A BILL TO BE ENTITLED
AN ACT
relating to performance ratings assigned to certain
open-enrollment charter schools under the public school
accountability system.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.072, Education Code, is amended by
adding Subsection (a-1) to read as follows:
(a-1) Notwithstanding Subsection (a) or (c) or Section
12.104(b)(2)(L), an open-enrollment charter school that provides
educational services only to students confined by court order in a
residential program or facility operated by a juvenile board:
(1) is not subject to assignment of a performance
rating under Subsection (a); and
(2) shall be considered under the accountability
system in the same manner as other entities that are not rated under
that system.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
