33	64		SECTION 1. AMENDATORY 59 O.S. 2021, Section 1682, is
34	65		amended to read as follows:

36	66		Section 1682. A. As used in the Electrical License Act:
37		-
38	67		1. “Board” means the Construction Industries Board;
39		-
40	68		2. “Committee” means the Committee of Electrical Examiners

43	97		3. “Electrical apprentice ” means any person sixteen (16) years
44	98		of age or older whose principal occupation is the learning of and
45	99		assisting in the ins tallation of electrical work under the direct

49	101		contractor;

51	102		4. “Journeyman electrician ” means any person other than an
52	103		electrical contractor who engages in the actual installation,
53	104		alteration, repair or renovation of electrical f acilities or
54	105		electrical construction work unless specifically exempted by the
55	106		provisions of the Electrical License Act;
56		-
57	107		5. “Electrical contractor ” means any person skilled in the
58	108		planning, superintending and practical in stallation of electrical
59	109		facilities who is familiar with t he laws, rules and regulations
60	110		governing such work. Electrical contractor also means any
61	111		individual, firm, partnership, corporation, limited liability
62	112		company or business performing skills of an el ectrical contractor or
63	113		an electrician or the business of c ontracting, or furnishing labor
64	114		or labor and materials for the installation, repair, maintenance or
65	115		renovation of electrical facilities or electrical construction work
66	116		according to the provisions of the Electrical License Act;

68	117		6. “Electrical facilities ” means all wiring, fixtures,
69	118		appurtenances and appliances for, and in connection with, a supply
70	119		of electricity within or adjacent to any building, structure or

74	149		7. “Category” means the classification by which licenses and
75	150		electrical work may be limited. Such categories shall include but
76	151		shall not be limited to installation, maintenance, repair,
77	152		alteration, residential, oi lfield and commercial;

79	153		8. “Temporary journeyman electrician” means any person other
80	154		than a person permanently licensed as a journeyman electrician or
81	155		electrical contractor in this state who meets the temporary
82	156		licensure requirements of Section 1685.1 of t his title;

84	157		9. “Variance and Appeals Board” means the Oklahoma State
85	158		Electrical Installation Code Variance and Appeals Board;
86		-
87	159		10. “Electrical construction work ” means installation,
88	160		fabrication or assembly of equipment or systems included in
89	161		“premises wiring” as defined in the National Electrical Code
90		-

92	162		(reference 158:40-1-4. Standard of Installation), and which is
93	163		hereby adopted and incorporated by reference. Electrical
94	164		construction work includes but is not limited to ins tallation of
95	165		raceway systems used f or any electrical purpo ses, and installation
96	166		of field-assembled systems such as ice and snow melting, pipe -
97	167		tracing and manufactured wiring systems. Electrical construction
98	168		work shall not include in -plant work performed b y employees of the
99	169		company owning the plant, work performe d by telecommunications
100	170		employees for telecommunications companies or installation of

102	199		premises wiring unless wiring interconnection s external to the
103	200		equipment are required in the field;

105	201		11. “Electrical work” means work consisting primarily of the
106	202		layout, installation, maintenance, repair, testing or replacement of
107	203		all or part of electrical wires, conduits, apparatus, fixtures,
108	204		appliances or equipment for transmitting, carrying, controlling or
109	205		using electricity in, on, outside or attached to a building,
110	206		structure, property or premises. Electrical work shall not mean
111	207		work that is related to or facilitates the construction,
112	208		installation or maintenance of all or part of a n electrical system,
113	209		but which does not involve actual work with any of the electrical
114	210		components provided in this definition; and
115		-
116	211		12. “Student electrical intern apprentice” means any person
117	212		sixteen (16) years of age or older who complies with the
118	213		requirements for registration under Section 1686 of this title.

120	214		B. Class 2 and Class 3 circuits shall be exempt from the
121	215		requirements of electrical licensing of either an electrical
122	216		contractor or a journeyman electrician, provi ded the work is
123	217		performed in accordance with the National Fire Protection
124	218		Association 70 requirements for Class 2 and Class 3 circuits.

126	219		SECTION 2. AMENDATORY 59 O.S. 2021, Section 1686, is

129	248		Section 1686. A. The Construction Industries B oard shall, upon
130	249		proper application and payment of fee, register as an electrical
131	250		apprentice and issue a certificate of such registration to any
132	251		person who furnishes satisfactory proof to the Board that the
133	252		applicant is:

137	253		1. Sixteen (16) years of age or ol der; or

139	254		2. Enrolled in a school or federal training program for
140	255		electrical apprentices recognized by the Board or employed as an
141	256		electrical apprentice with an active licensed electrical contractor.

143	257		B. The Construction I ndustries Board shall, upon proper
144	258		application and payment of fee, register as a student electrical
145	259		intern apprentice and issue a certificate of such registration to
146	260		any person who furnishes satisfactory proof to the Board that the
147	261		applicant is:

149	262		1. Sixteen (16) years of age or older; and
150		-
151	263		2. Enrolled in high sch ool and enrolled in a work-ready or
152	264		similar program recognized by the Board ; and
153		-
154	265		3. Employed with an active licensed electrical contractor.

156	266		A student apprentice may not apply more than five hundred (500)
157	267		hours per school year toward his or her journeyman requirements.

159	268		C. All applications for examination, license or renewal of
160	269		license shall be made in writing to the Board on forms provided, if
161	270		necessary, by the Board. All applications shall be acco mpanied by
162	271		the appropriate fee.

164	299		D. Apprentices and studen t electrical interns apprentices, when
165	300		required by the Board, shall provide such documents, statements or
166	301		other information as may be necessary to submit to a national
167	302		criminal history record check as defined by Section 150.9 of Titl e
168	303		74 of the Oklahoma St atutes.

170	304		SECTION 3. AMENDATORY 59 O.S. 2021, Section 1688, is
171	305		amended to read as follows:

173	306		Section 1688. A. No license shall be issued for longer than
174	307		one (1) year, and all licenses shall expire on the last day in the
175	308		birth month of the licensee. A license may be renewed upon
176	309		application and payment of fees thirty (30) days preceding or
177	310		following the date the license is due. Licenses renewed more than

180	311		thirty (30) days foll owing the date of expiration may be renewed
181	312		only upon application and payment of all required fees and payment
182	313		of any penalty for late renewal established by the Construction
183	314		Industries Board and upon compliance with any applicable continuing
184	315		education requirements established by the Board and the Electrical
185	316		License Act. No penalty for late renewal shall be charged to any
186	317		holder of a license which expires while the holder is in military
187	318		service, if an application for renewal is made within one (1) year
188	319		following the service discharge of the holder.

190	320		B. No journeyman or contractor license shall be renewed unless
191	321		the licensee has completed the required hours of continuing

193	350		Examiners and approved by the Construction Industries Board.

195	351		C. An apprentice registration certificate or a student intern
196	352		registration certificate shall be issued for one (1) year, at which
197	353		time the apprentice may reregister upon meeting the requirements of
198	354		the Construction Industries Board and paying the renewal fee.

200	355		D. A student apprentice registration certificate shall be
201	356		issued for the registrant's school year. A student apprentice
202	357		registration expires on the last day of the registrant's school
203	358		year, at which time th e apprentice may reregister upon meeting the
204	359		requirements of the Construction Industries Board and paying th e
205	360		renewal fee.

207	361		SECTION 4. AMENDATORY 59 O.S. 2021, Section 1689, is
208	362		amended to read as follows:

210	363		Section 1689. A. The Construction Industries Board or its
211	364		designee and the Committee of Electrical Examiners shall act as the
212	365		Electrical Hearing Board and shall comply with the provisions of
213	366		Article II of the Administrative Procedures Act, Section 308a et
214	367		seq. of Title 75 of the Oklahoma Statutes.

216	368		B. Any administrative hearing on suspensions, revocations or
217	369		fines shall be conducted by a hearing examiner appointed by the
218	370		Board. The hearing examiner ’s decision shall be a final decision
219	371		which may be appealed to a district court in accordance with the
220	372		Administrative Procedures Act.

224	400		C. The Electrical Hearing Board may, upon its own motion, and
225	401		shall, upon written complaint filed by any person, investigate the
226	402		business transactions of any electrical contractor , journeyman
227	403		electrician, electrical apprentice, student electrical intern
228	404		apprentice or poultry house contractor license. Upon a finding by
229	405		clear and convincing evidence, the Board shall suspend or revoke any
230	406		license or registration obtained by false or fraudulent
231	407		representation. Upon a finding by clear and conv incing evidence,
232	408		the Board shall also suspend or revoke any license or registration
233	409		for any of the following:
234		-
235	410		1. Making a material misstatement in the application for a
236	411		license or registration, o r the renewal of a licens e or
237	412		registration;
238		-
239	413		2. Loaning or illegally using a license;
240		-
241	414		3. Demonstrating incompetence to act as a journeyman
242	415		electrician or electrical contractor;
243		-
244	416		4. Violating any provisions of the Electrical License Act, or
245	417		any rule or order prescribed by the Boar d or any ordinance for the
246	418		installation of electrical facilities made or enacted by a city or
247	419		town by authority of the Electrical License Act;
248		-
249	420		5. Willfully failing to perform normal business obligations
250	421		without justifiable cause; or

252	449		6. Failing to maintai n a registration or license as requ ired by
253	450		law in another state while registered in this state as a nonresident
254	451		contractor.

256	452		D. Any person whose license or registration has been revoked by
257	453		the Electrical Hearing Board may apply for a new license one (1)
258	454		year from the date of such revocation .

260	455		E. Notwithstanding any other provision of law, a political
261	456		subdivision of this state that has adopted a nationally recognized
262	457		electrical code and appointed an inspector pursuant to the
263	458		provisions of Section 1693 of thi s title or pursuant to the
264	459		provisions of the Oklahoma Inspectors Act for such work shall have
265	460		jurisdiction over the interpretation of the code and the

268	461		installation of all electrical work done in that political
269	462		subdivision, subject to the provisions of the Oklahoma Inspectors
270	463		Act. Provided, a state inspector may work directly with an
271	464		electrical contractor, journeyman electrician, electrical apprentice
272	465		or student electrical intern apprentice in such a locality if a
273	466		violation of the code creates an immediate threat to life or health.

275	467		F. In the case of a complaint about, investigation of or
276	468		inspection of any license, registration, permit or electrical work
277	469		in any political subdivision of this state which has not adopted a
278	470		nationally recognized electrical code and appointed an inspector
279	471		pursuant to the provisions of Section 1693 of this title or pursuant
280	472		to the provisions of the Oklahoma Inspectors Act for such work, the

284	502		G. 1. No individual, business, company, corporation,
285	503		association or other entity subject to the provisions of the
286	504		Electrical License Act shall install, modify or alter electrical
287	505		facilities in any incorporated area of this state which has not
288	506		adopted a nationally recognize d electrical code and appointed an
289	507		inspector pursuant to the provisions of Section 1693 of this title
290	508		or pursuant to the provisions of the Oklahoma Inspectors Act for
291	509		such work without providing notice of such electrical work to th e
292	510		Construction Industries Board. A notice form for reproduc tion by an
293	511		individual or entity required to make such notice shall be provided
294	512		by the Construction Industries Board upon request.

296	513		2. Notice to the Construction Industries Board pursuant to this
297	514		subsection shall not be re quired for electrical maintenance o r
298	515		replacement of existing electrical appliances or fixtures or of any
299	516		petroleum refinery or its research facilities.

301	517		3. Enforcement of this subsection is authorized pursuant to the
302	518		Electrical License Act, or under author ity granted to the
303	519		Construction Industries Board.

305	520		SECTION 5. AMENDATORY 59 O.S. 2021, Section 1699, is
306	521		amended to read as follows:

308	522		Section 1699. One student electrical intern apprentice is
309	523		allowed to work per physical job site wi th direct supervision under

314	553		against the maximum number of apprentices who are allowed by law or
315	554		regulation to work under the supervision of a single journeyman or

317	556		to work on high voltage systems defined by the National Electrical
318	557		Code.
