H.B. No. 3005 AN ACT relating to the mandatory testing of persons suspected of exposing employees of a juvenile probation department to certain diseases. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 81.050(b), Health and Safety Code, is amended to read as follows: (b) A person whose occupation or whose volunteer service is included in one or more of the following categories may request the department or a health authority to order testing of another person who may have exposed the person to a reportable disease, including HIV infection: (1) a law enforcement officer; (2) a fire fighter; (3) an emergency medical service employee or paramedic; (4) a correctional officer; [or] (5) an employee, contractor, or volunteer, other than a correctional officer, who performs a service in a correctional facility as defined by Section 1.07, Penal Code, or a secure correctional facility or secure detention facility as defined by Section 51.02, Family Code; or (6) an employee of a juvenile probation department. SECTION 2. The change in law made by this Act applies only to an exposure to a disease that occurs on or after the effective date of this Act. An exposure to a disease that occurs before the effective date of this Act is covered by the law in effect when the exposure occurred, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2009. ______________________________ ______________________________ President of the Senate Speaker of the House I certify that H.B.
