2957 BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:

3158 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -132, is
3259 amended to read as follows:

3460 Section 5-132. A. Any person who is of legal age and a
3561 resident of Oklahoma this state, over the age of twenty -one (21) and
3662 under the age of twenty -six (26), and who has not completed the
3763 twelfth grade in school shall be given the same educational
3864 privileges and opportuni ties provided by law for children over the
3965 age of five (5) and under th e age of twenty-one (21), upon
4066 submitting to the board of education of the school district in w hich

4194 the person resides evidence satisfactory to that board showing that
4295 during the time before he or she was twenty-one (21) years of age he
4396 or she was unable to attend school for a definite per iod or periods
4497 of time because of physical disability, or serv ice in the United
4598 States Armed Forces or Auxiliary Organizations , by reason whereof it
4699 was impossible for him or her to complete the twelfth grade before

49100 reaching the age of twenty-one (21). Provided, further, the pupil
50101 shall be counted in the average da ily attendance of the district
51102 where he or she attends school during the period of time provided
52103 for in this article section for the purpose of calculating State Aid
53104 for the district.

55105 B. Any resident of the state who is nineteen (19) years of age
56106 or older, who is not enrolled in any high school program, and who
57107 has not completed the twelfth gr ade may attend any adult high school
58108 completion program which is establ ished by a school district and
59109 approved by the State Board of Career and Technology Education if
60110 such attendance has the approval of the district offering the
61111 program. Such attendance shall not be counted in the average daily
62112 attendance of the district unless the Legislature ap propriates
63113 monies for adult high school completion programs. Such attend ance
64114 shall not be counted to meet minimum numbers for accreditat ion of
65115 the school district involved, and such students shall not attend
66116 classes which are a part of the normal class structure of the
67117 district.

69145 C. A person subject to the provisions of subse ction A or B of
70146 this section shall not be required to tak e the student assessments
71147 required by Section 1210.508 of this title .

73148 SECTION 2. AMENDATORY 70 O.S. 2021, Sectio n 5-132.1, is
74149 amended to read as follows:

76150 Section 5-132.1. A. Any person other than those persons
77151 provided for in Section 5 -132 of this title, who is twenty-one (21)
78152 years of age or older and who has not completed the re quirements for
79153 a high school diploma or received a General Education Diploma
80154 Development (GED) requirements , upon proper application to an
81155 independent school district may be given the o pportunity to complete
82156 the requirements for and receive a regular high school diploma.

84157 B. The school district or technology center school district in
85158 which such person resides may give the person the option of
86159 attending regular classes if class size restr ictions are not
87160 violated, or of partici pating in other programs which m ay be
88161 provided pursuant to provisi ons of the Oklahoma Statutes or rules
89162 promulgated by the State Board of Educ ation or State Board of Career
90163 and Technology Education. Providing Provided, however, that the

93164 school district may deny admittance of persons over twenty -one (21)
94165 years of age to its classes.

96166 C. The school district or technology center school district may
97167 charge such person an amount of tuition not to exceed the average
98168 expenditure per pupil of the district for the preceding school year.

103199 section shall not be required to take the student assessments

106201 SECTION 3. This act shall become effective July 1, 2024.

108202 SECTION 4. It being immediately necessary for the preservation
109203 of the public peace, health , or safety, an emergency is hereby
110204 declared to exist, by reason whereof this act shall take effect and
111205 be in full force from and after its passage and approval.
