63128 SECTION 1. AMENDATORY 63 O.S. 2 021, Section 422, as last
64-amended by Section 6 of Enrolled Senate Bill No. 1995 of the 2nd
65-Session of the 59th Oklahoma Legislature , is amended to read as

68131 Section 422. A. The Oklahom a Medical Marijuana Authority shall
69132 make available on its website in an easy -to-find location an
70133 application for a medical marijua na commercial grower license. The
71134 application fee shall be paid by the applicant in the amounts
72135 provided for in Section 427.1 4 of this title. A method of payment
73136 for the application fee shall be provided on the w ebsite of the
74137 Authority. The Authority sh all have ninety (90) business days to

80168 B. The Authority shall approve all applications which meet the
81169 following criteria:

83170 1. The applicant must be twenty-five (25) years of age or

86172 2. The applicant, if applying as an individual, must show
87173 residency in this state;

89174 3. All applying entities must show that all members, managers,
90175 and board members are Oklahoma residents;

94176 4. An applying entity may show ownership of non -Oklahoma
95177 residents, but that percentage ownership may not exceed twenty -five

98179 5. All applying individuals or entities must be registered to

102182 commercial grower operation.

104183 Applicants with a nonv iolent felony conviction in the last two
105184 (2) years, any other felony conviction in the last five (5) years,
106185 inmates in the custody of the Department of Corrections or a ny
107186 person currently incarcerated shall not qualify for a commercial
108187 grower license.

110214 C. A licensed medical marijuana commercial gr ower may sell
111215 marijuana to a licensed medical marijuana dispensary or a licensed
112216 medical marijuana processor. Further, sales by a licensed medical
113217 marijuana commercial grower shall be considered wholesale sales an d
114218 shall not be subject to taxation. Under no circumstances may a
115219 licensed medical marijuana commercial grower sell marijuana directly
116220 to a licensed medical marijuana p atient or licensed medical
117221 marijuana caregiver. A licensed medical marijuana commercial grower
118222 may only sell at the wholesale lev el to a licensed medical marijuana
119223 dispensary, a licensed medical marijuana commercial grower or a
120224 licensed medical marijuana processor. If the federal government
121225 lifts restrictions on buying and selling marijuana between states,
122226 then a licensed medical m arijuana commercial grower would be allowed
123227 to sell and buy marijuana wholesale from, or to, an out -of-state
124228 wholesale provider. A licensed medical marijuana commercial grower
125229 shall be required to complete a month ly yield and sales report to
126230 the Authority. This report shall be due on the fifteenth of each
127231 month and provide reporting on the previous month. This report
128232 shall detail the amount of marijuana harvested in pounds, the amount
129233 of drying or dried marijuana on hand, the amount of marijuana sold
130234 to licensed processors in pounds, the amount of waste in pounds, and
131235 the amount of marijuana sold to licensed medical marijuana
132236 dispensaries in pounds. Additionally, this report shall show total
133237 wholesale sales in do llars. The Authority shall have oversight and

136264 auditing responsibilities to ensure that all marijuana being grown
137265 by licensed medical marijuana commercial growers is ac counted for.

139266 D. There shall be no limits on how much marijuana a licensed
140267 medical marijuana commercial grower can grow.

142268 E. Beginning on November 1, 2021, licensed medical marijuana
143269 commercial growers shall be authorized to package and sell pre -
144270 rolled marijuana to licensed medical marijuana dispensaries. The
145271 products described in this subse ction shall contain only the ground
146272 parts of the marijuana plant and shall not include marijuana
147273 concentrates or derivatives. The total net weight of each pre -roll
148274 packaged and sold by licensed medical marijuana commercial growers
149275 shall not exceed one (1) gram. These final products must be teste d,
150276 packaged and labeled in accordance with Oklahoma law and rules
151277 promulgated by the Authority.

153-F. Beginning November 1, 2022, all medical marijuana commercial
154-grower licensees who operate an outdoor medical marijuana production
155-facility shall be re quired to register with the Oklahoma Department
156-of Agriculture, Food, and Forestry as an environmentally sensitive
157-crop owner. Registration shall provide notice to commercial and
158-private pesticide applicators of the locations of medical marijuana
159-crops and help minimize the potential for damaging pesticide drift.
160-Medical marijuana commercial grower licensees shall provide their
161-business name, address, Global Positioning System (GPS) coordinates
162-for all outdoor medical marijuana production facilities, and any
163-other information required by the Department when registering with
164-the Environmentally Sensitive Area Registry.

166278 SECTION 2. AMENDATORY 63 O.S. 2021, Section 426.1, as
167-last amended by Section 14 of Enrolled Senate Bill No. 1995 of the
168-2nd Session of the 59th Oklahoma Legislature , is amended to read as

171281 Section 426.1. A. All licensure revocation hearings conducted

173283 shall be recorded. A party may request a copy of the recording of
174284 the proceedings. Copi es shall be provided to local law enforcement
175285 if the revocation was based on alleged criminal activity.

183316 concerning licensed patients, as defined in Section 427.2 of this
184317 title, the Authority shall share information with law enforcement
185318 agencies upon request without a subpoena or search warrant.

187319 C. The Authority shall make available all information on
188-whether a medical marijuana patient or caregiver license is valid to
189-law enforcement electron ically through an online verification
190-system.

192323 D. The Authority shall make available to state agencies and

197328 municipal governments in identifying locations within their

208364 licensee is to be located certifying compliance with zoning
209365 classifications, applicable municipal ordinances and all ap plicable
210366 safety, electrical, fire, plumbing, waste, construction and building
211367 specification codes. If the political subdivisi on does not have an
212368 authority having a jurisdiction agreement on file with the Office of
213369 the State Fire Marshal, the State Fire Marshal shall certify
214370 compliance with all applicable safety, electrical, fire, plumbing,
215371 waste, construction, and building specifica tion codes.

217-2. Beginning on May 28, 2021, upon the initial request for
218-renewal or transfer of a retail marijuana dispensary license, a
219-municipal government may object to the continued licensure of the
220-medical marijuana dispensary if the municipal government determines
221-
222-ENR. S. B. NO. 1635 Page 6
223-it is operating contrary to the required setback distance f rom a
224-school including the error in measurement allowance authorized by
225-Section 425 of this title.
226-
227-3. To prevent the granting of the grandfather provisions of
228-Section 425 of this title as a matter of law, the municipal
229-government shall provide the follow ing documentation prior to the
230-initial renewal or transfer of a license:
231-
232-a. a municipal resolution finding that the marijuana
233-dispensary is located within the prohibited setback
234-distance from a school that was openly in existence in
235-such a way that the pu blic generally would have known
236-of the school’s existence and operation in that
237-location prior to the original marijuana dispensary
238-being licensed. For purposes of this subparagraph,
239-“openly in existence” means any building, location or
240-structure on a school site that has visible outward
241-markings indicating the building, location or
242-structure was operating as a school which would serve
243-as sufficient notice of the existence of the school or
244-a reason for further inquiry on the part of the
245-marijuana dispensary license applicant. Openly in
246-existence shall not mean any school that operated
247-secretly or discreetly without any signs or other
248-markings on any building, location or structure on the
249-school site, undeveloped land or a structure owned by
250-a school that was not openly used and marked as a
251-school site, or any school site that was established
252-after the marijuana dispensary had been established
253-and licensed by the Authority, and
254-
255-b. documentation of the measured distance from the school
256-to the marijuana dispe nsary utilizing the method for
257-determining the setback distance less any allowable
258-error in measurement calculated and remeasured on and
259-after the effective date of this act as authorized by
260-Section 425 of this title.

262-4. Prior to initial renewal or trans fer of a license and upon
263-receipt of documentation required by paragraph 3 of this subsection,
264-if the Authority determines that the medical marijuana dispensary is
265-

267-operating contrary to the required setback distance from a school
268-including the error in mea surement allowance authorized by Section
269-425 of this title, the Authority may deny the renewal or transfer of
270-the medical marijuana dispensary license and shall cause the license
271-to be revoked.

273-5. For purposes of this subsection, “school” means the same as
274-defined in Section 427.2 of this title.
275-
276372 Once a certificate of compliance occupancy has been submitted to
277373 the Oklahoma Medical Marijuana Authority showing full compliance as
278374 outlined in this subsection, no additional certificate of compliance
279375 shall be required the licensee shall only need to submit an
280376 affidavit for license renewal unless stating the premises continues
281377 to comply with zoning classifications, applic able municipal
282378 ordinances, and all applicable safety, electrical, fire, plumbing,
283379 waste, construction, and building specifica tion codes. An
284380 additional certificate of occupancy along with an affidavit shall be
285381 submitted if a change of use or occupancy occu rs, or there is any
286382 change concerning the facility or location that would, by law,
287383 require additional inspection, licensure o r permitting by the state
288384 or municipality. Municipalities or the State Fire Marshal may
289385 implement an inspection program to verify compliance with this
290386 subsection. The Authority shall promulgate the rules necessary for
291387 the affidavit provided in this subse ction. If an application for

292414 renewal is submitted in violation of the provisions of this
293415 subsection or information provided on the affidavit is inaccurate or
294416 untrue, the Authority shall suspend operations of the licensee’s
295417 premises until compliance is ree stablished. All existing medical
296-marijuana business licensees and registrants that do not possess a
297-valid certificate of occupancy, where required, shall be subject to
298-revocation until such time as a valid certificate of oc cupancy is
299-obtained for all applicable structures. This provision shall not
300-apply to medical marijuana business licensees and registrants who
301-submitted a full and complete application for a valid certificate of
302-occupancy to the State Fire Marshal or polit ical subdivision with an
303-authority having a jurisdiction agreement on file with the State
304-Fire Marshal before February 1, 2024, and while the same application
305-remains under review by the State Fire Marshal or political
306-subdivision. Medical marijuana busin ess licensees and registrants
307-are responsible for compliance with applicable state fire, building,
308-and electrical codes and may be liable for all damage that results
309-

311-from noncompliance with state fire, building, and electrical codes
312-to the extent authorize d by law.

418+marijuana business licensees that do not possess a valid certificate
419+of occupancy, where required, shall be subject to revocation until
420+such time as a valid certificate of occupancy is obtained for all
421+applicable structure s. This provision shall not apply to medical
422+marijuana business licensees who submitted a full and complete
423+application for a valid certificate of occupancy to the State Fire
424+Marshal or political subdivision with an authority having a
425+jurisdiction agreeme nt on file with the State Fire Marshal before
426+November 1, 2024, and while the same application remains under

8681359 standards and testing. Beginning June 1, 2024, medica l marijuana
8691360 testing laboratories renewing their medical marijuana business
8701361 license shall be subject to and comply with any new or modified
8711362 rules relating to the testing of me dical marijuana, medical
8721363 marijuana concentrate, and medical marijuana products. T he refusal
8731364 or failure of a medical marijuana testing laboratory licensee to
8741365 comply with new or modified rules relating to laboratory standards
8751366 and testing procedures promulga ted under the provisions of this

11161759 prior to initial licensure and up to two (2) times per year
11171760 thereafter by an inspector approved by the Authority. The Authority
11181761 may enter the licensed premises of a testing laborat ory to conduct
11191762 investigations and additional inspections when the Authority
11201763 believes an investigation or additional inspection is necessary due
11211764 to a possible violation of app licable laws, rules or regulations.

11231765 U. Medical marijuana testing laboratories sha ll obtain
11241766 accreditation by an accrediting body approved by the Executive
11251767 Director or the Authority's quality assurance laboratory within one
11261768 (1) year of the date the initial license is issued. Renewal of any
11271769 medical marijuana testing laboratory license sh all be contingent
11281770 upon accreditation in accordance with this subsection. All medical

11461811 marijuana that has failed testing to a licensed processor only for
11471812 the purposes of decontamination or remediation and only in
11481813 accordance with the provisions of the Oklahoma Medical Marijuana and
11491814 Patient Protection Act and the rules and regulations pro mulgated by
11501815 the Executive Director. Remediated and decontaminated medical
11511816 marijuana may be returned only to the originating licensed
11521817 commercial grower.

11541818 W. Kief shall not be transferred or sold except as authorized

1921+BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
1922+SECTION 6. AMENDATORY 63 O.S. 2021, Section 426.1, as
1923+amended by Section 6, Chapter 251, O.S.L. 2022 (63 O.S. Supp. 2023,
1924+Section 426.1), is amended to read as follows:
1925+Section 426.1. A. All licensure revocation hearing s conducted
1926+pursuant to marijuana licenses esta blished in the Oklahoma Statutes
1927+shall be recorded. A party may request a copy of the recording of
1928+the proceedings. Copies shall be provided to local law enf orcement
1929+if the revocation was based on alleged cr iminal activity.
1930+B. The Oklahoma Medical Marij uana Authority shall assist any
1931+law enforcement officer in the performance of his or her duties upon
1932+such request by the law enforcement officer or the request of other
1933+local officials having jurisdiction. Ex cept for license information
1934+concerning licensed patients, as defined in Section 427.2 of this

1961+title, the Authority shall share information with law enforcement
1962+agencies upon request without a subpoena or s earch warrant.
1963+C. The Authority shall make availa ble all information on
1964+whether or not a medical marijuana patient or caregiver license is
1965+valid to law enforcement electronically through an online
1966+verification system.
1967+D. The Authority shall make available to state agencies and
1968+political subdivisions a l ist of marijuana-licensed premises,
1969+medical marijuana businesses or any other premises where marijuana
1970+or its by-products are licensed to be cultivated, grown, processed,
1971+stored or manufactured to aid state agencies and county and
1972+municipal governments in identifying locations within their
1973+jurisdiction and ensuring compliance with applicable laws, rules and
1974+regulations.
1975+E. Any marijuana-licensed premises, medical marijuana business
1976+or any other premises where marijuana or its by -products are
1977+licensed to be cultivated, grown, processed, stored or manufa ctured
1978+shall submit with its application or request to change location,
1979+after notifying the political subdivision of its intent, a
1980+certificate of compliance fr om the political subdivision where the
1981+facility of the applicant or licensee is to be located cer tifying
1982+compliance with zoning classifications, applicable municipal
1983+ordinances and all applicable safety, electrical, fire, plumbing,
1984+waste, construction and building specification codes. If the

2011+political subdivision does not have an authority having a
2012+jurisdiction agreement on file with the State Fire Marshal’s office,
2013+the State Fire Marshal shall certify compliance with all applicable
2014+safety, electrical, fir e, plumbing, waste, construction, and
2015+building specification codes.
2016+Once a certificate of complia nce has been submitted to the
2017+Oklahoma Medical Marijuana Authority showing full compliance as
2018+outlined in this subsection, no additional certificate of compliance
2019+shall be required the licensee shall only need to submit an
2020+affidavit for license renewal unless stating the premises continues
2021+to comply with zoning classifications, applicable municipal
2022+ordinances, and all applicable safety, electrical, fire, plumbin g,
2023+waste, construction, and building specification codes. An
2024+additional certificate of complianc e along with an affidavit shall
2025+be submitted if a change of use or occupancy occurs, or there is any
2026+change concerning the facility or location that would, by law,
2027+require additional inspection, licensure or p ermitting by the state
2028+or municipality. Municipalities or the State Fire Marshal may
2029+implement an inspection program to verify compliance with this
2030+subsection. The Authority shall promulgate the rules nec essary for
2031+the affidavit provided in this subsecti on. If an application for
2032+renewal is submitted in violation of the provisions of this
2033+subsection or information provided on the affidavit is inaccurate or
2034+untrue, the Authority shall suspend operations of the licensee ’s

2061+premises until compliance is reesta blished. Any marijuana licensed
2062+premises, medical marijuana business, or any other premises where
2063+medical marijuana or its byproducts are licensed to be cultivated,
2064+grown, processed, stored, or manufacture d that have been issued a
2065+certificate of complianc e by any political subdivision prior to the
2066+effective date of this act shall not be denied licensure or
2067+registration by a state agency for failing to provide a certificate
2068+of occupancy issued by either the State Fire Marshal or a political
2069+subdivision who has an authority having jurisdiction on file wi th
2070+the State Fire Marshal until after July 1, 2026 .
2071+SECTION 7. It being immediately necessary for the preservation
2072+of the public peace, health or safety, an emergency is hereby
2073+declared to exist, by reason whereof this act shall take effec t and
