4397 3. “Electrical apprentice ” means any person sixteen (16) years
4498 of age or older whose principal occupation is the learning of and
4599 assisting in the ins tallation of electrical work under the direct

51102 4. “Journeyman electrician ” means any person other than an
52103 electrical contractor who engages in the actual installation,
53104 alteration, repair or renovation of electrical f acilities or
54105 electrical construction work unless specifically exempted by the
55106 provisions of the Electrical License Act;

57107 5. “Electrical contractor ” means any person skilled in the
58108 planning, superintending and practical in stallation of electrical
59109 facilities who is familiar with t he laws, rules and regulations
60110 governing such work. Electrical contractor also means any
61111 individual, firm, partnership, corporation, limited liability
62112 company or business performing skills of an el ectrical contractor or
63113 an electrician or the business of c ontracting, or furnishing labor
64114 or labor and materials for the installation, repair, maintenance or
65115 renovation of electrical facilities or electrical construction work
66116 according to the provisions of the Electrical License Act;

68117 6. “Electrical facilities ” means all wiring, fixtures,
69118 appurtenances and appliances for, and in connection with, a supply
70119 of electricity within or adjacent to any building, structure or

71147 conveyance on the premises but not inclu ding the connection with a

74149 7. “Category” means the classification by which licenses and
75150 electrical work may be limited. Such categories shall include but
76151 shall not be limited to installation, maintenance, repair,
77152 alteration, residential, oi lfield and commercial;

79153 8. “Temporary journeyman electrician” means any person other
80154 than a person permanently licensed as a journeyman electrician or
81155 electrical contractor in this state who meets the temporary
82156 licensure requirements of Section 1685.1 of t his title;

84157 9. “Variance and Appeals Board” means the Oklahoma State
85158 Electrical Installation Code Variance and Appeals Board;

87159 10. “Electrical construction work ” means installation,
88160 fabrication or assembly of equipment or systems included in
89161 “premises wiring” as defined in the National Electrical Code

92162 (reference 158:40-1-4. Standard of Installation), and which is
93163 hereby adopted and incorporated by reference. Electrical
94164 construction work includes but is not limited to ins tallation of
95165 raceway systems used f or any electrical purpo ses, and installation
96166 of field-assembled systems such as ice and snow melting, pipe -
97167 tracing and manufactured wiring systems. Electrical construction
98168 work shall not include in -plant work performed b y employees of the
99169 company owning the plant, work performe d by telecommunications
100170 employees for telecommunications companies or installation of

101198 factory-assembled appliances or machinery which is not part of the
102199 premises wiring unless wiring interconnection s external to the
103200 equipment are required in the field;

105201 11. “Electrical work” means work consisting primarily of the
106202 layout, installation, maintenance, repair, testing or replacement of
107203 all or part of electrical wires, conduits, apparatus, fixtures,
108204 appliances or equipment for transmitting, carrying, controlling or
109205 using electricity in, on, outside or attached to a building,
110206 structure, property or premises. Electrical work shall not mean
111207 work that is related to or facilitates the construction,
112208 installation or maintenance of all or part of a n electrical system,
113209 but which does not involve actual work with any of the electrical
114210 components provided in this definition; and

116211 12. “Student electrical intern apprentice” means any person
117212 sixteen (16) years of age or older who complies with the
118213 requirements for registration under Section 1686 of this title.

120214 B. Class 2 and Class 3 circuits shall be exempt from the
121215 requirements of electrical licensing of either an electrical
122216 contractor or a journeyman electrician, provi ded the work is
123217 performed in accordance with the National Fire Protection
124218 Association 70 requirements for Class 2 and Class 3 circuits.

129248 Section 1686. A. The Construction Industries B oard shall, upon
130249 proper application and payment of fee, register as an electrical
131250 apprentice and issue a certificate of such registration to any
132251 person who furnishes satisfactory proof to the Board that the
133252 applicant is:

139254 2. Enrolled in a school or federal training program for
140255 electrical apprentices recognized by the Board or employed as an
141256 electrical apprentice with an active licensed electrical contractor.

143257 B. The Construction I ndustries Board shall, upon proper
144258 application and payment of fee, register as a student electrical
145259 intern apprentice and issue a certificate of such registration to
146260 any person who furnishes satisfactory proof to the Board that the
147261 applicant is:

149262 1. Sixteen (16) years of age or older; and

151263 2. Enrolled in high sch ool and enrolled in a work-ready or
152264 similar program recognized by the Board ; and

154265 3. Employed with an active licensed electrical contractor.

156266 A student apprentice may not apply more than five hundred (500)
157267 hours per school year toward his or her journeyman requirements.

159268 C. All applications for examination, license or renewal of
160269 license shall be made in writing to the Board on forms provided, if
161270 necessary, by the Board. All applications shall be acco mpanied by
162271 the appropriate fee.

164299 D. Apprentices and studen t electrical interns apprentices, when
165300 required by the Board, shall provide such documents, statements or
166301 other information as may be necessary to submit to a national
167302 criminal history record check as defined by Section 150.9 of Titl e
168303 74 of the Oklahoma St atutes.

170304 SECTION 3. AMENDATORY 59 O.S. 2021, Section 1688, is
171305 amended to read as follows:

173306 Section 1688. A. No license shall be issued for longer than
174307 one (1) year, and all licenses shall expire on the last day in the
175308 birth month of the licensee. A license may be renewed upon
176309 application and payment of fees thirty (30) days preceding or
177310 following the date the license is due. Licenses renewed more than

180311 thirty (30) days foll owing the date of expiration may be renewed
181312 only upon application and payment of all required fees and payment
182313 of any penalty for late renewal established by the Construction
183314 Industries Board and upon compliance with any applicable continuing
184315 education requirements established by the Board and the Electrical
185316 License Act. No penalty for late renewal shall be charged to any
186317 holder of a license which expires while the holder is in military
187318 service, if an application for renewal is made within one (1) year
188319 following the service discharge of the holder.

190320 B. No journeyman or contractor license shall be renewed unless
191321 the licensee has completed the required hours of continuing

193350 Examiners and approved by the Construction Industries Board.

195351 C. An apprentice registration certificate or a student intern
196352 registration certificate shall be issued for one (1) year, at which
197353 time the apprentice may reregister upon meeting the requirements of
198354 the Construction Industries Board and paying the renewal fee.

200355 D. A student apprentice registration certificate shall be
201356 issued for the registrant's school year. A student apprentice
202357 registration expires on the last day of the registrant's school
203358 year, at which time th e apprentice may reregister upon meeting the
204359 requirements of the Construction Industries Board and paying th e
205360 renewal fee.

207361 SECTION 4. AMENDATORY 59 O.S. 2021, Section 1689, is
208362 amended to read as follows:

210363 Section 1689. A. The Construction Industries Board or its
211364 designee and the Committee of Electrical Examiners shall act as the
212365 Electrical Hearing Board and shall comply with the provisions of
213366 Article II of the Administrative Procedures Act, Section 308a et
214367 seq. of Title 75 of the Oklahoma Statutes.

216368 B. Any administrative hearing on suspensions, revocations or
217369 fines shall be conducted by a hearing examiner appointed by the
218370 Board. The hearing examiner ’s decision shall be a final decision
219371 which may be appealed to a district court in accordance with the
220372 Administrative Procedures Act.

224400 C. The Electrical Hearing Board may, upon its own motion, and
225401 shall, upon written complaint filed by any person, investigate the
226402 business transactions of any electrical contractor , journeyman
227403 electrician, electrical apprentice, student electrical intern
228404 apprentice or poultry house contractor license. Upon a finding by
229405 clear and convincing evidence, the Board shall suspend or revoke any
230406 license or registration obtained by false or fraudulent
231407 representation. Upon a finding by clear and conv incing evidence,
232408 the Board shall also suspend or revoke any license or registration
233409 for any of the following:

235410 1. Making a material misstatement in the application for a
236411 license or registration, o r the renewal of a licens e or
237412 registration;
238-
239413 2. Loaning or illegally using a license;
240-
241414 3. Demonstrating incompetence to act as a journeyman
242415 electrician or electrical contractor;
243-
244416 4. Violating any provisions of the Electrical License Act, or
245417 any rule or order prescribed by the Boar d or any ordinance for the
246418 installation of electrical facilities made or enacted by a city or
247419 town by authority of the Electrical License Act;

249420 5. Willfully failing to perform normal business obligations
250421 without justifiable cause; or

252449 6. Failing to maintai n a registration or license as requ ired by
253450 law in another state while registered in this state as a nonresident
254451 contractor.

256452 D. Any person whose license or registration has been revoked by
257453 the Electrical Hearing Board may apply for a new license one (1)
258454 year from the date of such revocation .

260455 E. Notwithstanding any other provision of law, a political
261456 subdivision of this state that has adopted a nationally recognized
262457 electrical code and appointed an inspector pursuant to the
263458 provisions of Section 1693 of thi s title or pursuant to the
264459 provisions of the Oklahoma Inspectors Act for such work shall have
265460 jurisdiction over the interpretation of the code and the

268461 installation of all electrical work done in that political
269462 subdivision, subject to the provisions of the Oklahoma Inspectors
270463 Act. Provided, a state inspector may work directly with an
271464 electrical contractor, journeyman electrician, electrical apprentice
272465 or student electrical intern apprentice in such a locality if a
273466 violation of the code creates an immediate threat to life or health.

275467 F. In the case of a complaint about, investigation of or
276468 inspection of any license, registration, permit or electrical work
277469 in any political subdivision of this state which has not adopted a
278470 nationally recognized electrical code and appointed an inspector
279471 pursuant to the provisions of Section 1693 of this title or pursuant
280472 to the provisions of the Oklahoma Inspectors Act for such work, the

281500 Construction Industries Board shall have jurisdiction over such
282501 matters.

284502 G. 1. No individual, business, company, corporation,
285503 association or other entity subject to the provisions of the
286504 Electrical License Act shall install, modify or alter electrical
287505 facilities in any incorporated area of this state which has not
288506 adopted a nationally recognize d electrical code and appointed an
289507 inspector pursuant to the provisions of Section 1693 of this title
290508 or pursuant to the provisions of the Oklahoma Inspectors Act for
291509 such work without providing notice of such electrical work to th e
292510 Construction Industries Board. A notice form for reproduc tion by an
293511 individual or entity required to make such notice shall be provided
294512 by the Construction Industries Board upon request.

296513 2. Notice to the Construction Industries Board pursuant to this
297514 subsection shall not be re quired for electrical maintenance o r
298515 replacement of existing electrical appliances or fixtures or of any
299516 petroleum refinery or its research facilities.

301517 3. Enforcement of this subsection is authorized pursuant to the
302518 Electrical License Act, or under author ity granted to the
303519 Construction Industries Board.

305520 SECTION 5. AMENDATORY 59 O.S. 2021, Section 1699, is

313552 that no such student electrical intern apprentice shall be counted
314553 against the maximum number of apprentices who are allowed by law or
315554 regulation to work under the supervision of a single journeyman or
316555 contractor. A student electrical intern apprentice is not allowed
317556 to work on high voltage systems defined by the National Electrical
318557 Code.
