16	49		the Oklahoma Tax Commission and Office of Management
17	50		and Enterprise Services Joint Computer Enhancement
18	51		Fund; providing for expenditure from fund; updating
19	52		statutory language; providing an effective date; and

26	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	60		SECTION 1. AMENDATORY 68 O.S. 2021, Section 265, is
29	61		amended to read as follows:

31	62		Section 265. A. There is hereby created in the State Treasury
32	63		a fund for the Oklahoma Tax Commission to be known as the “Oklahoma
33	64		Tax Commission and Office of Management and E nterprise Services
34	65		Joint Computer Enhancement Fund ”. The fund shall be a continuing
35	66		fund, not subject to fiscal year limitations, and shall consist of
36	67		all monies deposited to the fund pursuant to law. All monies

37	95		accruing to the credit of said such fund are hereby appropriated and
38	96		may be budgeted and expended for the purposes authorized by
39	97		subsection B of this section. Expenditures from said such fund
40	98		shall be made upon warrants issued by the State Treasurer against
41	99		claims filed as prescribed by law with the Director of the Office of
42	100		Management and Enterprise Servi ces for approval and payment.

44	101		B. Monies in the Oklahoma Tax Commission and Office of
45	102		Management and Enterpr ise Services Joint Computer Enhancement Fund
46	103		shall be expended for the following purpos es:

50	104		1. To make payments on an agreement authorized by Section 5,
51	105		Chapter 278, O.S.L. 2008;

53	106		2. To make payments for the information technology acquisitions
54	107		to support the responsibilities of the Okl ahoma Tax Commission;

56	108		3. To make payments authorized by Section 34.33 of Title 62 of
57	109		the Oklahoma Statutes; and

59	110		3. 4. To the extent not needed for the above -listed purposes to
60	111		be expended on other project s as specifically au thorized by the
61	112		Legislature.

63	113		C. Notwithstanding any other provision of law, there shal l be
64	114		apportioned to the Oklahoma Tax Commission and Office of Management
65	115		and Enterprise Services Joint Computer Enhancement Fund from the
66	116		monies that would otherwise be apportioned by Section 2352 of this
67	117		title, the revenue received as a result of any cont racts entered

68	145		into by the Oklahoma Tax Commission pursuant to Section 264 of this
69	146		title.

71	147		D. The Tax Commission is hereby authorized to deposit to th e
72	148		credit of the Oklahoma Tax Commission and Office of Management and
73	149		Enterprise Services Joint Computer Enh ancement Fund any monies in
74	150		excess of the amounts necessary to pay all claims presented to its
75	151		cash security reserve fund. When monie s are deposited to the credit
76	152		of the Computer Enhancement Fund, the right of any person to present
77	153		a claim for refund of a cash security shall be preserved and the
78	154		value thereof shall be paid from the cash security reserve fund.

80	155		E. For the fiscal year beginning July 1, 2015, and thereafter a
81	156		portion of the revenue apportioned to the Oklahoma Tax Commission
82	157		and Office of Management and Enterprise Services Joint Computer
83	158		Enhancement Fund pursuant to Sections 1353, 1403 and 2352 of this
84	159		title shall be credited to the Oklaho ma Tax Commission, in an amount
85	160		which is equal to the sum of one -half of one percent (0.5%) of gross
86	161		collections of sales and use tax levied by counties of this state
87	162		pursuant to Section 1370 of this title and one -half of one percent
88	163		(0.5%) of sales and us e tax levied by muni cipalities of this state
89	164		pursuant to Section 2701 of this title.

93	165		SECTION 2. This act shall become effective July 1, 2024.

95	166		SECTION 3. It being immediately necessary for the preservation
96	167		of the public peace, health or safety, an emergency is hereby
