3259 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:

3460 SECTION 1. AMENDATORY 21 O.S. 2021, Section 142 .10, is
3561 amended to read as follows:

3762 Section 142.10. A. Compensation shall not be award ed:

3963 1. Unless the claim has been filed with the Crime Victims
4064 Compensation Board with in one (1) year thirty (30) months after the
4165 injury or death upon which the claim is based. If the victim is
4266 under a mental or cognitive disability or is a child under e ighteen
4367 (18) years of age, the Board may use the date the criminal incident

4495 was disclosed to a responsible adult when establishing whether or
4596 not the claim was timely f iled. In cases involving sexual assault
4697 of an adult eighteen (18) years of age or older , the Board may use

4998 the date the sexual assault forensic evidence kit was tested when
5099 establishing whether the claim was timely fil ed. The Board may, at
51100 its discretion, extend the filing period beyond one (1) year upon a
52101 showing of good cause or in all ca ses of sexual assault;

54102 2. To a claimant who was the offender, or an accomplice of the
55103 offender;
56-
57104 3. To another person if the award would unjustly benefit the
58105 offender or accomplice; or
59-
60106 4. Unless after the criminally injurious conduct resulting in
61107 injury or death:

63108 a. such conduct was reported to a law enforcement officer
64109 within seventy-two (72) hours after its oc currence, or
65-
66110 b. in the case of sexual assault, the victim undergoes a
67111 forensic medical examination within one hundred twenty
68112 (120) hours after its occurrence, or
69-
70113 c. the Board finds there was g ood cause for the failure
71114 to report the crime or obtain a forensic medi cal
72115 examination within that the time specified in
73116 subparagraph a or b of this paragraph .

75117 B. Compensation otherwise payable to a claimant s hall be

78146 1. That the economic loss is recouped from collateral sources;

81148 2. Of the degree of responsibility for the cause of the injury
82149 or death attributable to the victim as de termined by the Board.
83150 Provided, a self-inflicted injury shall not be attributable to the
84151 victim when the Board finds the injury is a direct result of the
85152 crime committed against the victim.

87153 C. The Board, upon findin g that the claimant or victim has not
88154 fully cooperated with appropriate law enforcement agencies, may
89155 deny, withdraw or reduce an awar d of compensation. Victims of
90156 sexual assault who undergo a forensic m edical examination within one

93157 hundred twenty (120) h ours after the sexual assault shall be found
94158 to have fully cooperated. The Board may ex tend this period of time
95159 for good cause.

97160 D. The Board, on its own motion or on request of the claimant,
98161 may reconsider a decision granting or denying an award or
99162 determining its amount. The motion or requ est to reconsider a
100163 decision shall be made within six (6) months from the date of the
101164 last action by the Board on the claim at issue. An order on
102165 reconsideration of an award shall not require a refund of amounts
103166 previously paid, unless the award was obtai ned by fraud. The right
104167 of reconsideration does n ot affect the finality of a Board decision
105168 for the purpose of judicial review. On claims which are denied by

106196 the Board, reconsideration may only be granted within six (6) months
107197 of the last Board action.

109198 E. The provisions of subsections A and B of this s ection shall
110199 not apply to claimants eligible f or compensation pursuant to the
111200 Murrah Crime Victims Compensation Act who make claims under the
112201 Oklahoma Crime Victims Com pensation Act.

114202 SECTION 2. AMENDATORY 21 O.S. 2021, Section 142 .13, is
115203 amended to read as follows:

117204 Section 142.13. A. The Crime Victim s Compensation Board may
118205 compensate for work loss, replacement services loss, dependent ’s
119206 economic loss and dependent ’s replacement service loss.
120207 Compensation for a caregiver who has out-of-pocket wage loss as a
121208 result of caring for the victim who was inj ured as a result of
122209 criminally injurious co nduct may not exceed Three Thousand Dollars
123210 ($3,000.00).

125211 B. Compensation payable to a vic tim and to all other claimants
126212 sustaining economic loss because of injury to or death of that
127213 victim may not exceed Twenty Thousand Dollars ($20,000.00) Twenty-
128214 five Thousand Dollars ($25,000.00) in the aggregate. The Board may,
129215 after approval of an initia l award of Twenty Thousand Dollars
130216 ($20,000.00) Twenty-five Thousand Dollars ($25,000.00), grant an
131217 additional sum not to exceed Twenty Thousand Dollars ($20,000.00)
132218 Twenty-five Thousand Dollars ($25,000.00), specifically for loss of
133219 wages for the victim o r loss of support for dependents of a deceased

134247 victim, provided, there is verifiable economic lo ss after deducting

137248 payments from other sou rces. In no event shall compensation payable
138249 to a victim and to all other claimants sustaining economic loss
139250 because of injury to or death of that victim exceed Forty Thousand
140251 Dollars ($40,000.00) Fifty Thousand Dollars ($50,000.00) in the
141252 aggregate.

143253 C. The Board may provide for the paymen t to a claimant in a
144254 lump sum or in installments. At the request of the claimant, the
145255 Board may convert future economic loss, other than allowable
146256 expense, to a lump sum.

148257 D. An award payable in a lump sum or installments for loss of
149258 support for a depende nt of the deceased victim may be computed
150259 through a formula which calculates the ne t loss of support for
151260 dependents based upon an es timated date of retirement or an
152261 estimated date of adulthood for dependent children, beginn ing with
153262 the date of death of the victim and ending with the least of one of
154263 the following time periods for each dep endent filing loss of
155264 support:

157265 1. The amount of time from the date of death of the victim to
158266 the date the victim would have been expected t o reach sixty-two (62)
159267 years of age;
160-
161268 2. The amount of time from the date of death of the victim to
162269 the date the spouse of the victim is expected to reach sixty -two
163270 (62) years of age; or

165298 3. The amount of time f rom the date of death of the victim to
166299 the date a dependent child is expected to reach eighteen (18) years
167300 of age or twenty-three (23) years of age if the depend ent child is
168301 enrolled as a full-time student. An award payable in installments
169302 for future loss of support may be modified by the Board in t he event
170303 a dependent child receiv ing loss of support is between the ages of
171304 eighteen (18) and twenty -three (23) years of age and is no longer
172305 enrolled as a full-time student, the dependent dies before all
173306 installments are paid or the dependent receiving in stallments moves
174307 and leaves no forwarding address with the Board office.

176308 E. An award shall not be subject to execut ion, attachment,
177309 garnishment or other process, ex cept for child support and except
178310 that an award for allowable expense shall not be exempt f rom a claim

181311 of a creditor to the extent that such creditor has provided
182312 products, services or accommodations, the co sts of which are
183313 included in the award.

185314 F. An assignment by the claimant to any future award u nder the
186315 provisions of this act Section 142.1 et seq. of this title is
187316 unenforceable, except:

189317 1. An assignment of any award for work loss to assure payment
190318 of court ordered alimony, maintenance or child support; or

192319 2. An assignment of any award for allowable expense to the
193320 extent that the benefits are for the cost of products, servic es or

194348 accommodations necessitated by the injury or death on which the
195349 claim is based and are provided or to be provi ded by the assignee.

197350 G. The Board may, in its discretion, approve payment of crisis
198351 counseling, occurring within three (3) years of the cri me, in an
199352 amount not to exceed Th ree Thousand Dollars ($3,000.00) for each
200353 family member of a homicide victim; provi ded, the counselor is a
201354 qualified mental health care provider. Medical and pharmaceutical
202355 treatment is not compensable for any family membe r of a deceased
203356 victim.

205357 H. Outpatient counseling expenses for a victim of criminally
206358 injurious conduct may be consi dered by the Board provided the
207359 counseling is focused on the crime and the counselor is a qualified
208360 mental health care provider. A total no t to exceed Three Thousand
209361 Dollars ($3,000.00) may be awarded for individual couns eling
210362 sessions for victims of crim inally injurious conduct. Sessions
211363 between the mental health care provider and nonoffending parents of
212364 a victimized child under eighteen (1 8) years of age may also be
213365 included in the award provided the combined total for the counseling
214366 and parental sessions do does not exceed Three Thousand Dollars
215367 ($3,000.00) and the parental sessions relate to the victimization.
216368 In extreme cases, the Board may, in its discretion, waive the thr ee-
217369 thousand-dollar limit. Inpatient mental health treatment will be
218370 reviewed on a case-by-case basis and may be compensated, at the

224400 I. Reasonable funeral, cremation or burial expenses shall not
225401 exceed Seven Thousand Five Hundred Dollars ($7,500.00 ).

227402 J. Reasonable costs associated with crime sce ne cleanup shall
228403 not exceed Two Thousand Dollars ($2,000.00).

230404 K. Loss of income of a careg iver shall not exceed Three
231405 Thousand Dollars ($3,000.00).

233406 L. Reasonable costs for vehicle impound fees are limited to
234407 violent crimes occurring in a vehicle owned by the victim of the
235408 violent crime or an eligible claimant, provided such fee is
236409 associated with the collection and security o f crime scene evidence.
237410 Reimbursement for vehicle impound fees shall not exceed Se ven
238411 Hundred Fifty Dollars ($750.00).

240412 SECTION 3. This act shall become effective November 1, 2023.
