computer system, computer
352-network, or other electronic device or system to violate any of the
353-provisions provided for in Sections 813, 8 14, or 815 of this title;

392+network, or other electronic device or system to encourage another
393+person to harm himself or herself or to commit suicide; and
355394 11. Willfully solicit another, regardless of any financial
356395 consideration or exchange of property, of any acts described in
357396 paragraphs 1 through 9 10 of this subsection.
358397 B. Any person convicted of violating paragraph 1, 2, 3, 6, 7, 9
359-or, 10, or 11 of subsection A of this section shall be g uilty of a
398+or 10, or 11 of subsection A of this section shall be guilty of a
360399 felony punishable as provided in Section 1955 of this title.
361400 C. Any person convicted of violating paragraph 4, 5 or 8 of
362401 subsection A of this section shall be guilty of a misdemeanor.
363402 D. Nothing in the Oklahoma Computer Crimes Act shall be
364403 construed to prohibit the monitoring of computer usage of, or the
365404 denial of computer or Internet access to, a child by a parent, legal
366405 guardian, legal custo dian, or foster parent. As used in this
367406 subsection, “child” sh all mean any person less than eighteen (18)
368407 years of age.
408+E. Nothing in the Oklahoma Computer Crimes Act shall be
409+construed to prohibit testing by an authorized entity, the purpose
410+of which is to provide to the owner or operator of the computer,
411+computer system or computer network an evaluation of the security of
412+the computer, computer system or computer network against real or
413+imagined threats or harms.

396-E. Nothing in the Oklahoma Computer Crimes Act shall be

402-SECTION 3. This act shall become effective November 1 , 2024.
