50100 A. There is hereby created the Sexual Assault Forensic Evidence
51101 (SAFE) Board within the Office of the A ttorney General. The Board
52102 shall have the power and duty to:

54103 1. Examine the process for gathering and a nalyzing sexual
55104 assault forensic evidence kits in this state and work with members
56105 of the Legislature to draft proposed legislation to improve the
57106 response of medical and law enforcement systems to sexual assault;
58-
59107 2. Develop a plan for the prioritization and acceptance of
60108 untested sexual assault forensic evidence kits identified in the
61109 statewide audit conducted by the Board;
62-
63110 3. Identify possible proced ures for the testing of anonymous
64111 sexual assault evidence kits;
65-
66112 4. Identify possible improvements for vi ctim access to evidence
67113 other than sexual assault forensic evidence kits including, but not
68114 limited to, police reports and other physical evidence;
69-
70115 5. Identify additional rights of victims concerning the sexual
71116 assault forensic evidence kits testing proce ss;
72-
73117 6. Identify and pursue grants and other funding sources to
74118 address untested sexual assault forensic evidence kits, reduce
75119 testing wait times, prov ide victim notification, and improve
76120 efficiencies in the kit testing process; and

78121 7. Develop a comprehen sive training plan for equipping and
79122 enhancing the work of law enforcement, prosecutors, victim

84153 B. In carrying out its duties and responsibilities, the Board

87155 1. Promulgate rules establishing criteria for the collection of
88156 sexual assault forensic evide nce subject to specific, in -depth
89157 review by the Board;

94159 sexual assault forensic eviden ce collection including, but not
95160 limited to, demographic and medical diagnostic information;

97161 3. Establish procedures for obtaining initial information
98162 regarding the collection of sexual assault forensic evidence f rom
99163 medical and law enforcement entities;

101164 4. Review the policies, practices, and procedures of the
102165 medical and law enforcement systems and make specif ic
103166 recommendations to the entities comprising the medical and law
104167 enforcement systems for actions necessa ry to improve such systems;

106168 5. Review the extent to which the medical and law enforcement
107169 systems are coordinated and evaluate whether the state is
108170 efficiently discharging its sexual assault forensic evidence
109171 collection responsibilities;

111172 6. Request and obtain a copy of all records and reports
112173 pertaining to sexual assault forensic evidence including, but not

125207 Confidential information provided to the Board shall be
126208 maintained by the Board in a confidential manner as otherwise
127209 required by state and federal law. Any person damaged by disclosure
128210 of such confidential information by the B oard or its members which
129211 is not authorized by law may maintain an action for damages, costs,
130212 and attorney fees pursuant to The Governmental Tort Claim s Act;

132213 7. Maintain all confidential information, documents, and
133214 records in possession of the Board as co nfidential and not subject
134215 to subpoena or discovery in any civil or criminal proceedings;

138217 otherwise available from other sources shall not be exempt from
139218 subpoena or discovery through such sources solely because such
140219 information, documents, and records were presented to or reviewed by

143221 8. Exercise all incidental powers necessary a nd proper for the
144222 implementation and administration of the Sexual Assault Forensic
145223 Evidence (SAFE) Board.

147224 C. The review and discussion of individu al cases of sexual
148225 assault evidence collection shall be conducted in executive session.

149253 All discussions of i ndividual cases and any writings produced by or
150254 created for the Board in the course of determining a reme dial
151255 measure to be recommended by the Board, as the result of a review of
152256 an individual case of sexual assault evidence collection, shall be
153257 privileged and shall not be admissible in evidence in any
154258 proceeding. All other business shall be conducted in acc ordance
155259 with the provisions of the Oklahom a Open Meeting Act. The Board
156260 shall periodically conduct meetings to discuss organization and
157261 business matters and any actions or recommendations aimed at
158262 improvement of the collection of sexual assault forensic e vidence
159263 which shall be subject to the Oklahoma Open Meeting Act.

161264 D. The Board shall submit an annual statistical report on the
162265 incidence of sexual ass ault forensic evidence collection in this
163266 state for which the Board has completed its review during the p ast
164267 calendar year including its recommenda tions, if any, to medical and
165268 law enforcement systems. The Board shall also prepare and make
166269 available to the public an annual report containing a summary of the
167270 activities of the Board relating to the review of s exual assault
168271 forensic evidence collection and an evaluation of whether the state
169272 is efficiently discharging its sexual assault forensic evidence
170273 collection responsibilities. The report shall be completed no later
171274 than February 1 of the subsequent year.

243403 f. a person who is a survivor of sexual assault and who
244404 has experience with sexual assault forensic evide nce
245405 kit collection or is a survivor of sexual assault
246406 committed in this state who has participated in the
247407 justice system process .

249408 B. Every two (2) yea rs the Board shall elect from among its
250409 membership a chair and a vice chair. The Board shall meet at lea st
251410 quarterly and may meet more frequently as necessary as determined by
252411 the chair. Seven (7) voting members or their designees, as
253412 specified in paragraphs 2 and 3 of subsection A of this section,
254413 shall constitute a quorum.

256414 C. Members shall serve without compensation but may be
257415 reimbursed for necessary travel out of funds available to the Office
258416 of the Attorney General pursuant to the State Travel Reimb ursement
259417 Act; provided, that the reimbursement shall be paid in the case of
260418 state employee members by the agency employing the member.

262419 D. The Office of the Attorney General shall provide
263420 administrative assistance and services to the Sexual Assault
264421 Forensic Evidence Board with funds appropriated or otherwise
265422 available for that purpose.

467711 16. The Sexual Assault Forensic Evidence (SAFE) Board as

470713 D. Except as otherwise specified in this subsection, an
471714 executive session for the purpose of discussing the purchase or
472715 appraisal of real property shall be limited to members of the public
473716 body, the attorney for the public body and the immediate staff of
474717 the public body. No landowner, real estate s alesperson, broker,
475718 developer or any other person who may profit directly or indirectly
476719 by a proposed transac tion concerning real property which is under
477720 consideration may be present or participate in the executive
478721 session, unless they are operating under an existing agreement to
479722 represent the public body.

481723 E. No public body may go into an executive session unles s the
482724 following procedures are strictly complied with:

505766 session including tape recordings , to be immediately made public.
