88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to a prohibition on parking a commercial motor vehicle in
1111 certain residential subdivisions.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 545.307, Transportation Code, is amended
1414 by amending Subsections (b) and (b-1) to read as follows:
1515 (b) Except as provided by Subsection (b-1), after 10 p.m.
1616 and before 6 a.m., a person may not park a commercial motor vehicle
1717 or leave the vehicle parked:
1818 (1) in a private driveway that is located in a
1919 residential subdivision; or
2020 (2) on a street that is maintained by a county or
2121 municipality and for which signs are posted as provided by
2222 Subsection (c) if the street:
2323 (A) [(1)] is located within a residential
2424 subdivision; or
2525 (B) [(2)] is adjacent to a residential
2626 subdivision and within 1,000 feet of the property line of a
2727 residence, school, place of worship, or park.
2828 (b-1) A person may park a commercial motor vehicle or leave
2929 the vehicle parked in a private driveway that is located in a
3030 residential subdivision, or on a street for which signs are posted
3131 as provided by Subsection (c) if the commercial motor vehicle:
3232 (1) is transporting persons or property to or from the
3333 residential subdivision or performing work in the subdivision; and
3434 (2) remains parked in or adjacent to the subdivision
3535 only for the period necessary to complete the transportation or
3636 work.
3737 SECTION 2. This Act takes effect September 1, 2009.
