| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 545.307, Transportation Code, is amended |
|---|
| 14 | 14 | | by amending Subsections (b) and (b-1) to read as follows: |
|---|
| 15 | 15 | | (b) Except as provided by Subsection (b-1), after 10 p.m. |
|---|
| 16 | 16 | | and before 6 a.m., a person may not park a commercial motor vehicle |
|---|
| 17 | 17 | | or leave the vehicle parked: |
|---|
| 18 | 18 | | (1) in a private driveway that is located in a |
|---|
| 19 | 19 | | residential subdivision; or |
|---|
| 20 | 20 | | (2) on a street that is maintained by a county or |
|---|
| 21 | 21 | | municipality and for which signs are posted as provided by |
|---|
| 22 | 22 | | Subsection (c) if the street: |
|---|
| 23 | 23 | | (A) [(1)] is located within a residential |
|---|
| 24 | 24 | | subdivision; or |
|---|
| 25 | 25 | | (B) [(2)] is adjacent to a residential |
|---|
| 26 | 26 | | subdivision and within 1,000 feet of the property line of a |
|---|
| 27 | 27 | | residence, school, place of worship, or park. |
|---|
| 28 | 28 | | (b-1) A person may park a commercial motor vehicle or leave |
|---|
| 29 | 29 | | the vehicle parked in a private driveway that is located in a |
|---|
| 30 | 30 | | residential subdivision, or on a street for which signs are posted |
|---|
| 31 | 31 | | as provided by Subsection (c) if the commercial motor vehicle: |
|---|
| 32 | 32 | | (1) is transporting persons or property to or from the |
|---|
| 33 | 33 | | residential subdivision or performing work in the subdivision; and |
|---|
| 34 | 34 | | (2) remains parked in or adjacent to the subdivision |
|---|
| 35 | 35 | | only for the period necessary to complete the transportation or |
|---|
| 36 | 36 | | work. |
