45	40		An Act relating to eminent domain; amending 27 O.S.
46	41		2021, Section 7, which relates to eminent domain for
47	42		electricity; determining when eminent domain ma y be
48	43		used; providing that eminent domain shall not be used
49	44		for certain facilities on private property; requiring
50	45		certain entities seeking eminent domain to receive
51	46		specific certificates under certain circumstances;
52	47		providing the Corporation Commission gran t such
53	48		certificates; and providing an effective date.

59	54		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	55		SECTION 1. AMENDATORY 27 O.S. 2021, Section 7, is
61	56		amended to read as follows:
62	57		Section 7. A. Except as otherwise pro vided in this section,
63	58		any person, firm or corporation organized under the laws of this
64	59		state, or authorized to do business in this state, to furnish light,
65	60		heat or power by electricity or natural gas, or any other person,
66	61		association or firm engaged in fu rnishing lights, heat or power by
67	62		electricity or natural gas shall have and exercise the right of
	63	+	eminent domain in the same manner and by like proceedings as
	64	+	provided for railroad corporations by laws of this state.

97	91		B. The power of eminent domain shall n ot be used for the siting
98	92		or building of wind turbines energy facilities, solar energy
99	93		facilities, battery storage facilities, hydrogen gas facilities, or
100	94		other renewable energy facilities on private property.
101	95		C. Prior to seeking to exercise eminent domai n for an electric
102	96		transmission facility rated greater than three hundred (300)
103	97		kilovolts, any person, firm, or corporation under the purview of
104	98		subsection A of this section must have obtained a Certificate of
105	99		Authority from the Corporation Commission, as r equired in Enrolled
106		-	House Bill No. 2756 of the ~~1st~~ Session of the 60th Oklahoma

107	101		Legislature.
108	102		SECTION 2. This act shall become effective November 1, 2025.
