55 relating to authorizing the Department of State Health Services to
66 obtain criminal history record information for certain applicants
77 for employment.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 411.110, Government Code, is amended by
1010 amending Subsections (a), (c), and (d) and adding Subsection (f) to
1111 read as follows:
1212 (a) The Department of State Health Services is entitled to
1313 obtain from the department criminal history record information
1414 maintained by the department that relates to:
1515 (1) a person who is:
1616 (A) an applicant for a license or certificate
1717 under the Emergency Medical Services Act (Chapter 773, Health and
1818 Safety Code);
1919 (B) an owner or manager of an applicant for an
2020 emergency medical services provider license under that Act; or
2121 (C) the holder of a license or certificate under
2222 that Act;
2323 (2) an applicant for a license or a license holder
2424 under Subchapter N, Chapter 431, Health and Safety Code; [or]
2525 (3) an applicant for a license, the owner or manager of
2626 an applicant for a massage establishment license, or a license
2727 holder under Chapter 455, Occupations Code;
2828 (4) an applicant for employment at or current employee
2929 of:
3030 (A) the Texas Center for Infectious Disease; or
3131 (B) the South Texas Health Care System; or
3232 (5) an applicant for employment at, current employee
3333 of, or person who contracts or may contract to provide goods or
3434 services with:
3535 (A) the vital statistics unit of the Department
3636 of State Health Services; or
3737 (B) the Council on Sex Offender Treatment or
3838 other division or component of the Department of State Health
3939 Services that monitors sexually violent predators as described by
4040 Section 841.003(a), Health and Safety Code.
4141 (c) After an entity is licensed or certified, the Department
4242 of State Health Services shall destroy the criminal history record
4343 information that relates to that entity. The Department of State
4444 Health Services shall destroy the criminal history record
4545 information that relates to:
4646 (1) an applicant for employment after that applicant
4747 is employed or, for an applicant who is not employed, after the
4848 check of the criminal history record information on that applicant
4949 is completed; or
5050 (2) an employee or contractor after the check of the
5151 criminal history record information on that employee or contractor
5252 is completed.
5353 (d) The Department of State Health Services shall destroy
5454 criminal history record information that relates to an applicant
5555 who [that] is not certified or employed, as applicable.
5656 (f) The Department of State Health Services may not consider
5757 offenses for which points are assessed under Section 708.052,
5858 Transportation Code, to determine whether to hire or retain an
5959 employee or to contract with a person on whom criminal history
6060 record information is obtained under this section.
6161 SECTION 2. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2009.
