57+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58+SECTION 1. NEW LAW A new section of law to be codified
59+in the Oklahoma Statutes as Section 1-8-113 of Title 10A, unless
60+there is created a duplication in numbering, reads as follows:
61+A. The Department of Human Se rvices shall not:
62+1. Require, as a condition for eligibility to foster or adopt,
63+any current or prospective adoptive or fost er parent to affirm,
64+accept, or support any government policy regarding sexual
65+orientation or gender identity that conflicts with t he parent’s
66+sincerely held religious or moral beliefs;

114-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12595 authorization necessary to be eligible to foster or adopt based, in
12696 whole or in part, upon the parent ’s sincerely held religious or
12797 moral beliefs regarding sexual orientation or gender identity; or
98+3. Establish or enforce any standard, rule, or policy that
99+precludes consideration of a current or prospective adoptive or
100+foster parent for any particular placement based, in whole or in
101+part, upon the parent’s sincerely held religious or moral beliefs
102+regarding sexual orientation or gender identity. Such beliefs sh all
103+not create a presumption that any particular placement is contrary
104+to the best interest of the child.
105+B. Nothing in this secti on shall:
106+1. Preclude the Department from taking into account the
107+religious or moral beliefs of a particular adoptive or fos ter child,
108+or his or her family of origin, when determining the most
109+appropriate placement f or the child; or
110+2. Be construed to pr ohibit the Department from making, or
111+relieve the Department of its duty to make, individual placements
112+consistent with the b est interests of the child as otherwise
113+required by law.
114+C. A current or prospective adoptive or foster parent aggrieved
115+by a violation of this section may raise a claim in a judicial or
116+administrative proceeding and seek injunctive relief, compensatory
117+damages, reasonable attorney fees , or other appropriate relief .
