| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 39.072, Education Code, is amended by | |
| 12 | 12 | adding Subsection (a-1) to read as follows: | |
| 13 | 13 | (a-1) Notwithstanding Subsection (a) or (c) or Section | |
| 14 | 14 | 12.104(b)(2)(L), an open-enrollment charter school that provides | |
| 15 | 15 | educational services only to students confined by court order in a | |
| 16 | 16 | residential program or facility operated by a juvenile board: | |
| 17 | 17 | (1) is not subject to assignment of a performance | |
| 18 | 18 | rating under Subsection (a); and | |
| 19 | 19 | (2) shall be considered under the accountability | |
| 20 | 20 | system in the same manner as other entities that are not rated under | |
| 21 | 21 | that system. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2009. |
