55+Section 152. As used in The Governmental T ort Claims Act:
56+1. “Action” means a proceeding in a court of competent

95-3. Personal communications concerning individual students ; and
96-4. Contracts for use of a student athlete's name, image, or
97-likeness disclosed to a postsecond ary institution.
98-B. If kept, statistical information not identified with a
99-particular student and directory information shall be open for
100-inspection and copying . Except as provided in subsection C of this
101-section, each educational institution may choose to designate
102-specific information which s hall be classified as directory
103-information for students attending the educational institution . In
104-accordance with the Family Educa tional Rights and Privacy Act,
105-Section 1232g of Title 20 of the United States Code and Part 99 of
106-Title 34 of the Code of Fe deral Regulations, "directory information"
107-includes a student's name, address, telephone listing, date and
108-place of birth, major fie ld of study, participation in officially
109-recognized activities and sports, weight a nd height of members of
110-athletic teams, dates of attendance, degrees and awards received,
111-and the most recent previous educational institution attended by the
112-student. Any educational agency or institution making public
113-directory information shall give pu blic notice of the categories of
114-information which it has designated as director y information with
115-respect to each student attending the institution or agency and
116-shall allow a reasonable period of time after the notice has been
117-given for a parent to infor m the institution or agency that any or

91+or the practice of a profession and who provides care to a medically
92+indigent person, as define d in paragraph 9 of this section, with no
93+expectation of or acceptance of compensation of any kind;
94+4. “Claim” means any written demand presented by a claimant or
95+the claimant’s authorized representative in accordance with the
96+Governmental Tort Claims Ac t to recover money from the state or
97+political subdivisio n as compensation for an act or omissi on of a
98+political subdivision or the state or an employee;

145-prior consent of the parent or guardian or the student if the
146-student is eighteen (18) years of age or older.
147-C. All educational agencies or instituti ons which are not the
148-primary custodians of student directory information of st udents
149-attending the educational institution, but which are allowed to
150-access the information for educational purposes, shall be prohibited
151-from releasing or selling any or all student directory information
152-unless disclosure is authorized by the Family Edu cational Rights and
153-Privacy Act, Section 1232g of Title 20 of the United States Code and
154-Part 99 of Title 34 of the Code of Federal Regulations, or Section
155-3-168 of Title 70 of the Oklahoma Statutes.
156-D. A public school district may release individual stu dent
157-records for the current or previous school year to a school district
158-at which the student was previously enrolled for purposes of
159-evaluating educational programs and school effectiveness."

447246 (3) any volunteer, full-time or part-time firefighter
448247 when performing duties for a fire department
449248 provided for in subparagraph j of paragraph 11 of

451250 b. For the purpose of The Governmenta l Tort Claims Act,
452251 the following are employees of this state, regardless
453252 of the place in this state where du ties as employees
454253 are performed:
455254 (1) physicians acting in an administrative capacity,
456255 (2) resident physicians and resident interns
457256 participating in a graduate medical education
458257 program of the University of Oklahoma Health
459258 Sciences Center, the College of Os teopathic
460259 Medicine of Oklahoma State University, or the
461260 Department of Mental Health and Substance Abuse
462261 Services,
463262 (3) faculty members and staff o f the University of
464263 Oklahoma Health Sciences Center and the College
465264 of Osteopathic Medicine of Oklahoma State
466265 University, while engaged in teaching duties,

495295 agency of the State of Oklahoma,
496296 (5) physicians who provide medical care to inmates
497297 pursuant to a contract with the Department of
498298 Corrections,
499299 (6) any person who is licensed to practice medicine
500300 pursuant to Title 59 of the Oklahoma Statutes,
501301 who is under an administrative professional
502302 services contract with the Oklahoma Health Care
503303 Authority under the auspices of the Ok lahoma
504304 Health Care Authority Chief Medical Officer, and
505305 who is limited to performing administrative
506306 duties such as professional guidance for m edical
507307 reviews, reimbursement rates, service
508308 utilization, health care delivery and benefit
509309 design for the Oklahoma Health Care Authority,
510310 only while acting within the scope of such
511311 contract,
512312 (7) licensed medical professionals under contract
513313 with city, county, or state entiti es who provide
514314 medical care to inmates or detainees in the
515315 custody or control of law enforcemen t agencies,

543344 in Sections 1-103 and 5-502 of Title 43A of the
544345 Oklahoma Statutes, who are c onducting initial
545346 examinations of individuals for the purpose of
546347 determining whether an individual meets the
547348 criteria for emergency detention as part of a
548349 contract with the Department of Mental Health and
549350 Substance Abuse Services, and
550351 (9) licensed mental health professionals a s defined
551352 in Sections 1-103 and 5-502 of Title 43A of the
552353 Oklahoma Statutes, who are providing mental
553354 health or substance abuse treatment services
554355 under a professional services contract with the
555356 Department of Mental Health and Substan ce Abuse
556357 Services and are providing such treatment
557358 services at a state-operated facility.
558359 Physician faculty members a nd staff of the University
559360 of Oklahoma Health Sciences Center and the College of
560361 Osteopathic Medicine of Oklahoma State University not
561362 acting in an administrativ e capacity or engaged in
562363 teaching duties are not employees or agents of the
563364 state.
564365 c. Except as provided in subparagraph b of this

592394 for the tortious conduct of any physician, resi dent
593395 physician or intern while practicing medicine or
594396 providing medical treatment to patients.
595397 d. For purposes of The G overnmental Tort Claims Act,
596398 members of the state military forces on state active
597399 duty orders or on Title 32 active duty orders are
598400 employees of this state, rega rdless of the place,
599401 within or outside this state, where their duties as
600402 employees are performe d;
601403 8. “Loss” means death or injury to the body or rights of a
602404 person or damage to real or personal property or rights therein;
603405 9. “Medically indigent” means a person requiring medically
604406 necessary hospital or other health care services for the person or
605407 the dependents of the person who has no public or private third-
606408 party coverage, and whose personal resources are insufficient to
607409 provide for needed health care;
608410 10. “Municipality” means any incorporated city or town, and all
609411 institutions, agencies or instr umentalities of a municipality;
610412 11. “Political subdivision” means:
611413 a. a municipality,
612414 b. a school district, including, but not limited to, a
613415 technology center school district established pursuant
614416 to Section 4410, 4411, 4420 or 4420.1 of Title 70 of
615417 the Oklahoma Statutes, or a public library as defined

645448 d. a public trust where the sole beneficiary or
646449 beneficiaries are a city, town, school district or
647450 county. For purposes of The Gov ernmental Tort Claims
648451 Act, a public trust shall include:
649452 (1) a municipal hospital created pursu ant to Sections
650453 30-101 through 30-109 of Title 11 of the Oklahoma
651454 Statutes, a county hospital created pursuant to
652455 Sections 781 through 796 of Title 19 of the
653456 Oklahoma Statutes, or is created pursuant to a
654457 joint agreement between such governing
655458 authorities, that is operated for the public
656459 benefit by a public trust created pursuant to
657460 Sections 176 through 180.4 of Title 60 of the
658461 Oklahoma Statutes and managed by a g overning
659462 board appointed or elected by the municipality,
660463 county, or both, who exercises control of the
661464 hospital, subject to the approval of the
662465 governing body of the municipality, county, or
663466 both,
664467 (2) a public trust creat ed pursuant to Sections 176
665468 through 180.4 of Title 60 of the Oklahoma

708512 to the provisions of the Oklahoma General Corporation
709513 Act for the primary pur pose of developing and
710514 providing rural water supply and sewage disposal
711515 facilities to serve rural residents,
712516 g. for the purposes of The Governmental Tort Claims Act
713517 only, districts formed pursuant to the Rural Water,

889697 to the provisions of the Governmental Tort Claims Act,
890698 and all their institutions, instru mentalities or agencies ;
891699 12. “Scope of employment” means performance by an employee
892700 acting in good faith within the duties of t he employee’s office or
893701 employment or of tasks lawfully assigned by a competent autho rity
894702 including the operation or use of an a gency vehicle or equipm ent
895703 with actual or implied consent of the supervisor of the employee,
896704 but shall not include corruption or fraud;
897705 13. “State” means the State of Oklahoma or any office,
898706 department, agency, a uthority, commission, board, institution,
899707 hospital, college, unive rsity, public trust created pursua nt to
900708 Title 60 of the Oklahoma Statutes of which the State of Oklahoma is
901709 the beneficiary, or other instrumentality thereof;
902710 14. “State active duty” shall be defined in accordance with
903711 Section 801 of Title 44 of the Oklah oma Statutes;
904712 15. “State military forces” shall be defined in accordance with
905713 Section 801 of Title 44 of the Oklahoma Statutes;
906714 16. “Title 32 active duty” shall be defined in accordance w ith
907715 Section 801 of Title 44 of the Oklahoma Statutes; and
908716 17. “Tort” means a legal wrong, independen t of contract,
909717 involving violation of a duty imposed by general law, st atute, the
910718 Constitution of the State of Oklahoma, or otherwise, resulting in a
911719 loss to any person, association or corporation as the proximate
