45	46		An Act relating to nuisances; amending 50 O.S. 2021,
46	47		Sections 2, 8, 10, and 21, which relate to public
47	48		nuisances, remedies, and civil action; prohibiting
48	49		certain acts from being deemed public nuisance;
49	50		clarifying applicable remedies in certain civil
50	51		actions; requiring certain determination for
51	52		liability in certain action; requiring determination
52	53		of proximate cause for maintenance of certain action;
53	54		specifying certain unlawful acts as public nuisance;

59	60		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	61		SECTION 1. AMENDATORY 50 O.S. 2021, Section 2, is
61	62		amended to read as follows:
62	63		Section 2. A public nuisance is one which affects at the same
63	64		time an entire community or neighborhood, or any considerable number
64	65		of persons, although the extent of the annoyance or damage inflicted
65	66		upon the individuals may be unequal. The manufacturing, marketing,
66		-	and selling of lawful products shall not be deemed a public

95	95		SECTION 2. AMENDATORY 50 O.S. 2021, Section 8, i s
96	96		amended to read as follows:
97	97		Section 8. A. The remedies against a public nuisance are:
98	98		1. Indictment or information , or;
99	99		2. A civil action, or seeking injunctive or other equitable
100	100		relief; or
101	101		3. Abatement;.
102	102		B. To be found liable in an action for pub lic nuisance, the
103	103		defendant in such an action must be determined by the court to have
104	104		been in control of the condi tions giving rise to the nuisance at the
105	105		time of injury.
106	106		SECTION 3. AMENDATORY 50 O.S. 2021, Section 10, is
107	107		amended to read as follows:
108	108		Section 10. A private person may maintain an action for a
109	109		public nuisance if it the court determines by clear and convincing
110	110		evidence that the nuisance is specially injurious the proximate
111	111		cause of special injury to himself the private person, but not
112	112		otherwise.
113	113		SECTION 4. AMENDATORY 50 O.S. 2021, Section 21, is
114	114		amended to read as follows:
115	115		Section 21. The repeated use of any real property or structure
116	116		thereon to commit unlawful drug distribution, prostitution, human
117		-	trafficking, or sex trafficking acts which result in a felony
