2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 22 O.S. 202 1, Section 1094, is
3057 amended to read as follows:

3258 Section 1094. A. There is hereby created the Oklahoma State
3359 Council for Interstate Adult Offender Supervis ion in accordance with
3460 Article IV of the Interstate Compact for Interstate Adult Offender
3561 Supervision. The State Council shall consist of the compact
3662 administrator who shall be a nonvoting member, the Executive
3763 Coordinator or designee of the District Attorneys Council, the
3864 Executive Director or designee of the Oklahoma Indigent Defense
3965 System and the Administrative Director of the Courts or designee ,

4093 who shall be nonvoting members and five appointed members who,
4194 except for the initial appointments, shall b e appointed for three -
4295 year terms. The members appointed to initial terms shall serve
4396 staggered terms as prescribed in this section. Terms of office
4497 shall expire on June 30. Members may be reappointed as deemed
4598 appropriate by the appoin ting authority. Members may be removed by
4699 the appointing authority for incompetence, willful neglect of duty,

49100 corruption in office, or malfeas ance in office. Vacanc ies shall be
50101 filled in the same manner as the original appointment. The members
51102 of the Council shall not be subject to the dual office holding
52103 prohibitions set forth in Section 6 of Title 51 of the Oklahoma
53104 Statutes. The members shall be appointed as follows:

55105 1. One member of the Senate, who shall serve an initial term of
56106 three (3) years, who shall be appointed by the President Pro
57107 Tempore;

59108 2. One member of the House of Representatives, who shall serve
60109 an initial term of three (3) years, who shall be ap pointed by the
61110 Speaker of the House of Representatives;

63111 3. One member of the judiciary who shall be a distr ict judge
64112 with experience in criminal proceedings, who shall serve an initial
65113 term of two (2) years, to b e appointed by the Presiding Judge of the
66114 Court of Criminal Appeals;

68142 4. One member of the Pardon and Parole Board, who shall serve
69143 an initial term of two (2) years, who shall be appointed by the
70144 Governor with the advice and consent of the Senate; and

72145 5. One member who repre sents a crime victims a dvocacy group,
73146 who shall serve an initial term of one (1) year, to be appointed by
74147 the Governor.

76148 B. The members of the State Council shall elect from their
77149 membership a chair and vice-chair vice chair to serve for one (1)
78150 year terms. A majority of the members shall const itute a quorum for
79151 the purpose of conducting the business of the Council. The Council
80152 shall meet at least annually and at the call of the chair.

82153 C. The Council shall comply with the Oklahom a Open Meeting Act,
83154 the Oklahoma Open Records Act, and the Oklahoma Administrative
84155 Procedures Act.

86156 D. Members of the Council, except the compact administra tor,
87157 shall serve without compensation but shall be reimbursed by their
88158 appointing authorities for expense s incurred in the performance of
89159 their duties as provided in the State Travel Reimbursement Act until
90160 the Council is funded.

94161 E. The Council shall oversee and administer this state ’s
95162 participation in the Compact. The Council may promulgate rules to
96163 implement operations and procedures n ecessary for administration of
97164 the compact.

99192 F. Until the Compact becomes effective upon its adoption by
100193 thirty-five states, the Council may select a person who is employed
101194 by a state agency, subject to the assent of the admi nistrative head
102195 of the agency, to serve as the compact administrator. The agency
103196 that employs the compact administrator shall pay th e salary of the
104197 compact administrator and any ex penses the compact administrator
105198 incurs in fulfilling duties related t o the Compact. The Council and
106199 the administrative head of the agen cy shall determine what portion
107200 of the employee’s time shall be devoted to Compact activi ties. The
108201 compact administrator shall serve as this state ’s commissioner on
109202 the Interstate Commission fo r Adult Offender Supervision. In the
110203 event the compact administrator cannot attend a meeting of the
111204 Interstate Commission, the Counc il shall appoint a Council member to
112205 represent this state at the meeting.
