9	9	relating to the requirement that certain applicants for a vehicle
10	10	dealer general distinguishing number complete a dealer education
11	11	course.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 503.029, Transportation Code, is amended
14	14	by adding Subsections (d), (e), and (f) to read as follows:
15	15	(d) An applicant for an original dealer general
16	16	distinguishing number who proposes to be an independent motor
17	17	vehicle dealer and who does not hold a general distinguishing
18	18	number as a franchised motor vehicle dealer or independent motor
19	19	vehicle dealer must submit to the department evidence that the
20	20	applicant completed a dealer education course, approved by the
21	21	department, in the year preceding the date the application is
22	22	filed. The course must be at least 8 hours and not more than 12
23	23	hours in length.
24	24	(e) The department may approve a dealer education course
25	25	under Subsection (d) only if the provider of the course:
26	26	(1) is a business with experience providing compliance
27	27	education to independent motor vehicle dealers;
28	28	(2) provides online and CD-ROM versions of the course
29	29	with assessment and verification capabilities;
30	30	(3) provides ongoing educational support by telephone
31	31	or the Internet for one year at no additional cost to persons who
32	32	have completed a course;
33	33	(4) provides at least one instructor-led dealer
34	34	education course each month, including at least one instructor-led
35	35	course each year in or near:
36	36	(A) Austin;
37	37	(B) Dallas and Fort Worth;
38	38	(C) El Paso;
39	39	(D) Houston; and
40	40	(E) San Antonio; and
41	41	(5) has a curriculum review panel for the course that
42	42	consists of at least four independent motor vehicle dealers who
43	43	hold dealer general distinguishing numbers.
44	44	(f) Not later than the 180th day after the date the
45	45	department first approves a dealer education course under
46	46	Subsection (d), each person who holds a dealer general
47	47	distinguishing number as an independent motor vehicle dealer shall
48	48	complete a dealer education course approved by the department. This
49	49	subsection does not apply to a person who has previously completed a
50	50	dealer education course approved by the department. This
51	51	subsection expires January 1, 2011.
52	52	SECTION 2. Section 503.029(d), Transportation Code, as
53	53	added by this Act, applies only to an application for an original
54	54	independent motor vehicle dealer general distinguishing number
55	55	filed with the Texas Department of Transportation on or after
56	56	September 1, 2010. An application filed before that date is
57	57	governed by the law in effect when the application was filed, and
58	58	the former law is continued in effect for that purpose.
59	59	SECTION 3. Not later than January 1, 2010, the Texas
60	60	Department of Transportation shall begin to approve or reject
61	61	applications from providers of dealer education courses under
62	62	Sections 503.029(d) and (e), Transportation Code, as added by this
63	63	Act.
64	64	SECTION 4. This Act takes effect September 1, 2009.
