6756 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57+SECTION 1. NEW LAW A new section of law to be codified
58+in the Oklahoma Statutes as Section 6060.5b of Title 36, un less
59+there is created a duplication in numbering, reads as follows:
60+A. For the purposes of this section:
61+1. “Clinical utility” means clinical utility as defined
62+pursuant to Section 6060.5a of Title 36 of the Oklahoma Statutes;
63+2. “Evidence-based cancer imaging” means appropriate
64+preventative screening and imagi ng supported by evidence;

94-SECTION 1. NEW LAW A new section of law to be codified
95-in the Oklahoma Statutes as Section 6060.5b of Title 36, un less
96-there is created a duplication in numbering, reads as follo ws:
97-A. For the purposes of this section:
98-1. “Clinical utility” means clinical utility as defined
99-pursuant to Section 6060.5a of Title 36 of the Oklahoma Statutes;
100-2. “Evidence-based cancer imaging” means appropriate
101-preventative screening and imagi ng supported by evidence;
10292 3. “Genetic testing for an inherited mutation ” means multi-gene
10393 testing for an inherited mutation associated with an increased risk
10494 of cancer;
10595 4. “Health benefit plan” means a health benefit plan as defined
10696 pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes; and
10797 5. “Health care provider ” means any physician, hospital, or
10898 other entity or person that is l icensed or otherwise authorized in
10999 this state to furnish health care services.
110100 B. Any health benefit plan includin g the Oklahoma Employees
111101 Insurance Plan that is o ffered, issued, or renewed in this state on
112102 or after the effective date of this act shall pr ovide coverage for:
113103 1. Clinical genetic testing for an inherited gene mutation for
114104 individuals with a personal or family history of cancer when such
115105 test provides clinical utility and when orde red or recommended by a
116106 health care provider in accordance with medical and scientific
117107 evidence including, but not lim ited to:
108+a. the most recent version of the National Compreh ensive
109+Cancer Network (NCCN) clinical practice
110+recommendations that are level 2 a or higher,
111+b. Centers for Medicare and Medicaid Services nat ional
112+coverage determinations or Medicare administrative
113+contractor local coverage determinations, or
114+c. nationally recognized clinical practice guidelines;

153144 increased risk of cancer when such te st provides clinical utility
154145 and when ordered or recomme nded by a health care provider in
155146 accordance with the most recent version of the NCCN clinical
156147 practice recommendations that are level 2a or higher, or in
157148 accordance with other nationally recognized c linical practice
158149 guidelines.
159150 C. Coverage under this sec tion shall not be subject to any
160151 annual deductibles, copayments, or coinsurance limits as established
161152 for all covered benefits under the h ealth benefit plan.
162153 D. If application of this section would r esult in health
163154 savings account ineligibility under Sect ion 223 of the federal
164155 Internal Revenue Code, as amended, the provisions of this section
165156 shall only apply to health savings accounts with qualified high
166157 deductible health plans with respect to the ded uctible of such a
167158 plan after the enrollee has satisfied the minimum deductible.

194159 Provided, however, the provisions of this section shall apply to
195160 items or services that are preventive care pursu ant to Section
196161 223(c)(2)(C) of the federal Internal Revenue Co de, as amended,
