4540 An Act relating to eminent domain; amending 27 O.S.
4641 2021, Section 7, which relates to eminent domain for
4742 electricity; determining when eminent domain ma y be
4843 used; providing that eminent domain shall not be used
4944 for certain facilities on private property; requiring
5045 certain entities seeking eminent domain to receive
5146 specific certificates under certain circumstances;

5954 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6055 SECTION 1. AMENDATORY 27 O.S. 2021, Section 7, is
6156 amended to read as follows:
6257 Section 7. A. Except as otherwise pro vided in this section,
6358 any person, firm or corporation organized under the laws of this
6459 state, or authorized to do business in this state, to furnish light,
6560 heat or power by electricity or natural gas, or any other person,
6661 association or firm engaged in fu rnishing lights, heat or power by
6762 electricity or natural gas shall have and exercise the right of
63+eminent domain in the same manner and by like proceedings as
64+provided for railroad corporations by laws of this state.

9791 B. The power of eminent domain shall n ot be used for the siting
9892 or building of wind turbines energy facilities, solar energy
9993 facilities, battery storage facilities, hydrogen gas facilities, or
10094 other renewable energy facilities on private property.
10195 C. Prior to seeking to exercise eminent domai n for an electric
10296 transmission facility rated greater than three hundred (300)
10397 kilovolts, any person, firm, or corporation under the purview of
10498 subsection A of this section must have obtained a Certificate of
10599 Authority from the Corporation Commission, as r equired in Enrolled
