1010 relating to use of school district resources for athletic or
1111 instructional facilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 11.168, Education Code, is amended to
1414 read as follows:
1515 Sec. 11.168. USE OF DISTRICT RESOURCES PROHIBITED FOR
1616 CERTAIN PURPOSES. Except as provided by Section 45.109(a-1), the
1717 [The] board of trustees of a school district may not enter into an
1818 agreement authorizing the use of school district employees,
1919 property, or resources for the provision of materials or labor for
2020 the design, construction, or renovation of improvements to real
2121 property not owned or leased by the district.
2222 SECTION 2. Section 45.109, Education Code, is amended by
2323 adding Subsection (a-1) to read as follows:
2424 (a-1) An independent school district and an institution of
2525 higher education, as defined by Section 61.003, located wholly or
2626 partially in the boundaries of the county in which the district is
2727 located may contract for the district to contribute district
2828 resources to pay a portion of the costs of the design or
2929 construction of an instructional facility or a stadium or other
3030 athletic facilities owned by or under the control of the
3131 institution of higher education. A district may contribute
3232 district resources under this subsection only if the district and
3333 the institution of higher education enter into a written agreement
3434 authorizing the district to use that facility.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2009.
