99 relating to the requirement that certain applicants for a vehicle
1010 dealer general distinguishing number complete a dealer education
1111 course.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 503.029, Transportation Code, is amended
1414 by adding Subsections (d), (e), and (f) to read as follows:
1515 (d) An applicant for an original dealer general
1616 distinguishing number who proposes to be an independent motor
1717 vehicle dealer and who does not hold a general distinguishing
1818 number as a franchised motor vehicle dealer or independent motor
1919 vehicle dealer must submit to the department evidence that the
2020 applicant completed a dealer education course, approved by the
2121 department, in the year preceding the date the application is
2222 filed. The course must be at least 8 hours and not more than 12
2323 hours in length.
2424 (e) The department may approve a dealer education course
2525 under Subsection (d) only if the provider of the course:
2626 (1) is a business with experience providing compliance
2727 education to independent motor vehicle dealers;
2828 (2) provides online and CD-ROM versions of the course
2929 with assessment and verification capabilities;
3030 (3) provides ongoing educational support by telephone
3131 or the Internet for one year at no additional cost to persons who
3232 have completed a course;
3333 (4) provides at least one instructor-led dealer
3434 education course each month, including at least one instructor-led
3535 course each year in or near:
3636 (A) Austin;
3737 (B) Dallas and Fort Worth;
3838 (C) El Paso;
3939 (D) Houston; and
4040 (E) San Antonio; and
4141 (5) has a curriculum review panel for the course that
4242 consists of at least four independent motor vehicle dealers who
4343 hold dealer general distinguishing numbers.
4444 (f) Not later than the 180th day after the date the
4545 department first approves a dealer education course under
4646 Subsection (d), each person who holds a dealer general
4747 distinguishing number as an independent motor vehicle dealer shall
4848 complete a dealer education course approved by the department. This
4949 subsection does not apply to a person who has previously completed a
5050 dealer education course approved by the department. This
5151 subsection expires January 1, 2011.
5252 SECTION 2. Section 503.029(d), Transportation Code, as
5353 added by this Act, applies only to an application for an original
5454 independent motor vehicle dealer general distinguishing number
5555 filed with the Texas Department of Transportation on or after
5656 September 1, 2010. An application filed before that date is
5757 governed by the law in effect when the application was filed, and
5858 the former law is continued in effect for that purpose.
5959 SECTION 3. Not later than January 1, 2010, the Texas
6060 Department of Transportation shall begin to approve or reject
6161 applications from providers of dealer education courses under
6262 Sections 503.029(d) and (e), Transportation Code, as added by this
6363 Act.
6464 SECTION 4. This Act takes effect September 1, 2009.
