26	57		BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:

28	58		SECTION 1. AMENDATORY 47 O.S. 2021, Section 1135.1, as
29	59		last amended by Section 1, Chapter 392, O.S.L. 2022 (47 O.S. Supp.
30	60		2023, Section 1135.1), is amended to read as follows:
31		-
32	61		Section 1135.1. A. The Oklahoma Tax Commission is hereby
33	62		authorized to design and issue appropriate official special license
34	63		plates to persons as provided by this section.
35		-
36	64		Special license plates shall not be transferred to any other
37	65		person but shall be removed from the vehicle upon transfer of
38	66		ownership and retained. The special license plate may then be used

39	94		on another vehicle but only after such other vehicle has been
40	95		registered for the current year.

42	96		Except as provided in subsection B of this section, special
43	97		license plates shall be renewed each year by the Tax Commission or a
44	98		motor license agent. The Tax Commission shall annually notify by
45	99		mail all persons issued special license plates. The notice shall
46	100		contain all necessary information and shall contain instructions for
47		-

49	101		the renewal procedure upon presentation to a motor lice nse agent or
50	102		the Tax Commission. The license plates shall be issued on a
51	103		staggered system. The motor license agent fees shall be paid out of
52	104		the Oklahoma Tax Commission Reimbursement Fund.

54	105		On and after January 1, 2022, if a special license plate is
55	106		issued pursuant to this section, except for Legislative License
56	107		Plates issued pursuant to paragraph 30 of subsection B of Section
57	108		1135.2 of this title, any registration fee required for such plate
58	109		pursuant to this section and the fee required pursuant to Sectio n
59	110		1132 of this title shall be remitted at the same time and subject to
60	111		a single registration period. The Oklahoma Tax Commission shall
61	112		determine, by rule, a method for making required fee and
62	113		registration period adjustments if a special license plate is
63	114		obtained during a twelve-month period for which a registration fee
64	115		has already been remitted pursuant to Section 1132 of this title.
65	116		The combination of fees in a single remittance shall not alter the
66	117		apportionment otherwise provided for in this section.

68	145		On and after January 1, 2022, if a physically disabled license
69	146		plate is issued pursuant to paragraph 3 of subsection B of this
70	147		section, any registration fee required for such plate pursuant to
71	148		this section and the fee required pursuant to Section 1132 of thi s
72	149		title shall be remitted at the same time and subject to a single
73	150		registration period. The Oklahoma Tax Commission shall determine,
74	151		by rule, a method for making required fee and registration period
75	152		adjustments when a physically disabled license plate i s obtained

81	157		B. The special license plates provided by this section are as
82	158		follows:

84	159		1. Political Subdivision Plates - such plates shall be designed
85	160		for any vehicle owned by any political subdivision of this state
86	161		having obtained a proper Oklahoma certificate of title. Such
87	162		political subdivisions shall file an annual report with the Tax
88	163		Commission stating the agency where such vehicle is located. Such
89	164		license plates shall be permanent in nature and designed in such a
90	165		manner as to remain with the vehicle for the durati on of the life

93	166		span of the vehicle or until the title is transferred to an owner
94	167		who is not a political subdivision.

104	201		power unit owned and operated by a religious
105	202		corporation or society of this state holding a valid
106	203		exemption from taxation issued pursuant to Se ction
107	204		501(a) of the Internal Revenue Code, 26 U.S.C.,
108	205		Section 501(a), and listed as an exempt organization
109	206		in Section 501(c)(3) of the Internal Revenue Code, as
110	207		amended, 26 U.S.C., Section 501(c)(3), and that is
111	208		used by the corporation or society solely fo r the
112	209		furtherance of its religious functions,
113		-
114	210		b. any vehicle owned and operated only by nonprofit
115	211		organizations devoted exclusively to youth programs
116	212		including, but not limite d to, the Girl Scouts and Boy
117	213		Scouts of America,

119	214		c. any vehicle, except passenger automobiles, owned or
120	215		operated by nonprofit organizations actually involved
121	216		in programs for the employment of the handicapped and
122	217		used exclusively in the transportation of g oods or
123	218		materials for such organization,

137	254		nonprofit agencies and organizations, and

139	255		(2) holds a valid exemption from taxation issued
140	256		pursuant to Section 501(c) of the Internal
141	257		Revenue Code, as amended, 26 U.S.C., Section
142	258		501(c), and listed as an exempt organizat ion in
143	259		Section 501(c)(3) of the Internal Revenue Code,
144	260		as amended, and
145		-
146	261		(3) uses such vehicle exclusively for the
147	262		transportation of such surplus foods,
148		-
149	263		f. any vehicle which:
150		-
151	264		(1) is owned and operated by a private, nonprofit
152	265		organization which is exempt from taxation
153	266		pursuant to the provisions of Section 501(c)(3)
154	267		of the Internal Revenue Code, 26 U.S.C., Section
155	268		501(c)(3), and which is primarily funded by a

157	297		least one hundred local chapters or clubs, and

159	298		(2) is designed and used to provide mobile health
160	299		screening services to the general public at no
161	300		cost to the recipient, and for which no
162	301		reimbursement of any kind is received from any
163	302		health insurance provider, health maintenance
164	303		organization or governmental progr am, or
165		-
166	304		g. any vehicle owned and operated by the Civil Air
167	305		Patrol, a congressionally chartered corporation that
168	306		also serves an auxiliary of the United States Air
169	307		Force and which is exempt from taxation pursuant to
170	308		the provisions of Section 501(c)(3) of the Internal
171	309		Revenue Code, 26 U.S.C., Section 501(c)(3), and is
172	310		used exclusively for its corporate missions of
173	311		aerospace education, cadet programs and emergency
174	312		services. Such license plates shall be permanent in
175	313		nature and designed in such a manner as to rem ain with
176	314		the vehicle for the duration of the life span of the
177	315		vehicle or until the title to such vehicle is

180	316		transferred to an owner who is not subject to this
181	317		exemption. Such vehicles shall be exempt from the
182	318		registration fees levied under Section 1132 of this
183	319		title, except that an initial registration fee of

184	347		Twenty-five Dollars ($25.00) shall apply to each
185	348		vehicle.

187	349		Any person claiming to be eligible for a tax -exempt or nonprofit
188	350		license plate under the provisions of this paragraph must have the
189	351		name of the tax-exempt or nonprofit organization prominently
190	352		displayed upon the outside of the vehicle, except those vehicles
191	353		registered pursuant to the provisions of subpara graph b of this
192	354		paragraph, unless such display is prohibited by federal or state law
193	355		or by state agency rules. No vehicle shall be licensed as a tax-
194	356		exempt or nonprofit vehicle unless the vehicle has affixed on each
195	357		side thereof, in letters not less than two (2) inches high and two
196	358		(2) inches wide, the name of the tax-exempt or nonprofit
197	359		organization or the insignia or other symbol of such organization
198	360		which shall be of sufficient size, shape and color as to be readily
199	361		legible during daylight hours from a distance of fifty (50) feet
200	362		while the vehicle is not in motion.

202	363		Except as provided in subpar agraph g of this paragraph, the
203	364		registration fee shall be Eight Dollars ($8.00) and shall be in
204	365		addition to all other registration fees provided by law, except the
205	366		registration fees levied by Section 1132 of this title;

207	367		3. Physically Disabled License Plat es - such plates shall be
208	368		designed for persons who are eligible for a physically disabled
209	369		placard under the provisions of Section 15-112 of this title. It
210	370		shall prominently display the international accessibility symbol,

211	398		which is a stylized human figure i n a wheelchair. The Tax
212	399		Commission shall also design physically disabled license plates for
213	400		motorcycles owned by persons who are eligible for a physically
214	401		disabled placard pursuant to the provisions of Section 15-112 of
215	402		this title. Upon the death of the physically disabled person, the
216	403		disabled license plate shall be returned to the Tax Commission.
217	404		There shall be no fee for such plate in addition to the rate
218	405		provided by the Oklahoma Vehicle License and Registration Act for
219	406		the registration of the vehicle. For an additional fee of Ten
220	407		Dollars ($10.00), a person eligible for a physically disabled
221	408		license plate shall have the option of purchasing a duplicate
222		-

224	409		physically disabled special license plate which shall be securely
225	410		attached to the front of the vehicl e. The original physically
226	411		disabled special license plate shall be securely attached to the
227	412		rear of the vehicle at all times.

229	413		Any person who is eligible for a p hysically disabled license
230	414		plate and whose vehicle has had modifications because of the
231	415		physical disability of the owner or of a family member within the
232	416		second degree of consanguinity of the owner, may register the
233	417		vehicle for a flat fee of Twenty -five Dollars ($25.00). This fee
234	418		shall be in lieu of all other registration fees provided by the
235	419		Oklahoma Vehicle License and Registration Act;
236		-
237	420		4. Indian Tribal License Plates - such plates shall be designed
238	421		for any vehicle of a native Native American Indian Tribal

247	455		5. Hearing Impaired License Plates - such plates shall be
248	456		designed for persons who are hearing impaired. Such persons may
249	457		apply for a hearing-impaired license plate for each vehicle with a
250	458		rated carrying capacity of one (1) ton or less upon the presentme nt
251	459		of an application on a form furnished by the Tax Commission and
252	460		certified by a physician holding a valid license to practice
253	461		pursuant to the licensing prov isions of Title 59 of the Oklahoma
254	462		Statutes, attesting that the person is hearing impaired. The
255	463		license plate shall be designed so that such persons may be readily
256	464		identified as being hearing impaired. There shall be no additional
257	465		fee for the plate, but all other registration fees provided by the
258	466		Oklahoma Vehicle License and Registration Act shall ap ply; and
259		-
260	467		6. Antique or Classic Vehicles License Plates – such plates
261	468		shall be designed and issued for any vehicle twenty-five (25) years
262	469		of age or older, based upon the date of manufacture thereof and
263	470		which travels on the highways of this state primarily inci dental to
264	471		historical or exhibition purposes only.

268	499		The registration fee shall be Eight Dollars ($8.00) and shall be
269	500		in addition to all other registration fee s provided by law, except
270	501		the registration fees levied by Section 1132 of this title. Any
271	502		person registering an antique or classic vehicle may elect to have
272	503		the vehicle registered for a ten-year period. The registration fee
273	504		for the elected ten-year registration shall be Seventy-five Dollars
274	505		($75.00). The motor license agent registering the antique or
275	506		classic vehicle for a ten-year period shall receive one hundred
276	507		percent (100%) of the fees the motor license agent would have
277	508		otherwise received pursuant to subsection A of Section 1141.1 of
278	509		this title if the antiq ue or classic vehicle had been registered on
279	510		an annual basis; and

281	511		7. Honorary Consul License Plates – such plates shall be
282	512		designed to include the words “Honorary Consul” and issued to
283	513		persons who are honorary consuls authorized by the United States to
284	514		perform consular duties. Persons applying f or such license plates
285	515		must show proof of standing as an honorary consul. The fee for such
286	516		plate shall be Eight Dollars ($8.00) and shall be in addition t o all
287	517		other registration fees required by the Oklahoma Vehi cle License and
288	518		Registration Act. The own er of the vehicle that possesses such
289	519		license plates shall return the special license plates to the
290	520		Oklahoma Tax Commission if the owner disposes of the ve hicle during
291	521		the registration year or ceases to be authoriz ed to perform consular
292	522		duties.

295	551		designed in such a manner as to identify the use or ownership of the
296	552		vehicle. Use of any vehicle posses sing a special license plate
297	553		provided by this section for an y purpose not specified herein shall
298	554		be grounds for revocation of the special license plate and
299	555		registration certificate.

301	556		D. The fees provided by this section shall be deposited in the
302	557		Oklahoma Tax Commission Reimbursement Fund.

304	558		SECTION 2. It being immediately necessa ry for the preservation
305	559		of the public peace, health or safety, an emergency is hereby
306	560		declared to exist, by reason whereof this act shall take effect and
307	561		be in full force from and after its passage and approval.
