An Act ENROLLED SENATE BILL NO. 1543 By: Hall of the Senate and Boatman of the House An Act relating to unlawful contracts; amending 15 O.S. 2021, Section 219A, which relates to noncompetition agreements; clarifying certain contractual provisions; and providing an effective date. SUBJECT: Noncompetition agreements BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. AMENDATORY 15 O.S. 2021, Section 219A, is amended to read as follows: Section 219A. A. A person who makes an agreement with an employer, whether in writing or verbally, not to compete with the employer after the employment relationship has been terminated, shall be permitted to engage in the same business as that conducted by the former employer or in a similar business as that conducted by the former employer as long as the former employee does not directly solicit, directly or indirectly, actively or inactively, the sale of goods, services or a combination of goods and services from the established customers or independent contractors of the former employer. B. Any provision in a contract between an employer and an employee in conflict with the provisions of this section shall be void and unenforceable. SECTION 2.
