145	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
146	54		SECTION 1. AMENDATORY 37A O.S. 2021, Section 2-101, is
147	55		amended to read as follows:
148	56		Section 2-101. A. Except as otherwise provided in this
149	57		section, the licenses issued by the ABLE Commission, and the annu al
150	58		fees therefor, shall be as follows:

339	251		B. 1. There shall be added to the initial or renewal fee s for
340	252		a Mixed Beverage License an administrative fee, which shall not be
341	253		deemed to be a license fee, in the amount of Five Hundred Dollars
342	254		($500.00), which shall be paid at the same time and in the same
343	255		manner as the license fees prescribed by paragraph 12 of subsection
344	256		A of this section; provided, this fee shall not be asse ssed against
345	257		service organizations or fraternal beneficiary societies which are
346	258		exempt under Section 501(c)(19), (8) or (10) of the Internal Revenue
347	259		Code.
348	260		2. There shall be added to the fee for a Mixed Beverage/Caterer
349	261		Combination License an administrativ e fee, which shall not be deemed
350	262		to be a license fee, in the amount of Two Hundred F ifty Dollars
351	263		($250.00), which shall be paid at the same time and in the same
352	264		manner as the license fee prescribed by paragraph 13 of subsection A
353	265		of this section.
354	266		C. Notwithstanding the provisions of subsection A of this
355	267		section:
356		-	1. The license fee for a mixed beverage or bottle club license
357		-	for those service organizations or f raternal beneficiary societ ies
358		-	which are exempt under Section 501(c)(19), (8) or (10) of the

	295	+	1. The license fee for a mixed beverage or bottle club license
	296	+	for those service organizations or fraternal beneficiary societ ies
	297	+	which are exempt under Section 501(c)(19), (8) or (10) of the
385	298		Internal Revenue Code shall be Five Hundred Dollars ($500.00) per
386	299		year; and
387	300		2. The renewal fee for an airline/railroad/commercial passenger
388	301		vessel beverage license held by a railroad descri bed in 49 U.S.C.,
389	302		Section 24301, shall be One Hundred Dollars ($100.00 ).
390	303		D. An applicant may apply for and receive both an on -premises
391	304		beer and wine license and a caterer license.
392	305		E. All licenses, except as otherwise provided, shall be valid
393	306		for one (1) year from date of issuance unless revoked or
394	307		surrendered. Provided, a ll employee licenses shall be valid for two
395	308		(2) years.
396	309		F. The holder of a license, issued by the ABLE Commission, for
397	310		a bottle club located in a county of this state where the sale of
398	311		alcoholic beverages by the individual drink for on -premises
399	312		consumption has been authorized, may exchange the bottle club
400	313		license for a mixed beverage lice nse or an on-premises beer and wine
401	314		license and operate the licensed premises as a mixed beverage
402	315		establishment or an on-premises beer and wine establishment subject
403	316		to the provisions of the Oklahoma Alcoholic Beverage Control Act.
404	317		There shall be no addit ional fee for such exchange and the mixed
405	318		beverage license or on-premises beer and wine license issued shall
406		-	expire one (1) year from the date of issuance of the original b ottle
407		-	club license.

488	403		The surcharge shall be paid concurrent with the licensee ’s
489	404		annual licensing fee an d, in addition to Five Dollars ($5.00) of the
490	405		employee license fee, sh all be deposited in the Alcoholic Beverage
491	406		Governance Revolving Fund established pur suant to Section 5-128 of
492	407		this title.
493	408		H. Any license issued by the ABLE Commission under this title
494	409		may be relied upon by other licensees as a valid license, and no
495	410		other licensee shall have any obligation to independently determine
496	411		the validity of such l icense or be held liable solely as a
497	412		consequence of another licensee ’s failure to maintain a valid
498	413		license.
499	414		SECTION 2. It being immediately necessary for t he preservation
500	415		of the public peace, health or safety, an emergency is hereby
501	416		declared to exist, by reason whereof this act shall take effect and
502	417		be in full force from and after its passage and approval.
