58110 SECTION 1. AMENDATORY 36 O.S. 2021, Section 6960, as
59111 amended by Section 1, Chapter 38, O.S.L. 2022 (36 O.S. Supp. 2023,
60112 Section 6960), is amended to read as follows:

62113 Section 6960. For purposes of the Patient ’s Right to Pharmacy
63114 Choice Act:

65115 1. “Covered entity” means a nonprofit hospital or medical
66116 service organization, insurer, health benefit plan, health
67117 maintenance organization, health program administered by the state
68118 in the capacity of providing health coverage, or an employer, labor
69119 union, or other group of persons t hat provides health coverage to
70120 persons in this state. This term does not include a health plan
71121 that provides coverage only for accidental injury, specified
72122 disease, hospital indemnity, disability income, or other limited
73123 benefit health insurance policies and contracts that do not include
74124 prescription drug coverage;

76125 2. “Health insurer” means any corporation, association, benefit
77126 society, exchange, partnership or individual licensed by the
78127 Oklahoma Insurance Code;

80128 2. 3. “Health insurer payor ” means a health insurance company,

85159 3. 4. “Mail-order pharmacy” means a pharmacy licensed by this
86160 state that primarily dispenses and delivers covered drugs via common
87161 carrier;

89162 4. 5. “Pharmacy benefits manager ” or “PBM” means a person,
90163 business, or other entity that performs pharmacy benefits management
91-

93164 and any other person acting for such person under . The term shall
94165 include a person or entity acting on behalf of a PBM in a
95166 contractual or employment relationship in the performance of
96167 pharmacy benefits management for a managed-care managed care
97168 company, nonprofit hospital, medical service organization, insurance
98169 company, third-party payor or a health program administered by a
99170 department of this state;

101171 6. “Pharmacy benefits management ” means a service provided to
102172 covered entities to facilitate the provisions of prescription drug
103173 benefits to covered individuals with in this state including, but not
104174 limited to, negotiating pricing and other terms with drug
105175 manufacturers and providers. Pharmacy benefits m anagement may
106176 include any or all of the following services:

108177 a. claims processing, retail network management, and
109178 payment of claims to pharmacies for prescription drugs

144228 health benefit plan a contracted price for prescription drugs that
145229 differs from the amount the PBM directly or indirectly pays the

156264 SECTION 2. AMENDATORY 36 O.S. 2021, Section 6962, as
157265 last amended by Section 1, Chapter 293, O.S.L. 2023 (36 O.S. Supp.
158266 2023, Section 6962), is amended to read as follows:

160267 Section 6962. A. The Attorney General shall review and approve
161268 retail pharmacy network access for all pharmacy benefits managers
162269 (PBMs) to ensure compliance with Section 6961 of this title.

164270 B. A PBM, or an agent of a PBM, shall not:
165-
166271 1. Cause or knowingly permit the use of advertisement,
167272 promotion, solicitation, representation, proposal or offer that is
168273 untrue, deceptive or misleading;
169-
170274 2. Charge a pharmacist or pharmacy a fee related to the
171275 adjudication of a claim including without limitation a fee for:
172-
173276 a. the submission of a claim,
174-
175277 b. enrollment or participation in a retail pharmacy

184309 3. Reimburse a pharmacy or pharmacist in the state an amount
185310 less than the amount that the PBM reimburses a pharmacy owned by or
186311 under common ownership with a PBM f or providing the same covered
187312 services. The reimbursement amount paid to the pharmacy shall be
188313 equal to the reimbur sement amount calculated on a per -unit basis
189314 using the same generic product identifier or generic code number
190315 paid to the PBM-owned or PBM-affiliated pharmacy;

192316 4. Deny a provider the opportunity to participate in any
193317 pharmacy network at preferred particip ation status if the provider
194318 is willing to accept the terms and conditions that the PBM has
195319 established for other providers as a condition o f preferred network
196320 participation status;

198321 5. Deny, limit or terminate a provider ’s contract based on
199322 employment status of any employee who has an active license to
200323 dispense, despite probation status, with the State Board of
201324 Pharmacy;

203325 6. Retroactively den y or reduce reimbursement for a covered
204326 service claim after returning a paid claim response as part of the
205327 adjudication of the claim, unless:

207328 a. the original claim was submitted fraudulently, or
208-
209329 b. to correct errors identified in an audit, so long as
210330 the audit was conducted in compliance with Sections
211331 356.2 and 356.3 of Title 59 of the Oklahoma Statutes;

213359 7. Fail to make any payment due to a pharmacy or pharmacist for
214360 covered services properly rendered in the event a PBM terminates a
215361 provider from a pharmac y benefits manager network;

217362 8. Conduct or practice spread pricing, as defined in Section 1
218363 of this act Section 6960 of this title, in this state; or

237373 C. The prohibitions under this section shall apply to contracts
238374 between pharmacy benefits manager s and providers for participation
239375 in retail pharmacy networks.

241376 1. A PBM contract shall:

243377 a. not restrict, directly or indirectly, any pharma cy
244378 that dispenses a prescription drug from informing, or
245379 penalize such pharmacy for informing, an individual of
246380 any differential between the individual ’s out-of-
247381 pocket cost or coverage with respect to acquisition of

248409 the drug and the amount an individual wo uld pay to
249410 purchase the drug directly, and

251411 b. ensure that any entity that provides pharmacy benefits
252412 management services under a contract with any such
253413 health plan or health insurance coverage does not,
254414 with respect to such plan or coverage, restrict,
255415 directly or indirectly, a pharmacy that dispenses a
256416 prescription drug from informing, or penalize such
257417 pharmacy for informing, a covered individual of any
258418 differential between the individual ’s out-of-pocket
259419 cost under the plan or coverage with respect to
260420 acquisition of the drug and the amount an individual
261421 would pay for acquisition of the drug without using
262422 any health plan or health insurance coverage.

266423 2. A pharmacy benefits manager ’s contract with a provider shall
267424 not prohibit, restrict or limit disclosure of information and
268425 documents to the Attorney General, law enforcement or state and
269426 federal governmental officials inve stigating or examining a
270427 complaint or conducting a review of a pharmacy benefits manager ’s
271428 compliance with the requirements under the Patien t’s Right to
272429 Pharmacy Choice Act, Pharmacy Audit Integrity Act, and Section s 357
273430 through 360 of Title 59 of the Okla homa Statutes.

277459 1. Establish and maintain an electronic claim inquiry
278460 processing system using the Nat ional Council for Prescription Drug
279461 Programs’ Programs current standards to communicate information to
280462 pharmacies submitting claim inquiries;

282463 2. Fully disclose to insurers, self -funded employers, unions or
283464 other PBM clients the existence of the respective aggregate
284465 prescription drug discounts, rebates received from drug
285466 manufacturers and pharmacy audit recoupments;
286-
287467 3. Provide the Attorney General, insurers, self -funded employer
288468 plans and unions unrestricted audit rights of and access to the
289469 respective PBM pharmaceutical manufacturer and provider contracts,
290470 plan utilization data, plan pricing data, pharmacy utilization data
291471 and pharmacy pricing data;
292-
293472 4. Maintain, for no less than three (3) years, documentation of
294473 all network development activities includin g but not limited to
295474 contract negotiations and any denials to providers to join networks.
296475 This documentation shall be made available to the Attorney General
297476 upon request; and
298-
299477 5. Report to the Attorney General, on a quarterly basis for
300478 each health insurer payor, on the following information:

302479 a. the aggregate amount of rebates received by the PBM,
303-
304480 b. the aggregate amount of rebates distributed to the
305481 appropriate health insurer payor,

310510 enrollees of each heal th insurer payor at the point of
311511 sale that reduced the applicable deductible,
312512 copayment, coinsure or other cost shar ing amount of
313513 the enrollee,

315514 d. the individual and aggregate amount paid by the health
316515 insurer payor to the PBM for pharmacy services
317516 itemized by pharmacy, drug product and service
318517 provided, and
319-
320518 e. the individual and aggregate amount a PBM paid a
321519 provider for pharmacy services itemized by pharmacy,
322520 drug product and service provided.

324521 E. Nothing in the Patient ’s Right to Pharmacy Choice Act shal l
325522 prohibit the Attorney General from requesting and obtaining detailed
326523 data, including raw data, in response to the information provided by
327524 a PBM in the quarterly reports required by this section. The
328525 Attorney General may alter the frequency of the report s required by
329526 this section at his or her discretion.

331527 F. The Attorney General may promulgate rules to implement the
332528 provisions of the Patient ’s Right to Pharmacy Choice Act , Pharmacy
333529 Audit Integrity Act, and Sections 357 through 360 of Title 59 of the
334530 Oklahoma Statutes.

336558 SECTION 3. AMENDATORY 36 O.S. 2021, Section 6965, as

340561 Section 6965. A. The Attorney General shall ha ve power and
341562 authority to examine and investigate the affairs of every pharmacy
342563 benefits manager (PBM) engaged in ph armacy benefits management in
343564 this state in order to determine whether such entity is in
344565 compliance with the Patient ’s Right to Pharmacy Cho ice Act, Pharmacy
345566 Audit Integrity Act, and Section s 357 through 360 of Title 59 of the
346567 Oklahoma Statutes.

348568 B. The Attorney General shall have the power and authority to
349569 subpoena witnesses and records, whether prior to or during an
350570 investigation or prosecut ion of a complaint, from any relevant

353571 entity or persons to ensure compliance with the Patient ’s Right to
354572 Pharmacy Choice Act, Pharmacy Audit Integrity Act, and Sections 357

357574 C. All PBM files and records sha ll be subject to examination by
358575 the Attorney General or by duly appointed designees. The Attorney
359576 General, authorized employees and examiners shall have access to any
360577 of a PBM’s files and records that may relate to a particular
361578 complaint under investigati on or to an inquiry or examination by the
362579 Attorney General.

364580 C. D. Every officer, director, employee or agent of the PBM,
365581 upon receipt of any inquiry from the Attorney General , shall, within

366609 twenty (20) days from the date the inquiry is sent, furnish the
367610 Attorney General with an adequate response to the inquiry.

369611 D. E. When making an examination under this section, the
370612 Attorney General may retain subject matter experts, attorneys,
371613 appraisers, independent actuaries, independent certified public
372614 accountants or an accounting firm or individual holding a permit to
373615 practice public accounting, certified financial examiners or other
374616 professionals and specialists as examiners, the cost of which shall
375617 be borne by the PBM that is the subject of the examination.

377618 F. 1. Protected health information held by a PBM shall be
378619 provided at the request of the Attorney General for the purpos e of
379620 conducting investigations into potential violations of state laws
380621 and regulations related to the PBM. Disclosure of protected health
381622 information shall be limited to the extent necessary for the
382623 investigation and enforcement of state law.

384624 2. All disclosures of protected health information shall be
385625 made in compliance with all applicable federal and state privacy
386626 laws, including the Health Insurance Portability and Accountability
387627 Act of 1996 (HIPAA), and other relevant laws protecting the privacy
388628 and confidentiality of health information.

390629 3. Any protected health information obtained for an
391630 investigation shall be handled and maintained per applicable federal
392631 and state privacy laws and regulations, including HIPAA.

396659 4. Unauthorized disclosure of protected health information
397660 obtained during an investigation is strictly prohibited and subject
398661 to legal penalties.

400662 G. 1. If the Attorney General, after notice and opportunity
401663 for hearing, finds that any PBM operating within th is state has not
402664 fully cooperated with an investigation or inquiry conducted by the
403665 Attorney General related to compliance with the Patient ’s Right to
404666 Pharmacy Choice Act, Pha rmacy Audit Integrity Act, and Sections 357
405667 through 360 of Title 59 of the Oklahoma Statutes, the Attorney
406668 General may instruct the Insurance Commissioner that the PBM be
407669 censured or his or her license be revoked. If the Attorney General
408670 makes such instruction, the Insurance Commissioner shall enforce the
409671 instructed action within thirty (30) days.

411672 2. In addition to or in lieu of any censure, suspension, or
412673 revocation by the Insurance Commissioner, the Attorney General may
413674 levy a civil fine not less than O ne Hundred Dollars ($100.00) and
414675 not greater than Ten Thousand Dollars ($10,000.00) for each
415676 violation of this subse ction and assess any other penalty or remedy
416677 authorized by this act. For purposes of this section, each day a
417678 PBM fails to comply with an i nvestigation or inquiry may be
418679 considered a separate violation.

426712 civil penalty against any person licensed under the insurance laws
427713 of this state for any violation of the Patient ’s Right to Pharmacy
428714 Choice Act, Section 6958 et seq. of this title.

433718 Choice Act, the Pharmacy Audit Integrity Act or the provisions of

435720 Statutes, the Attorney General may recommend instruct the Insurance
436721 Commissioner that the PBM be censured, or his or her license may be
437722 suspended or revoked and a penalty or remedy authorized by this act

440723 may be imposed. If the Attorney General mak es such recommendation
441724 instruction, the Insurance Commissioner shall take the recommended
442725 action enforce such action within thirty (30) days .

444726 2. In addition to or in lieu of any censure, suspension or
445727 revocation of a license by the Insurance Commissioner, a PBM the
446728 Attorney General may be subject to levy a civil or administrative
447729 fine of not less than One Hundred Dollars ($100.00) and not greater
448730 than Ten Thousand Dollars ($10,000.00) for each violation of the
449731 provisions of the Patient ’s Right to Pharmacy Choice Act, the
450732 Pharmacy Audit Integrity Act or the provisions of Sections 357

495821 or denied renewal or who has had a fine levied against him or her
496822 shall have the right of appeal from the final order of the Attorney

500825 G. If the Attorney General determines, ba sed upon an
501826 investigation of complaints, that a PBM has engaged in violations of

539911 There is hereby created in the State Treasury a revolving fund
540912 for the Office of the Attorney General, to be designated the
541913 “Attorney General’s Pharmacy Benefits Manager Enforcement Revolving
542914 Fund”. The fund shall be a continuing fund, not subject to fiscal
543915 year limitations, and shall consist of any monies collected by the
544916 Attorney General and designated to the fund by law, including those
545917 levied for activities related to enforcement of the Patient ’s Right
546918 to Pharmacy Choice Act, the Pharmacy Audit Integrity Act, and the
547919 provisions of Sections 357 through 360 of Title 59 of the Oklahoma
548920 Statutes. All monies accruing to the credit of the fund are he reby
549921 appropriated and may be budgeted and expended by the Attorney
550922 General for the purposes provided in this section. Expenditures
551923 from the fund shall be made upon warrants issued by the State
552924 Treasurer against claims filed as prescribed by law with the
553925 Director of the Office of Management and Enterprise Services for
554926 approval and payment.

582976 Attorney General or Insurance Commissioner or Pharmacy Choice
583977 Commission. Such orders shall be open records.

585978 C. Nothing in this section shall prevent the Attorney General
586979 from making public, in the form of an examination report, any
587980 findings from an exami nation pursuant to Section 6965 of this title.
588981 It shall be the Attorney General ’s sole discretion to determine
589982 whether it is in the public ’s interest to publish these findings.
590983 Only the final examination report shall be made public. Any
