77 relating to the establishment of an interagency farm-to-school
88 coordination task force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 12, Agriculture Code, is amended by
1111 adding Section 12.0026 to read as follows:
1212 Sec. 12.0026. INTERAGENCY FARM-TO-SCHOOL COORDINATION TASK
1313 FORCE. (a) To promote a healthy diet for schoolchildren and the
1414 business of small to mid-sized local farms and ranches, the
1515 interagency farm-to-school coordination task force shall develop a
1616 plan to facilitate the availability of locally grown food products
1717 in public schools.
1818 (b) The task force is composed of:
1919 (1) a representative of:
2020 (A) the department, appointed by the
2121 commissioner;
2222 (B) the Texas Education Agency, appointed by the
2323 commissioner of education; and
2424 (C) the Department of State Health Services,
2525 appointed by the commissioner of that department; and
2626 (2) at least one representative of each of the
2727 following groups, appointed by the commissioner:
2828 (A) fruit and vegetable producer organizations;
2929 (B) school food service organizations;
3030 (C) food distribution businesses;
3131 (D) child nutrition and advocacy organizations;
3232 (E) parent organizations;
3333 (F) educational institutions that conduct
3434 research in the areas of agriculture and nutrition; and
3535 (G) health nutrition educators who serve school
3636 districts.
3737 (c) A member of the task force serves at the will of the
3838 official who appointed the member.
3939 (d) The representative of the department serves as
4040 presiding officer. The task force may elect other necessary
4141 officers from its members.
4242 (e) The task force shall meet at the call of the presiding
4343 officer.
4444 (f) The agency whose commissioner appoints a member is
4545 responsible for the expenses of a member's service on the task
4646 force. A member of the task force is not entitled to additional
4747 compensation for serving on the task force.
4848 (g) Each appropriate agency or group represented on the task
4949 force shall provide the personnel and resources necessary to
5050 implement a task force measure under this section.
5151 (h) Subject to available funding, the task force shall:
5252 (1) design education resources on nutrition and food
5353 education to be used by schools and school districts;
5454 (2) expand food-focused experiential education
5555 programs;
5656 (3) create a grant program funded by the department
5757 that allows schools and school districts to recover the costs
5858 associated with purchasing locally grown food products;
5959 (4) develop a database of available locally grown food
6060 products for use by school food service agencies that includes
6161 contact and purchasing information for the products;
6262 (5) design and implement training programs to enable
6363 local farmers and ranchers to market their products to schools and
6464 school districts, including programs related to:
6565 (A) crop production;
6666 (B) marketing of crops;
6767 (C) postharvest handling of crops;
6868 (D) food safety;
6969 (E) business management;
7070 (F) liability and risk management; and
7171 (G) other topics deemed appropriate by the task
7272 force;
7373 (6) advise schools and school districts on methods by
7474 which a school or school district may improve its facilities to
7575 allow for the use of minimally processed, fresh, and locally
7676 produced foods in school meals;
7777 (7) provide technical assistance to school food
7878 service agencies to establish procedures, recipes, menu rotations,
7979 and other internal processes that accommodate the use of locally
8080 grown foods in public schools;
8181 (8) offer advanced skills development training to
8282 school food service employees regarding the proper methods of
8383 handling, preparing, and serving locally grown foods; and
8484 (9) conduct any other activity considered by the task
8585 force as necessary to achieve its goals under this section.
8686 (i) The task force may solicit and accept gifts, grants, and
8787 donations from public and private entities to use for the purposes
8888 of this section.
8989 SECTION 2. (a) Not later than December 1, 2009, the
9090 Department of Agriculture shall establish the interagency
9191 farm-to-school coordination task force as required by Section
9292 12.0026, Agriculture Code, as added by this Act.
9393 (b) Not later than February 1, 2010, the commissioners of
9494 the Department of Agriculture, the Texas Education Agency, and the
9595 Department of State Health Services shall appoint members of the
9696 interagency farm-to-school coordination task force, as required by
9797 Section 12.0026, Agriculture Code, as added by this Act.
9898 SECTION 3. This Act takes effect September 1, 2009.
