| 7 | 7 | | relating to the making or acceptance of political contributions in |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 253.039, Election Code, is amended by |
|---|
| 11 | 11 | | amending Subsections (a), (b), and (c) and adding Subsection (h) |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | (a) A person may not knowingly make or authorize a political |
|---|
| 14 | 14 | | contribution while in the Capitol or a courthouse to: |
|---|
| 15 | 15 | | (1) a candidate or officeholder; |
|---|
| 16 | 16 | | (2) a political committee; or |
|---|
| 17 | 17 | | (3) a person acting on behalf of a candidate, |
|---|
| 18 | 18 | | officeholder, or political committee. |
|---|
| 19 | 19 | | (b) A candidate, officeholder, or political committee or a |
|---|
| 20 | 20 | | person acting on behalf of a candidate, officeholder, or political |
|---|
| 21 | 21 | | committee may not knowingly accept a political contribution, and |
|---|
| 22 | 22 | | shall refuse a political contribution that is received, in the |
|---|
| 23 | 23 | | Capitol or a courthouse. |
|---|
| 24 | 24 | | (c) This section does not prohibit contributions made in the |
|---|
| 25 | 25 | | Capitol or a courthouse through the United States postal service or |
|---|
| 26 | 26 | | a common or contract carrier. |
|---|
| 27 | 27 | | (h) In this section, "courthouse" means any building owned |
|---|
| 28 | 28 | | or occupied by the state, a county, or a municipality, including a |
|---|
| 29 | 29 | | building or office leased to the state, a county, or a municipality, |
|---|
| 30 | 30 | | in which a justice or judge sits to conduct court proceedings. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2009. |
