4998 1. “Commission” means the Oklahoma Workforce Commission;

5199 2. “Person” means any individual, group of individuals, or any
52100 partnership, corporation, association, cooperative, or employee
53101 thereof, or any other legal entity; and

55102 3. “Governor’s Council for Workforce and Economic Development ”
56103 means the State’s Workforce Investment Board established under the
57104 authority of Executive Order 2 005-27 and Section 5003.10d of Title
58105 74 of the Oklahoma Statutes.

60106 SECTION 3. NEW LAW A new section of law to be codified
61107 in the Oklahoma Statutes as Section 902 of Title 40, unless there is

64109 There is hereby created the Oklahoma Workforce Commission. Th e
65110 purpose of the Commission is to coordinate the development of the
66111 workforce needed to grow Oklahoma ’s economy and Oklahomans ’
67112 prosperity. To accomplish this purpose, the Commission is empowered
68113 to the fullest extent permitted by law to coordinate the fundin g and
69114 activities of each element of the state’s workforce development
70115 programs, systems, and entities ; to achieve better alignment,
71116 accountability, and results for the state’s workforce development
72117 efforts; and to act as the principal point of contact regarding

73144 workforce development for public officials, businesses, and the
74145 public. In carrying out its work, the Commission shall consult
75146 officials, leaders, and experts in workforce development including,
76147 but not limited to, state and local agencies, departments,
77148 educational institution s, boards, commissions, the private sector,
78149 and other leaders and experts. The Commission shall conv ene
79150 advisory committees consisting o f relevant state and local agencies,
80151 departments, educational institution s, boards, commissions, the
81152 private sector, and other officials as the Commission deems
82153 appropriate. It is the intent of the Legislature that the
83154 Commission shall serve as a coordina ting body for workforce
84155 development entities in the state and that workforce development
85156 entities will fully participate in and cooperate with the
86157 Commission’s activities, but the Commission sha ll not directly
87158 exercise governing c ontrol of state and local agencies, depart ments,
88159 educational institutions, boards, commissions, a nd other workforce
89160 development entities except as otherwise pr escribed by law.

97164 A. The Oklahoma Workforce Commission shall consist of nine ( 9)
98165 members. The nine me mbers shall be private sector leaders

101193 1. Three members to be appointed by the President Pro Tempore
102194 of the Senate;

104195 2. Three members to be appointed by the Speaker of the House of
105196 Representatives; and

107197 3. Three members to be appointed by the Governor , one of whom
108198 shall be designated by the Governor t o serve as chair of the
109199 Commission.

111200 B. The members of the Commiss ion shall be qualified electors of
112201 this state and shall not be employed by any government entity or
113202 have been employed by a government entity within the preceding one-
114203 year period.

116204 C. For the initial appointments of Commissioners, each
117205 appointing authority shall make one appointment for a one -year term,
118206 one appointment for a two-year term, and one appointment for a
119207 three-year term. Thereafter, the terms of the Commissioners shall
120208 be for three (3) years. Commissioners may be appointed to
121209 subsequent terms without limit as to number.

123210 D. Vacancies on the Commission shall be fill ed for the
124211 unexpired term of office in the same manner as the original
125212 appointment. The appointed members shall serve at the pleasure of
126213 the appointing authorities.

128214 E. In addition to the chair appointed by the Governor, the
129215 Commission may establish a nd elect additional officers by a majority
130216 vote of the Commissioners. The chair shall preside over meetings of

131243 the Commission and officers shall perform duties as may be required
132244 by the Commission. The first meeting of the Commission shall be
133245 called by the chair no later than sixty (60) days after the
134246 effective date of this act .

138247 F. No member of the Commission shall receive a s alary for
139248 duties performed as a member of the Commission; however, members are
140249 eligible to receive reimbursement for expenses and travel
141250 reimbursement as provided for in the State Travel Reimbursement Act.

143251 G. Members serving on the Commission shall be eligible to serve
144252 on any other state board or commission if such member is othe rwise
145253 qualified to hold such appointed office, not withstanding the
146254 provisions of Section 6 of Title 51 of the Oklahoma Statutes.

148255 H. A quorum of five members shall be required to conduct
149256 official business of the Commission.

167294 support as the Commission deems appropriate to carry out the purpose
168295 and provisions of this act, including but not limited to a nonp rofit
169296 corporation to carry out the Commission ’s objectives, an Executive
170297 Director or other chief executive office r and any other employ ees or
171298 contractors the Commiss ion deems appropriate, and to prescribe their
172299 duties and fix their compensation;

174300 5. To administer the Workforce Coordination Revolving Fund
175301 created in Section 255.4 of Title 62 of the Oklahoma Statutes;

177302 6. To approve or disapprove the budget of the C ommission;

181303 7. To promulgate rules to carry out the provisions of this act;

183304 8. To enter into contracts or agreements for studies,
184305 professional services, grant administration and procurement,
185306 research projects, sup plies, or any other services the Commission
186307 deems necessary to carry out its purpose, and to incur those
187308 expenses necessary to carry out those purposes;

189309 9. To cooperate with any pr ivate, local, state, or national
190310 commission, organization, agency , or group and to make contracts and
191311 agreements for joint programs beneficial to Oklahoma ’s workforce
192312 development efforts;

194313 10. To accept donations, grants, contributions, and gifts from
195314 any public or private so urce and deposit such in the Workforce
196315 Coordination Revolving Fund, created in Section 255.4 of Title 62 of
197316 the Oklahoma Statutes;

200344 activities and administration of the Governor’s Council for
201345 Workforce and Economic Development, including but not limited to the
202346 creation and submission of state plans to the federal government
203347 pursuant to the provisions of the Workforce Innov ation and
204348 Opportunity Act;

206349 12. To collect data from federal, state , and local agencies,
207350 departments, educational institutions, boards, c ommissions, or any
208351 other entities including , but not limited to:

210352 a. number of participants in workforce development
211353 programming,

213354 b. cost per participant,

215355 c. wages before and after participation in programs,
216-
217356 d. degree or certificate conferred on each participant,

219357 e. number of jobs open needing degrees or certificates,

221358 f. labor force and economic information, and

225359 g. any other information the Commission deems appropriate
226360 to guide funding decisions, facilitate its work or the
227361 work of workforce development entities in the state,
228362 or to understand the impact of the state ’s workforce
229363 efforts and programming;

231364 13. To create and maintain a publi c dashboard and create
232365 reports with data concerning workforce development efforts in the
233366 state. All state and local agencies, departments, educational

235394 cooperate with information and data r equests from the Commission or
236395 its designees. It is the intent of the Legislatu re that the
237396 Oklahoma Workforce Commission serve as the centralized data and
238397 information repository for workforce development activities for the
239398 state; and

241399 14. To make recommendations to the Legislature to improve
242400 workforce developmen t programs in the state .
401+SECTION 6. It being immediately necessary for the preservation
402+of the public peace, health or safety, an emergency is hereby
403+declared to exist, by reason whereof this act shall take effect and
404+be in full force from and after its passage and approval.
