55 relating to filing fees in civil actions and proceedings and the use
66 of those fees, to costs on conviction in certain courts, to money
77 paid into the registry of a court in certain counties, and to the
88 appointment of counsel in certain suits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 102, Code of Criminal
1111 Procedure, is amended by adding Article 102.0169 to read as
1212 follows:
1313 Art. 102.0169. COURT COSTS; COUNTY AND DISTRICT COURT
1414 TECHNOLOGY FUND. (a) A defendant convicted of a criminal offense in
1515 a county court, statutory county court, or district court shall pay
1616 a $4 county and district court technology fee as a cost of court.
1717 (b) In this article, a person is considered convicted if:
1818 (1) a sentence is imposed on the person;
1919 (2) the person receives community supervision,
2020 including deferred adjudication; or
2121 (3) the court defers final disposition of the person's
2222 case.
2323 (c) The clerks of the courts described by Subsection (a)
2424 shall collect the costs and pay them to the county treasurer or to
2525 any other official who discharges the duties commonly delegated to
2626 the county treasurer, as appropriate, for deposit in a fund to be
2727 known as the county and district court technology fund.
2828 (d) A fund designated by this article may be used only to
2929 finance:
3030 (1) the cost of continuing education and training for
3131 county court, statutory county court, or district court judges and
3232 clerks regarding technological enhancements for those courts; and
3333 (2) the purchase and maintenance of technological
3434 enhancements for a county court, statutory county court, or
3535 district court, including:
3636 (A) computer systems;
3737 (B) computer networks;
3838 (C) computer hardware;
3939 (D) computer software;
4040 (E) imaging systems;
4141 (F) electronic kiosks; and
4242 (G) docket management systems.
4343 (e) The county and district court technology fund shall be
4444 administered by or under the direction of the commissioners court
4545 of the county.
4646 SECTION 2. Section 117.111, Local Government Code, is
4747 amended to read as follows:
4848 Sec. 117.111. SUBCHAPTER APPLICABLE TO COUNTY WITH
4949 POPULATION OF 1.3 [2.4] MILLION OR MORE. This subchapter applies
5050 only to a county with a population of 1.3 [2.4] million or more.
5151 SECTION 3. The heading to Subchapter E, Chapter 117, Local
5252 Government Code, is amended to read as follows:
5353 SUBCHAPTER E. SPECIAL PROVISIONS APPLYING TO FUNDS PAID INTO COURT
5454 REGISTRY IN COUNTY WITH POPULATION OF MORE THAN 1.3 [2.4] MILLION
5555 SECTION 4. Section 133.152(a), Local Government Code, is
5656 amended to read as follows:
5757 (a) In addition to other fees collected under Section
5858 133.151(a) or otherwise authorized or required by law, the clerk of
5959 a district court shall collect the following fees on the filing of
6060 any civil action or proceeding requiring a filing fee, including an
6161 appeal, and on the filing of any counterclaim, cross-action,
6262 intervention, interpleader, or third-party action requiring a
6363 filing fee:
6464 (1) $5 in family law cases and proceedings as defined
6565 by Section 25.0002, Government Code; and
6666 (2) $10 in any case other than a case described by
6767 Subdivision (1).
6868 SECTION 5. Section 133.153(a), Local Government Code, is
6969 amended to read as follows:
7070 (a) In addition to other fees authorized or required by law,
7171 the clerk of a court other than a district court, the courts of
7272 appeals, or the supreme court shall collect the following fees on
7373 the filing of any civil action or proceeding requiring a filing fee,
7474 including an appeal, and on the filing of any counterclaim,
7575 cross-action, intervention, interpleader, or third-party action
7676 requiring a filing fee:
7777 (1) $10 [$5] for statutory and constitutional county
7878 courts; and
7979 (2) $6 [$2] for justice of the peace courts.
8080 SECTION 6. Subchapter A, Chapter 25, Government Code, is
8181 amended by adding Section 25.0020 to read as follows:
8282 Sec. 25.0020. APPOINTMENT OF COUNSEL IN CERTAIN APPEALS.
8383 (a) On a written application of any party to an eviction suit, the
8484 county court or county court at law in which an appeal of the suit is
8585 filed may appoint any qualified attorney who is willing to provide
8686 pro bono services in the matter or counsel from a list provided by a
8787 pro bono legal services program of counsel willing to be appointed
8888 to handle appeals under this section to attend to the cause of a
8989 party who:
9090 (1) was in possession of the residence at the time the
9191 eviction suit was filed in the justice court; and
9292 (2) has perfected the appeal on a pauper's affidavit
9393 approved in accordance with Rule 749a, Texas Rules of Civil
9494 Procedure.
9595 (b) The appointed counsel shall represent the individual in
9696 the proceedings of the suit in the county court or county court at
9797 law. At the conclusion of those proceedings, the appointment
9898 terminates.
9999 (c) The court may terminate representation appointed under
100100 this section for cause.
101101 (d) Appointed counsel may not receive attorney's fees
102102 unless the recovery of attorney's fees is provided for by contract,
103103 statute, common law, court rules, or other regulations. The county
104104 is not responsible for payment of attorney's fees to appointed
105105 counsel.
106106 (e) The court shall provide for a method of service of
107107 written notice on the parties to an eviction suit of the right to
108108 request an appointment of counsel on perfection of appeal on
109109 approval of a pauper's affidavit.
110110 SECTION 7. Subchapter A, Chapter 26, Government Code, is
111111 amended by adding Section 26.010 to read as follows:
112112 Sec. 26.010. APPOINTMENT OF COUNSEL IN CERTAIN APPEALS.

140140 SECTION 8. Subchapter H, Chapter 51, Government Code, is
141141 amended by adding Section 51.708 to read as follows:
142142 Sec. 51.708. ADDITIONAL FILING FEE FOR CIVIL CASES IN
143143 CERTAIN COURTS. (a) In addition to all other fees authorized or
144144 required by other law, the clerk of a county court, statutory county
145145 court, or district court shall collect a filing fee of not more than
146146 $10 in each civil case filed in the court to be used for court record
147147 preservation for the courts in the county.
148148 (b) Court fees due under this section shall be collected in
149149 the same manner as other fees, fines, or costs are collected in the
150150 case.
151151 (c) The clerk at least monthly shall send the fees collected
152152 under this section to the county treasurer or to any other official
153153 who discharges the duties commonly assigned to the county
154154 treasurer. The treasurer or other official shall deposit the fees
155155 in a court record preservation account in the county treasury. The
156156 money in the account may be used only to digitize court records and
157157 preserve the records from natural disasters.
158158 (d) The court record preservation account shall be
159159 administered by or under the direction of the commissioners court
160160 of the county.
161161 SECTION 9. Subchapter D, Chapter 101, Government Code, is
162162 amended by adding Section 101.06117 to read as follows:
163163 Sec. 101.06117. ADDITIONAL DISTRICT COURT FEES: GOVERNMENT
164164 CODE. The clerk of a district court shall collect an additional
165165 filing fee not to exceed $10 under Section 51.708, Government Code,
166166 in certain civil cases to fund the preservation of court records.
167167 SECTION 10. Subchapter E, Chapter 101, Government Code, is
168168 amended by adding Section 101.08115 to read as follows:
169169 Sec. 101.08115. ADDITIONAL STATUTORY COUNTY COURT FEES:
170170 GOVERNMENT CODE. The clerk of a statutory county court shall
171171 collect an additional filing fee not to exceed $10 under Section
172172 51.708, Government Code, in certain civil cases to fund the
173173 preservation of court records.
174174 SECTION 11. (a) Section 101.0814, Government Code, is
175175 amended to conform to the amendments made to Section 101.081,
176176 Government Code, by Chapter 399 (S.B. 819), Acts of the 80th
177177 Legislature, Regular Session, 2007, and to conform to the
178178 amendments made to Section 101.083, Government Code, by Chapter
179179 1301 (S.B. 600), Acts of the 80th Legislature, Regular Session,
180180 2007, and is further amended to read as follows:

645645 eviction suit filed on or after the effective date of this Act. A
646646 suit filed before the effective date of this Act is governed by the
647647 law in effect immediately before that date, and that law is
648648 continued in effect for that purpose.
649649 SECTION 20. The change in law made by this Act in adding
650650 Article 102.0169, Code of Criminal Procedure, applies only to a
651651 cost on conviction for an offense committed on or after the
652652 effective date of this Act. A cost on conviction for an offense
653653 committed before the effective date of this Act is covered by the
654654 law in effect when the offense was committed, and the former law is
655655 continued in effect for that purpose. For purposes of this section,
656656 an offense was committed before the effective date of this Act if
657657 any element of the offense occurred before that date.
658658 SECTION 21. The changes in law made by this Act apply only
659659 to a fee that becomes payable on or after the effective date of this
660660 Act. A fee that becomes payable before the effective date of this
661661 Act is governed by the law in effect when the fee became payable,
662662 and the former law is continued in effect for that purpose.
663663 SECTION 22. This Act takes effect September 1, 2009.
