6565 An Act relating to consumer protection; defining
6666 terms; prohibiting use of hidden fees and charges by

7777 BE IT ENACTED BY THE PEOPL E OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new s ection of law to be codified
7979 in the Oklahoma Statutes as Section 773 of Title 15, unless there is
8080 created a duplication in numbering, reads as follows:
8181 As used in this act:
8282 1. “Ancillary good or service ” means any additional good or
8383 goods or additional service or services offered to a consumer as
8484 part of a transaction;
8585 2. “Business” means an individual, corporation, partnership,
8686 association, or any other entity that offers goods or services
8787 including, but not limited to, online, in mobile applications, an d

140140 3. “Clear and conspicuous ” or “clearly and conspicuously ” means
141141 a required disclosure is easily noticeable and easily understandable
142142 by consumers, as follows:
143143 a. in any communication that is solely visual or solely
144144 audible, the disclosure shall be made through the same
145145 means by which the communication is presented. In any
146146 communication made through both visual and audible
147147 means, the disclosure shall be p resented
148148 simultaneously in both the visual and audible portions
149149 of the communication even if the presentation
150150 requiring the disclosure is made in only one means,
151151 b. a visual disclosure, by size, contrast, location, the
152152 length of time viewable, and other ch aracteristics,
153153 shall stand out from any accompanying text or visual
154154 elements so that it is easily noticed, read, and
155155 understood,
156156 c. an audible disclosure, including by telephone or
157157 streaming video, shall be delivered in a volume,
158158 speed, and cadence suffici ent for ease of
159159 understanding,
160160 d. in any communication using an interactive el ectronic
161161 medium, such as on the Internet, mobile application,
162162 or software, the disclosure shall be unavoidable,

214214 e. the disclosure shall use diction and syntax
215215 understandable to consumers and shall appear in each
216216 language in which the representation that requires the
217217 disclosure appears,
218218 f. the disclosure shall comply with these requirements in
219219 each medium through which it is received, including
220220 all electronic devices and face -to-face communication,
221221 and
222222 g. the disclosure shall not be contradicted or mitigated
223223 by, or inconsistent with, anything else in the
224224 communication;
225225 4. “Covered good or service ” means:
226226 a. live-event tickets, and
227227 b. short-term lodging including, but not limited to ,
228228 temporary sleeping accommodations at a hotel, motel,
229229 inn, short-term rental, vacation rental, or other
230230 place of lodging;
231231 5. “Government charges” means the fees or charges imposed on
232232 the transaction by a federal, state, trial, or local government
233233 agency, unit, or department;
234234 6. “Pricing information” means any information relating to an
235235 amount a consumer may pay;
236236 7. “Shipping charges” means the fees or charges that reasonably
237237 reflect the amount a business incurs to send physical goods to a

289289 consumer including, but not limited to, through the mail, private
290290 mail and shipping services, or by freight; and
291291 8. “Total price” means the maximum total of all fees or charges
292292 a consumer shall pay for any good or goods or service or services
293293 along with any mandatory a ncillary good or service. Government
294294 charges, shipping charges, and fees or c harges for any option al
295295 ancillary good or service may be excluded from the provisions of
296296 this act.
297297 SECTION 2. NEW LAW A new section of law to be codified
298298 in the Oklahoma Statutes as Section 773.1 of Title 15, unless there
299299 is created a duplication in numbering, reads as follows:
300300 A. It shall be unlawful for any business to offer, display, or
301301 advertise any price of a covered good or service without clearly an d
302302 conspicuously disclosing the total price.
303303 B. In any offer, display, or adve rtisement that represents any
304304 price of a covered good or service, a business shall disclose the
305305 total price more prominently than any other pricing information.
306306 Where the final amount of payment for the transaction is displayed,
307307 the final amount of payment shall be disclosed more prominently
308308 than, or as prominently as, the total price.
309309 C. A business shall disclose clearly and conspicuously, before
310310 the consumer consents to pay fo r any covered good or service:
311311 1. The nature, purpose, and amount of any fee or charge imposed
312312 on the transaction that has been excluded from the total price and

364364 the identity of the good or service for which the fee or charge is
365365 imposed; and
366366 2. The final amount of payment for the transaction.
367367 D. It shall be considered an unfair and deceptive practice
368368 under the Oklahoma Consumer Protection Act for any business in any
369369 offer, display, or advertisement for a covered good or service to
370370 misrepresent any fee or charge including, but not limited to, the
371371 nature, purpose, amount, or refunda bility of any fee or charge, and
372372 the identity of the good or service for which the fee or charge is
373373 imposed.
374374 SECTION 3. This act shall become effective November 1, 2025.
