27		-	BE IT ENACTED BY THE PEOPLE OF THE STATE OF 7 OKLAHOMA:

29	56		SECTION 1. AMENDATORY 2 O.S. 2021, Section 10 -9.17, is
30	57		amended to read as follows:

32	58		Section 10-9.17. A. It shall be unlawful and a misdemeanor
33	59		punishable by a fine of not more than Five Thousand Dollars
34	60		($5,000.00) for any person to act, operate, or do business or
35	61		advertise as a commercial poultry waste applicator or to l and-apply
36	62		poultry waste as a private poultry waste applicator unless such
37	63		person has obtained a vali d applicator’s certificate issued by the
38	64		State Board of Agriculture Oklahoma Department of Agriculture, Food,
39	65		and Forestry.

41	93		B. Applicator’s certificates shall be issued by the Board,
42	94		Department to applicants who qualify under the provisions of the
43	95		Oklahoma Poultry Waste Applicators Certification Act.

45	96		C. Certificates shall be issued only upon application therefor
46	97		to the Board Department on a form of applicat ion prescribed by the

49	98		Board Department. The application shall contain information
50	99		regarding the applicant’s qualifications and proposed operations and
51	100		such other information as may be specified by the Board Department.

53	101		D. A certificate shall be issued on ly after satisfactory
54	102		completion of such certification standards as determined by the
55	103		Board Department.

57	104		E. 1. All The Department shall issue a commercial applicator
58	105		certificates shall expire on the thirty -first day of December
59	106		following their issuance or renewal, and may be renewed for the
60	107		ensuing calendar year, without penalty, certificate for a five -year
61	108		period if a properly completed application is fil ed with the Board
62	109		Department not later than the first day of January of each year the
63	110		subsequent five-year period. A registration fee of Fifteen Dollars
64	111		($15.00) Seventy-Five Dollars ($75.00) shall accompany every initial
65	112		and renewal application for certi fication. A renewal fee of Fifteen
66	113		Dollars ($15.00) shall accompany every renewal application.

68	114		2. All The Department shall issue a private applicator
69	115		certificates shall be in effect for five (5) years and may be
70	116		renewed by certificate for a five -year period if a properly

71	144		completed application is filed with the Department not later than
72	145		the first day of January of the subsequent five -year period. A
73	146		registration fee of Fifteen Dollars ($15.00) shall accompany every
74	147		initial and renewal application for certi fication. A renewal fee of
75	148		Fifteen Dollars ($15.00) shall accompany every renewal application.
76	149		The Fifteen Dollar ($15.00) registration and renewal fee shall be
77	150		waived if the private applicator is als o registered pursuant to the
78	151		Oklahoma Registered Poult ry Feeding Operations Act.

80	152		3. The Department shall issue all certificates for five -year
81	153		periods beginning January 1, 2025 , and expiring on December 31,
82	154		2029, followed by successive five -year periods.

84	155		4. All such fees shall be deposited in the Agriculture
85	156		Regulation Revolving Fund to be used for the purpose of implementing
86	157		the provisions of the Oklahoma R egistered Poultry Feeding Operations
87	158		Act and the Oklahoma Poultry Waste Applicators Certification Ac t.

91	159		F. Any person issued an applicator ’s certificate shall comply
92	160		with the education provisions of subsection F of Section 10 -9.5 of
93	161		this title.

95	162		SECTION 2. This act shall become effective November 1, 2024.
