| 7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 8 | 8 | SECTION 1. Section 504.615, Transportation Code, is amended | |
| 9 | 9 | by adding Subsection (d-1) and amending Subsection (e) to read as | |
| 10 | 10 | follows: | |
| 11 | 11 | (d-1) If the fee is for the issuance of license plates for a | |
| 12 | 12 | college described by Subsection (e)(3), the amount of the fee | |
| 13 | 13 | remaining after deduction of the department's administrative costs | |
| 14 | 14 | shall be deposited to the credit of the Texas Higher Education | |
| 15 | 15 | Coordinating Board and may be used only to fund the award of TEXAS | |
| 16 | 16 | grants under Subchapter M, Chapter 56, Education Code. | |
| 17 | 17 | (e) In this section, "college" means: | |
| 18 | 18 | (1) an institution of higher education as defined by | |
| 19 | 19 | Section 61.003, Education Code; [or] | |
| 20 | 20 | (2) a private college or university described by | |
| 21 | 21 | Section 61.222, Education Code; or | |
| 22 | 22 | (3) the University of Notre Dame. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2009. |
