6657 SECTION 1. AMENDATORY 70 O.S. 2021, Section 18 -109.5, is

95-1. "Visual impairment" means an impairment in vision that, even
96-with correction, adversely affects a child 's educational
97-performance. This includes both partial sigh t and blindness;
98-2. "Specific learning disability" means a disorder in one or
99-more of the basic psy chological processes involved in understanding

10193 the imperfect ability to listen, think, speak, read, write, spell or

144-6. "Emotional disturbance " means a condition exhibiting one or
145-more of the following characteristics over a long period of ti me and
146-to a marked degree that adversely affects a child 's educational
147-performance:
148-a. an inability to learn which cannot be explained by
149-intellectual, sensory or health factors,
150143 b. an inability to build or maintain satisfactory
151144 interpersonal relationships with peers and teachers,
152145 c. inappropriate types of behavior or feelings under

158151 The term includes children who are schizophrenic. The term does not
159152 include children who are socially maladjusted, unless it is
160153 determined that they are seriously emotionally disturbed;
161154 7. "Gifted" means identified students as outlined in Section
162155 1210.301 of this title;
163156 8. "Hearing impairment" means an impairment in hearing, whether
164157 permanent or fluctuating, that adversely affects a child 's
165158 educational performance but that is not included under the
166159 definition of "deafness";
160+9. "Multiple disabilities " means concomitant impairments, such

193-9. "Multiple disabilities " means concomitant impairments, such
194-as intellectual disability – blindness or intellectual disability –
195-orthopedic impairment, the combination of which cau ses such severe

204198 palsy, amputations and f ractures or burns that cause contractures;
205199 11. "Other health impairment" means having limited stren gth,
206200 vitality or alertness, including a heightened alertness to
207201 environmental stimuli, that results in limited alertness with
208202 respect to the educational env ironment that adversely affects a
209203 child's educational performance and is due to chronic or acute
210204 health problems such as asthma, attention deficit disorder or
211205 attention deficit hyperactivity disorder, diabetes, epilepsy, a
212206 heart condition, hemophilia, lead poisoning, leukemia, nephritis,
213207 rheumatic fever, sickle cell anemia and Tourette syndrome;
214208 12. "Speech or language impairment " means a communication
215209 disorder, such as stuttering, impaired articulation, a language
210+impairment, or a voice impairment, that a dversely affects a child's
211+educational performance;
212+13. "Deaf-blindness" means concomitant hearing and visual
213+impairments, the combination of which causes such severe
214+communication and other developmental and educational problems that
215+they cannot be accom modated in special education programs solely for
216+children with deafness or children with blindness;

244-13. "Deaf-blindness" means concomitant hearing and visual
245-impairments, the combination of which causes such severe
246-communication and other developmental and educational problems that
247-they cannot be accom modated in special education programs solely for
248-children with deafness or children with blindness;
249244 14. "Autism" means a developmental disability significantly
250245 affecting verbal and nonverbal communication and social interaction,
251246 generally evident before a ge three (3), that adversely affects a
252247 child's educational performance. Other characteristics often
253248 associated with autism are engagement in repetitive activities and
254249 stereotyped movements, resistance to environmental change or change
255250 in daily routines, a nd unusual responses to sensory experiences.
256251 Autism does not apply if a child 's educational perform ance is
257252 adversely affected primarily because the child has an emotional
258253 disturbance, as defined in this subsection;
259254 15. "Traumatic brain injury " means an acquired injury to the
260255 brain caused by an external physical force, resulting in total or
261256 partial functional disability or psychosocial impairment, or both,
262257 that adversely affects a child 's educational performance. Traumatic
263258 brain injury applies to open or closed head injuries resulting in
264259 impairments in one or more areas such as cognition; language;
265260 memory; attention; reasoning; abstract thinking; judgment; problem -
261+solving; sensory, perceptual, and motor abilities; psychosocial
262+behavior; physical functions; information processing; and speech.
263+Traumatic brain injury does not apply to brain injuries that a re
264+congenital or degenerative or to brain injuries induced by birth
265+trauma;
266+16. "Bilingual English language learner" means those students :

298294 a. who have limited English speaking abilities or who
299295 come from homes where English is not the dominant
300296 language as reported on the current year application
301297 for accreditation:
302298 (1) were not born in the United States or whose
303299 native language is a language other than English,
304300 (2) are Native American or Alaska Natives, or a
305301 native resident of the outlying areas, and who
306302 come from an environment where a language other
307303 than English has had a significant impact on the
308304 student's level of English language proficiency,
309305 or
310306 (3) are migratory, whose native language is a
311307 language other than English, and who come from an
312308 environment where a language other than English
313309 is dominant, and
310+b. whose difficulties in speaking, reading, writing , or
311+understanding the English language may be suffici ent
312+to deny the student:
313+(1) the ability to meet the state's proficient level
314+of achievement on state assessments,
315+(2) the ability to successfully achieve in classrooms
316+where the language of instruction is English, or
317+(3) the opportunity to participate ful ly in society.

340-b. whose difficulties in speaking, reading, writing , or
341-understanding the English language may be suffici ent
342-to deny the student:
343-(1) the ability to meet the state's proficient level
344-of achievement on state assessments,
345-(2) the ability to successfully achieve i n classrooms
346-where the language of instruction is English, or
347-(3) the opportunity to participate ful ly in society.
348345 Any school district receiving funds for a student who is categorized
349346 as an English language learner shall reevaluate the student annually
350347 using assessments required by federal law to confirm the stud ent
351348 continues to meet the definition of English language learner as
352349 provided in this paragraph;
353350 17. "Special Education Summer Program " means those summer
354351 school programs which school districts may provide for children who
355352 are severely or profoundly multiple -handicapped if their
356353 individualized education program states the need for a continuing
357354 educational experience to prevent loss of educational achievement or
358355 basic life skills. Any school district receiving funds for such
359356 special education summer programs shall provide services as provided
360357 in Section 13-101 of this title; and
361358 18. "Optional Extended School Year Program " means the program
362359 defined in Section 1-109.1 of this title.
360+B. The State Board of Education is hereby authorized t o modify
361+and redefine by rule the definitions set out in this se ction
362+whenever such modification is required to receive federal assistance
363+therefor.
364+SECTION 2. AMENDATORY 7 0 O.S. 2021, Section 18 -200.1, as
365+last amended by Section 2, Chapter 488, O.S.L. 2021, is amended to
366+read as follows:
367+Section 18-200.1 A. Beginning with the 2022-2023 school year,
368+and each school year thereafter, each school district shall have its

389-B. The State Board of Education is hereby authorized t o modify

391-whenever such modification is required to receive federal assistance

393-SECTION 2. AMENDATORY 7 0 O.S. 2021, Section 1 8-200.1, as
394-last amended by Section 2, Chapter 488, O.S.L. 2021, is amended to
395-read as follows:
396-Section 18-200.1 A. Beginning with the 2022-2023 school year,
397-and each school year thereafter, each school district shall have its
398396 initial allocation of State Aid calculated based on the stat e
399397 dedicated revenues actually collected during the preceding fiscal
400398 year, the adjusted assessed valuation of the preceding year and the
401399 weighted average daily membership for the school district of the
402400 preceding school year. Each school district shall subm it the
403401 following data based on the first nine (9) weeks, to be used in the
404402 calculation of the average daily membership of the school district:
405403 1. Student enrollment by grade level;
406404 2. Pupil category counts; and
407405 3. Transportation supplement data.
408406 On or before December 30, the State Department of Education
409407 shall determine each school district’s current year allocation
410408 pursuant to subsection D of this section. The State Department of
411409 Education shall complete an audit, using procedures established by
412410 the Department, of the student enrollment by grade level data, pupil
411+category counts and transportation supplement data to be used in the
412+State Aid Formula pursuant to subsection D of this section by
413+December 1 and by January 15 shall notify each school district of
414+the district’s final State Aid allocation for the current schoo l
415+year. The January payment of State Aid and each subsequent payment
416+for the remainder of the school year shall be based on the final
417+State Aid allocation as calculated in subsection D of this section.
418+Except for reductions made due to the assessment of penalties by the
419+State Department of Education according to law, the January payment

440-State Aid Formula pursuant to subsection D of this section by
441-December 1 and by January 15 shall notify each school district of
442-the district’s final State Aid allocation for the current schoo l
443-year. The January payment of State Aid and each subsequent payment
444-for the remainder of the school year shall be based on the final
445-State Aid allocation as calculated in subsection D of this section.
446-Except for reductions made due to the assessment of penalties by the
447-State Department of Education according to law, the January payment
448447 of State Aid and each subsequent payment for the remainder of the
449448 school year shall not decrease by an a mount more than the amount
450449 that the current chargeable revenue incr eases for that district.
451450 B. The State Department of Education shall retain not less than
452451 one and one-half percent (1 1/2%) of the total funds appropriated
453452 for financial support of schools, to be used to make midyear
454453 adjustments in State Aid and which shal l be reflected in the final
455454 allocations. If the amount of appropriated fund s, including the one
456455 and one-half percent (1 1/2%) retained, remaining after January 1 of
457456 each year is not suffic ient to fully fund the final allocations, the
458457 Department shall reca lculate each school district’s remaining
459458 allocation pursuant to subsection D of this section using the
460459 reduced amount of appropriated funds.
461460 C. On and after July 1, 1997, the amount of Sta te Aid each
462461 district shall receive shall be the sum of the Foundati on Aid, the
462+Salary Incentive Aid and the Transportation Supplement, as adjus ted
463+pursuant to the provisions of subsection G of this section and
464+Section 18-112.2 of this title; provided, no d istrict having per
465+pupil revenue in excess of three hundred percent (300%) of the
466+average per pupil revenue of all districts shall receive any State
467+Aid or Supplement in State Aid.
468+The July calculation of per pupil revenue shall be determined by
469+dividing the district’s second preceding year ’s total weighted
470+average daily membership (ADM) into the district’s preceding year’s

489-Salary Incentive Aid and the Transportation Supplement, as adjus ted
490-pursuant to the provisions of subsection G of this section and
491-Section 18-112.2 of this title; provided, no d istrict having per
492-pupil revenue in excess of three hundred percent (300%) of the
493-average per pupil revenue of all districts shall receive any State
494-Aid or Supplement in State Aid.
495-The July calculation of per pupil revenue shall be determined by
496-dividing the district’s second preceding year ’s total weighted
497-average daily membership (ADM) into the district’s preceding year’s
498498 total revenues excludi ng federal revenue, insurance loss payments,
499499 reimbursements, recovery of overpayments and refunds, unused
500500 reserves, prior expenditures recovered, prior year surpluses, and
501501 less the amount of any transfer fees paid in that year.
502502 The December calculation of per pupil revenue shall be
503503 determined by dividing the district ’s preceding year’s total
504504 weighted average daily me mbership (ADM) into the district ’s
505505 preceding year’s total revenues excluding federal revenue, insurance
506506 loss payments, reimbursements, recovery of overpayments and refunds,
507507 unused reserves, prior expenditures recovered, prior year surpluses,
508508 and less the amount of any transfer fees paid in that year.
509509 D. For the 1997-98 school year, and each school year
510510 thereafter, Foundation Aid, the Transportat ion Supplement and Salary
511511 Incentive Aid shall be calculated as follows:
512+1. Foundation Aid shall be determined by subtracting the amount
513+of the Foundation Program Income from the c ost of the Foundation
514+Program and adding to this difference the Transportati on Supplement.
515+a. The Foundation Program shall be a district ’s higher
516+weighted average daily membership based on the first

518+preceding school year of a school district, as
519+determined by the provisions of subse ction A of
520+Section 18-201.1 of this title and paragraphs 1, 2, 3

538-1. Foundation Aid shall be determined by subtracting the amount
539-of the Foundation Program Income from the c ost of the Foundation
540-Program and adding to this difference the Transportati on Supplement.
541-a. The Foundation Program shall be a district ’s higher
542-weighted average daily membership based on the first
543-nine (9) weeks of the current school year or the
544-preceding school year of a school district, as
545-determined by the provisions of subse ction A of
546-Section 18-201.1 of this title and paragraphs 1, 2, 3
547-and 4 of subsection B of Section 18-201.1 of this
548549 title, multiplied by the Base Foundation Support
549550 Level. However, for the portion of weighted
550551 membership derived from nonresident, transferre d
551552 pupils enrolled in online courses, the Foundation
552553 Program shall be a district ’s weighted average daily
553554 membership of the preceding school year or the first
554555 nine (9) weeks of the current school year, whichever
555556 is greater, as determined by the provisions o f
556557 subsection A of Section 18-201.1 of this title and
557558 paragraphs 1, 2, 3 and 4 of subsection B of Section
558559 18-201.1 of this title, multiplied by the Base
559560 Foundation Support Level.
560561 b. The Foundation Program Income shall be the sum of the
561562 following:
563+(1) The adjusted assessed valuation of the current
564+school year of the school district, minus the
565+previous year protested ad valorem tax revenues
566+held as prescribed in Section 2884 of Title 6 8 of
567+the Oklahoma Statutes, multiplied by the mills
568+levied pursuant to subse ction (c) of Section 9 of
569+Article X of the Oklahoma Constitution, if
570+applicable, as adjusted in subsection (c) of
571+Section 8A of Article X of the Oklahoma
572+Constitution. For purpose s of this subsection,

588-(1) The adjusted assessed valuation of the current

590-previous year protested ad valorem tax revenues

592-the Oklahoma Statutes, multiplied by the mills
593-levied pursuant to subse ction (c) of Section 9 of
594-Article X of the Oklahoma Constitution, if
595-applicable, as adjusted in subsection (c) of

597-Constitution. For purpose s of this subsection,
598600 the “adjusted assessed valuation of the current
599601 school year” shall be the adjusted assessed
600602 valuation on which tax revenues are collected
601603 during the current school yea r, and
602604 (2) Seventy-five percent (75%) of the amount received
603605 by the school district from the proceeds of the
604606 county levy during the preceding f iscal year, as
605607 levied pursuant to subsection (b) of Section 9 of
606608 Article X of the Oklahoma Constitution, and
607609 (3) Motor Vehicle Collections vehicle collections,
608610 and
609611 (4) Gross Production Tax production tax, and
610612 (5) State Apportionment apportionment, and
611613 (6) R.E.A. Tax tax.
614+The items listed in divisions (3), (4) , (5), and (6)
615+of this subparagraph shall consist of the amounts
616+actually collected from such sources during the
617+preceding fiscal year calculated on a per capita basis
618+on the unit provided for by law for the distribution
619+of each such revenue.
620+2. The Transportation Supplement shall be equal to the average
621+daily haul times the per capita allowance times the appropria te
622+transportation factor.

738-3. Salary Incentive Aid shall be determined as follows:

791-the Oklahoma Statutes. The student identification system shall be
792-used specifically for the purpose of reporting en rollment data by
793-school sites and by school districts, the administration of the
794-Oklahoma School Testing Program Act, the collection of appropri ate
795-and necessary data pursuant to the Oklahoma Educational Indicators
796-Program, determining student enrollment, establishing a student
797803 mobility rate, allocation of the State Aid Formula and midyear
798804 adjustments in funding for student growth. This enrollmen t data
799805 shall be submitted to the State Department of Education in
800806 accordance with rules promulgated by the State Board of Education.
801807 Funding for the development, implementation, personnel training and
802808 maintenance of the student identification system shall be set out in
803809 a separate line item in the allocation section of the appropriation
804810 bill for the State Board of E ducation for each year.
805811 F. 1. In the event that ad valorem taxes of a school district
806812 are determined to be uncollectible because of bankruptcy , clerical
807813 error, or a successful tax protest, and the amount of such taxes
808814 deemed uncollectible exceeds Fifty T housand Dollars ($50,000.00) or
809815 an amount greater than twenty-five percent (25%) of ad valorem taxes
810816 per tax year, or the valuation of a distric t is lowered by order of
817+the State Board of Equalization, the school district ’s State Aid,
818+for the school year t hat such ad valorem taxes are calculated in the
819+State Aid Formula, shall be determined by subtracting the net
820+assessed valuation of the property upon which taxes were deemed
821+uncollectible from the assessed valuation of the school district and
822+the state. Upon request of the local board of education, it shall
823+be the duty of the county assessor to certify to the Director of
824+Finance of the State Depa rtment of Education the net assessed

848855 receives for reimbursement from the Ad Valorem Reimbursement Fund is
849856 less than the amount of funds claimed for reimbursement by the
850857 school district due to insufficiency of funds as provided in Sect ion
851858 193 of Title 62 of the Oklahoma Statutes, then the school district’s
852859 assessed valuation for the school year that such ad valorem
853860 reimbursement is calculated in the State Aid Formula shall be
854861 adjusted accordingly.
855862 G. 1. Notwithstanding the provisions of Section 18-112.2 of
856863 this title, a school district shall have its State Aid reduced by an
857864 amount equal to the amount of carryover in the gener al fund of the
858865 district as of June 30 of the preceding fiscal year, that is in
859866 excess of the following standards for two (2) consecutive years:

902910 balance penalty to be assessed against that school district.
903911 Calculation of the general fund balance penalty shall not include
904912 federal revenue. Within thirty (30) days of receipt of this written
905913 notice the school district shall submit to the Department a written
906914 reply either accepting or protesting the penalty to be assessed
907915 against the district. If protesting, the school district shall
908916 submit with its reply the reasons for rejecting the calculations and
909917 documentation supporting those reasons. The Dep artment shall review
910918 all school district penalty protest documentation and notify each
919+district by March 15 of i ts finding and the final penalty to be
920+assessed to each district. General fund balance penalties shall be
921+assessed to all school districts by A pril 1.
922+3. Any school district which receives proceeds from a tax
923+settlement or a Federal Emergency Management Agency settlement
924+during the last two (2) months of the preceding fiscal year shall be
925+exempt from the penalties assessed in this subsection, if the
926+penalty would occur solely as a result of receiving funds from the
927+tax settlement.

946955 4. Any school district which receives an increase in State Aid
947956 because of a change in Foundation and/or Salary Incentive Aid
948957 factors during the last two (2) months of the preceding fiscal year
949958 shall be exempt from the penalties assessed in this subsection, if
950959 the penalty would occur solely as a result of receiving funds from
951960 the increase in State Aid.
952961 5. If a school district does not receive Foundation and/or
953962 Salary Incentive Aid during the preceding fiscal year, the State
954963 Board of Education may waive the penalty assessed in thi s subsection
955964 if the penalty would result in a loss of more than forty percent
956965 (40%) of the remaining State Aid to be allocated to the school
957966 district between April 1 and the remainder of the school year and if
958967 the Board determines the penalty will cause th e school district not
959968 to meet remaining financial obligations.
969+6. Any school district which receives gross production revenue
970+apportionment during the 2002-2003 school year or in any subsequent
971+school year that is greater than the gross production revenue
972+apportionment of the preceding school year shall be exempt from the
973+penalty assessed in this subsection, if the penalty would occur
974+solely as a result of the gross production revenue apportionment, as
975+determined by the State Board of Education.
976+7. Beginning July 1, 2003, school districts that participate in
977+consolidation or annexation pursuant to the provisions of the
978+Oklahoma School Voluntary Consolidation and Annexation Act shall be

991-solely as a result of the gross production revenue apportionment, as
992-determined by the State Board of Education.
993-7. Beginning July 1, 2003, school districts that participate in
994-consolidation or annexation pursuant to the provisions of the
995-Oklahoma School Voluntary Consolidation and Annexation Act shall be
9961006 exempt from the penalty assessed in this subsection for the school
9971007 year in which the consolidation or annexation occurs and for the
9981008 next three (3) fiscal years.
9991009 8. Any school district which receives proceeds from a sales tax
10001010 levied by a municipality pursuant to Section 22 -159 of Title 11 of
10011011 the Oklahoma Statutes or proceeds from a sales tax levied by a
10021012 county pursuant to Section 1370 of Title 68 of the Oklahoma Statutes
10031013 during the 2003-2004 school year or the 2004 -2005 school year shall
10041014 be exempt from the penalties assessed in this subsection, if the
10051015 penalty would occur solel y as a result of receiving funds from the
10061016 sales tax levy.
10071017 9. Any school district which has an amount of carryover in the
10081018 general fund of the di strict in excess of the limits established in
10091019 paragraph 1 of this subsection during the fiscal years beginning
1020+July 1, 2020, July 1, 2021, July 1, 2022, and July 1, 2023, shall
1021+not be assessed a general fund balance penalty as provided for in
1022+this subsection.
1023+10. For purposes of calculating the general fund balance
1024+penalty, the terms “carryover” and “general fund balance” shall not
1025+include federal revenue.
1026+H. In order to provide startup funds for the implementation of
1027+early childhood programs, State Aid m ay be advanced to school
1028+districts that initially start early childhood instruction at a

10461057 shall make application to the State Department of Education no later
10471058 than September 15 of each year an d advanced funding shall be awarded
10481059 to the approved districts no later than October 30. The advanced
10491060 funding shall not exceed the per pupil amount of State Aid as
10501061 calculated in subsection D of this section per anticipated Head
10511062 Start eligible student. The total amount of advanced funding shall
10521063 be proportionately reduced from the monthly payments of the
10531064 district’s State Aid payments during the last six (6) months of the
10541065 same fiscal year.
10551066 I. 1. Beginning July 1, 1996, the Oklahoma Tax Commission,
10561067 notwithstanding any provision of law to the contrary, shall report
10571068 monthly to the State Department of Education the month ly
10581069 apportionment of the following information:
10591070 a. the assessed valuation of property,
1071+b. motor vehicle collections,
1072+c. R.E.A. tax collected, and
1073+d. gross productions tax collected.
1074+2. Beginning July 1, 1997, the State Auditor and Inspector ’s
1075+Office, notwithstanding any provision of law to the contrary, shall
1076+report monthly to the State Department of Education the monthly
1077+apportionment of the proc eeds of the county levy.

11021114 Auditor and Inspector ’s Office, the county treasurers ’ offices and
11031115 the Commissioners of the Land Office, pursuant to this subsection
11041116 shall be reported by school district on forms developed by the State
11051117 Department of Education.
11061118 SECTION 3. AMENDATORY 70 O.S. 2021, Section 18 -201.1, is
11071119 amended to read as follows:
11081120 Section 18-201.1 A. Beginning with the 2020-21 school year,
11091121 and each school year thereafter, t he weighted membership of a school
1122+district for calculation of Fo undation Aid purposes pursuant to
1123+paragraph 1 of subsection D of Section 18 -200.1 of this title shall
1124+be the sum of the weighted pupil grade level calculation, the

11501163 nine (9) weeks of the cu rrent school year or the preceding school
11511164 year of a school district, unless oth erwise specified. The higher

13511368 The small school district f ormula calculation shall apply
13521369 only to school districts whose highest average daily
13531370 membership is less than 529 pupils. School districts which
13541371 are consolidated or annexed after July 1, 2003, pur suant to

1797-dedicated revenues actually collected during the preceding fiscal
1798-year, the adjusted assessed valuation of the preceding year and the
1799-weighted average daily membership for the school district of the
1800-preceding school year. Each school district shall subm it the
1801-following data based on the first nine (9) weeks, to be used in the
1802-calculation of the average daily membe rship of the school district:

1832-On or before December 30, the State Department of Education
1833-shall determine each school district ’s current year allocati on
1834-pursuant to subsection D of this section. The State Department of
1835-Education shall complete an audit, using procedures established by
1836-the Department, of the student enrollment by grade level data, pupil
1837-category counts and transportation supplement data to be used in the
1838-State Aid Formula pursuant to subsection D of this section by
1839-December 1 and by January 15 shall notify each school district of
1840-the district’s final State Aid allocation for the current school
1841-year. The January payment of State Aid and each subsequent payment
1842-for the remainder of the school year shall be based on the final
1843-State Aid allocation as calculated in subsection D of this section.
1844-Except for reductions made due to the assessment of penalties by the
1845-State Department of Education according to law, the January payment
1846-of State Aid and each subsequent payment for the remainder of the
1847-school year shall not decrease by an a mount more than the amount
1848-that the current chargeable revenue increases for that district.
1849-B. The State Departm ent of Education shall retain not less than
1850-one and one-half percent (1 1/2%) of the total funds appropriated
1851-for financial support of schools, to be used to make midyear
1852-adjustments in State Aid and which shall be reflected in the final
1853-allocations. If the amount of appropriated fund s, including the one

1882-Department shall recalculate each school district ’s remaining
1883-allocation pursuant to subsection D of this section using the
1884-reduced amount of appropriated funds.
1885-C. On and after July 1, 1997, the amount of Sta te Aid each
1886-district shall receive shall be the sum of the Foundation Aid, the
1887-Salary Incentive Aid and the Trans portation Supplement, as adjus ted
1888-pursuant to the provisions of subsection G of this section and
1889-Section 18-112.2 of this title; provided, no d istrict having per
1890-pupil revenue in excess of three hundred percent (300%) of the
1891-average per pupil revenue of al l districts shall receive any State
1892-Aid or Supplement in State Aid.
1893-The July calculation of per pupil revenue shall be determined by
1894-dividing the district’s second preceding year ’s total weighted
1895-average daily membership (ADM) into the district ’s preceding year’s
1896-total revenues excludi ng federal revenue, insurance loss payments,
1897-reimbursements, recovery of overpayments and refunds, unused
1898-reserves, prior expenditures recovered, prior year surpluses, and
1899-less the amount of any transfer fees paid in that year .
1900-The December calculation of per pupil revenue shall be
1901-determined by dividing the district ’s preceding year’s total
1902-weighted average daily me mbership (ADM) into the district ’s
1903-preceding year’s total revenues excluding federal revenue, insurance

1936-1. Foundation Aid shall be determined by subtracting the amount
1937-of the Foundation Program Income from the cost of the Foundation
1938-Program and adding to th is difference the Transportati on Supplement.
1939-a. The Foundation Program shall be a district ’s higher
1940-weighted average daily membership based on the first
1941-nine (9) weeks of the current school year or the
1942-preceding school year of a school district, as
1943-determined by the provisions of subse ction A of
1944-Section 18-201.1 of this title and paragraphs 1, 2, 3
1945-and 4 of subsection B of Section 18 -201.1 of this
1946-title, multiplied by the Base Foundation Support
1947-Level. However, for the portion of weighted
1948-membership derived from nonresident, transferre d
1949-pupils enrolled in online courses, the Foundation
1950-Program shall be a district ’s weighted average daily
1951-membership of the preceding school year or the first
1952-nine (9) weeks of the current school year, whichever
1953-is greater, as determined by the provisions o f

1984-b. The Foundation Program Income shall be the su m of the

1986-(1) The adjusted assessed valuation of the current
1987-school year of the school district, minus the
1988-previous year protested ad valorem tax revenues
1989-held as prescribed in Section 2884 of Title 68 of
1990-the Oklahoma Statutes, multiplied by the mills
1991-levied pursuant to subse ction (c) of Section 9 of
1992-Article X of the Oklahoma Constitution, if
1993-applicable, as adjusted in subsection (c) of
1994-Section 8A of Article X of the Oklahoma
1995-Constitution. For purposes of this subsection,
1996-the “adjusted assessed valuation of the current
1997-school year” shall be the adjusted assessed
1998-valuation on which tax revenues are collected
1999-during the current school yea r, and
2000-(2) Seventy-five percent (75%) of the amount received
2001-by the school district from the proceeds of the
2002-county levy during the preceding f iscal year, as

2039-preceding fiscal year calculated on a per capita basis
2040-on the unit provided for by law for the distribution
2041-of each such revenue.
2042-2. The Transportation Supplement shall be equal to the average
2043-daily haul times the per capita allowance times the appropria te
2044-transportation factor.
2045-a. The average daily haul shall be the number of children
2046-in a district who are legally transported and who live
2047-one and one-half (1 1/2) miles or more from school.
2048-b. The per capita allowance shall be determined using the
2049-following chart:

2137-a. Multiply the Incentive Aid guarantee by the district’s

2140-preceding school year of a school di strict, as
2141-determined by the provisions of subsection A of
2142-Section 18-201.1 of this title and paragraphs 1, 2, 3

2144-title.
2145-b. Divide the district’s adjusted assessed valuation of
2146-the current school year minus the previous year’s
2147-protested ad valorem t ax revenues held as prescribed
2148-in Section 2884 of Title 68 of the Oklahoma Statutes,
2149-by one thousand (1,000) and subtract the quotient from
2150-the product of subparagraph a of this paragraph. The
2151-remainder shall not be less than zero (0).

2184-shall be the Salary Incentive Aid of the district.
2185-E. By June 30, 1998, the State Department of Education shall
2186-develop and the Department and all school districts shall hav e
2187-implemented a student identification sys tem which is consistent with
2188-the provisions of subsections C and D of Section 3111 of Title 74 of
2189-the Oklahoma Statutes. The student identification system shall be
2190-used specifically for the purpose of reporting en rollment data by
2191-school sites and by schoo l districts, the administratio n of the
2192-Oklahoma School Testing Program Act, the collection of appropri ate
2193-and necessary data pursuant to the Oklahoma Educational Indicators
2194-Program, determining student enrollment, establishing a student
2195-mobility rate, allocation of the State Aid Formul a and midyear
2196-adjustments in funding for student growth. This enrollmen t data
2197-shall be submitted to the State Department of Education in
2198-accordance with rules promulgated by the State Board of Education.
2199-Funding for the deve lopment, implementation, perso nnel training and
2200-maintenance of the student identification system shall be set out in
2201-

2229-F. 1. In the event that ad valorem taxes of a school district
2230-are determined to be uncollectible because of bankruptcy , clerical
2231-error, or a successful tax protest, and the amount of such taxes
2232-deemed uncollectible exceeds Fifty T housand Dollars ($50,000.00) or
2233-an amount greater than twenty-five percent (25%) of ad valorem taxes
2234-per tax year, or the valuation of a distric t is lowered by order of
2235-the State Board of Equalization, the school district ’s State Aid,
2236-for the school year t hat such ad valorem taxes are calculated i n the
2237-State Aid Formula, shall be determined by subtracting the net
2238-assessed valuation of the property upon which taxes were deemed
2239-uncollectible from the assessed valuation of the school district and
2240-the state. Upon request of the local board of educatio n, it shall
2241-be the duty of the county assessor to certify to the Director of
2242-Finance of the State Depa rtment of Education the net assessed
2243-valuation of the property upon which taxes were determined
2244-uncollectible.
2245-2. In the event that the amount of funds a school district
2246-receives for reimbursement from the Ad Valorem Reimbursement Fund is
2247-less than the amount of funds claimed for reimbursement by the
2248-school district due to insufficiency of funds as provided in Sect ion
2249-193 of Title 62 of the Oklahoma Statut es, then the school district’s
2250-assessed valuation for the school year that such ad valorem

2327-Calculation of the general fund balance penalty shall not include
2328-federal revenue. Within thirty (30) days of receipt of this written
2329-notice the school district shall submit to the Department a written
2330-reply either accepting or protesting the penalty to be assessed
2331-against the district. If protesting, the school district shall
2332-submit with its reply the reasons for rejecting the calculations and
2333-documentation supporting those reasons. The Dep artment shall review
2334-all school district penalty protest documentation and notify each
2335-district by March 15 of i ts finding and the final penalty to be
2336-assessed to each district. General fund balance penalties shall be
2337-assessed to all school districts by A pril 1.
2338-3. Any school district which receives proceeds from a tax
2339-settlement or a Federal Emergency Management Agency settlement
2340-during the last two (2) months of the preceding fiscal year shall be
2341-exempt from the penalties assessed in this subsection, if the
2342-penalty would occur solely as a result of receiving funds from the
2343-tax settlement.
2344-4. Any school district which receives an increase in State Aid
2345-because of a change in Foundation and/or Salary Incentive Aid
2346-factors during the last two (2) months of the preceding fiscal year
2347-shall be exempt from the penalties assessed in this subsection, if
2348-the penalty would occur solely as a result of receiving funds from
2349-the increase in State Aid.

2376-5. If a school district does not receive Foundation and/or
2377-Salary Incentive Aid during the preceding fiscal year, the State
2378-Board of Education may waive the penalty assessed in thi s subsection
2379-if the penalty would result i n a loss of more than forty percent
2380-(40%) of the remaining State Aid to be allocated to the school
2381-district between April 1 and the remainder of the school year and if
2382-the Board determines the penalty will cause th e school district not
2383-to meet remaining fi nancial obligations.
2384-6. Any school district which receives gross production revenue
2385-apportionment during the 2002-2003 school year or in any subsequent
2386-school year that is greater than the gross production revenue
2387-apportionment of the preceding school yea r shall be exempt from the
2388-penalty assessed in this subsection, if the penalty would occur
2389-solely as a result of the gross production revenue apportionment, as
2390-determined by the State Board of Education.
2391-7. Beginning July 1, 2003, school districts that pa rticipate in
2392-consolidation or annexation pursuant to the provisions of the
2393-Oklahoma School Voluntary Consolidation and Annexation Act shall be
2394-exempt from the penalty assessed in this subsection for the school
2395-year in which the consolidation or annexation occurs and for the
2396-next three (3) fiscal years.
2397-8. Any school district which receives proceeds from a sales tax
2398-levied by a municipality pursuant to Section 22 -159 of Title 11 of
2399-the Oklahoma Statutes or proceeds from a sales tax levied by a

2427-during the 2003-2004 school year or the 2004 -2005 school year shall
2428-be exempt from the penalties assessed in this subsection, if the
2429-penalty would occur solel y as a result of receiving funds from the
2430-sales tax levy.
2431-9. Any school district which has an amount of carryover in the
2432-general fund of the di strict in excess of the limits established in
2433-paragraph 1 of this subsection during the fiscal years beginning
2434-July 1, 2020, July 1, 2021, July 1, 2022, a nd July 1, 2023, shall
2435-not be assessed a general fund balance penalty as provided for in
2436-this subsection.
2437-10. For purposes of calculating the general fund balance
2438-penalty, the terms “carryover” and “general fund balance” shall not
2439-include federal revenue.
2440-H. In order to provide start up funds for the implementation of
2441-early childhood programs, State Aid m ay be advanced to school
2442-districts that initially start early childhood instruction at a
2443-school site. School di stricts that desire such advanced funding
2444-shall make application to the State Department of Education no later
2445-than September 15 of each year an d advanced funding shall be awarded
2446-to the approved districts no later than October 30. The advanced
2447-funding shall not exceed the per pupil amount of Sta te Aid as
2448-calculated in subsec tion D of this section per anticipated Head
2449-Start eligible student. The total amount of advanced funding shall

2479-I. 1. Beginning July 1, 1996, the Oklahoma Tax Commission,
2480-notwithstanding any provision of law to the contrary, shall report
2481-monthly to the State Department of Education the month ly
2482-apportionment of the following informat ion:
2483-a. the assessed valuation of property,
2484-b. motor vehicle collections,
2485-c. R.E.A. tax collected, and
2486-d. gross productions tax collected.
2487-2. Beginning July 1, 1997, the State Auditor and Inspector ’s
2488-Office, notwithstanding any provision of law to the con trary, shall
2489-report monthly to the State Department of Education the monthly
2490-apportionment of the proc eeds of the county levy.
2491-3. Beginning July 1, 1996, the Commissioners of the Land
2492-Office, notwithstanding any p rovision of law to the contrary, shall
2493-report monthly to the State Depar tment of Education the monthly
2494-apportionment of state apportionment.
2495-4. Beginning July 1, 1997, the county treasurers ’ offices,
2496-notwithstanding any provision of law to the contrary, s hall report
2497-monthly to the State Departmen t of Education the ad valorem tax
2498-protest amounts for each county.

1717+SECTION 4. This act shall become effective July 1, 2023.
1718+SECTION 5. It being immediately necessary for the preservation
