27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 22 O.S. 202 1, Section 1094, is
30	57		amended to read as follows:

32	58		Section 1094. A. There is hereby created the Oklahoma State
33	59		Council for Interstate Adult Offender Supervis ion in accordance with
34	60		Article IV of the Interstate Compact for Interstate Adult Offender
35	61		Supervision. The State Council shall consist of the compact
36	62		administrator who shall be a nonvoting member, the Executive
37	63		Coordinator or designee of the District Attorneys Council, the
38	64		Executive Director or designee of the Oklahoma Indigent Defense
39	65		System and the Administrative Director of the Courts or designee ,

40	93		who shall be nonvoting members and five appointed members who,
41	94		except for the initial appointments, shall b e appointed for three -
42	95		year terms. The members appointed to initial terms shall serve
43	96		staggered terms as prescribed in this section. Terms of office
44	97		shall expire on June 30. Members may be reappointed as deemed
45	98		appropriate by the appoin ting authority. Members may be removed by
46	99		the appointing authority for incompetence, willful neglect of duty,

49	100		corruption in office, or malfeas ance in office. Vacanc ies shall be
50	101		filled in the same manner as the original appointment. The members
51	102		of the Council shall not be subject to the dual office holding
52	103		prohibitions set forth in Section 6 of Title 51 of the Oklahoma
53	104		Statutes. The members shall be appointed as follows:

55	105		1. One member of the Senate, who shall serve an initial term of
56	106		three (3) years, who shall be appointed by the President Pro
57	107		Tempore;

59	108		2. One member of the House of Representatives, who shall serve
60	109		an initial term of three (3) years, who shall be ap pointed by the
61	110		Speaker of the House of Representatives;

63	111		3. One member of the judiciary who shall be a distr ict judge
64	112		with experience in criminal proceedings, who shall serve an initial
65	113		term of two (2) years, to b e appointed by the Presiding Judge of the
66	114		Court of Criminal Appeals;

68	142		4. One member of the Pardon and Parole Board, who shall serve
69	143		an initial term of two (2) years, who shall be appointed by the
70	144		Governor with the advice and consent of the Senate; and

72	145		5. One member who repre sents a crime victims a dvocacy group,
73	146		who shall serve an initial term of one (1) year, to be appointed by
74	147		the Governor.

76	148		B. The members of the State Council shall elect from their
77	149		membership a chair and vice-chair vice chair to serve for one (1)
78	150		year terms. A majority of the members shall const itute a quorum for
79	151		the purpose of conducting the business of the Council. The Council
80	152		shall meet at least annually and at the call of the chair.

82	153		C. The Council shall comply with the Oklahom a Open Meeting Act,
83	154		the Oklahoma Open Records Act, and the Oklahoma Administrative
84	155		Procedures Act.

86	156		D. Members of the Council, except the compact administra tor,
87	157		shall serve without compensation but shall be reimbursed by their
88	158		appointing authorities for expense s incurred in the performance of
89	159		their duties as provided in the State Travel Reimbursement Act until
90	160		the Council is funded.

94	161		E. The Council shall oversee and administer this state ’s
95	162		participation in the Compact. The Council may promulgate rules to
96	163		implement operations and procedures n ecessary for administration of
97	164		the compact.

99	192		F. Until the Compact becomes effective upon its adoption by
100	193		thirty-five states, the Council may select a person who is employed
101	194		by a state agency, subject to the assent of the admi nistrative head
102	195		of the agency, to serve as the compact administrator. The agency
103	196		that employs the compact administrator shall pay th e salary of the
104	197		compact administrator and any ex penses the compact administrator
105	198		incurs in fulfilling duties related t o the Compact. The Council and
106	199		the administrative head of the agen cy shall determine what portion
107	200		of the employee’s time shall be devoted to Compact activi ties. The
108	201		compact administrator shall serve as this state ’s commissioner on
109	202		the Interstate Commission fo r Adult Offender Supervision. In the
110	203		event the compact administrator cannot attend a meeting of the
111	204		Interstate Commission, the Counc il shall appoint a Council member to
112	205		represent this state at the meeting.
