55 relating to the mandatory testing of persons suspected of exposing
66 employees of a juvenile probation department to certain diseases.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 81.050(b), Health and Safety Code, is
99 amended to read as follows:
1010 (b) A person whose occupation or whose volunteer service is
1111 included in one or more of the following categories may request the
1212 department or a health authority to order testing of another person
1313 who may have exposed the person to a reportable disease, including
1414 HIV infection:
1515 (1) a law enforcement officer;
1616 (2) a fire fighter;
1717 (3) an emergency medical service employee or
1818 paramedic;
1919 (4) a correctional officer; [or]
2020 (5) an employee, contractor, or volunteer, other than
2121 a correctional officer, who performs a service in a correctional
2222 facility as defined by Section 1.07, Penal Code, or a secure
2323 correctional facility or secure detention facility as defined by
2424 Section 51.02, Family Code; or
2525 (6) an employee of a juvenile probation department.
2626 SECTION 2. The change in law made by this Act applies only
2727 to an exposure to a disease that occurs on or after the effective
2828 date of this Act. An exposure to a disease that occurs before the
2929 effective date of this Act is covered by the law in effect when the
3030 exposure occurred, and the former law is continued in effect for
3131 that purpose.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
