55 relating to the release from the Texas Department of Criminal
66 Justice of certain inmates who complete a rehabilitation program.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 508.141, Government Code, is amended by
99 adding Subsections (b-1), (d-1), and (d-2) and amending Subsection
1010 (d) to read as follows:
1111 (b-1) If a parole panel requires, as a condition of release,
1212 that an inmate complete a specific department rehabilitation
1313 program before release, the department shall place the inmate in
1414 the program specified by the parole panel, except that the
1515 department may place the inmate in a different program with the
1616 approval of the parole panel.
1717 (d) A parole panel may release an inmate on parole during
1818 the parole month established for the inmate, or during any
1919 applicable range of dates established under Subsection (d-1), if
2020 the panel determines that the inmate's release will not increase
2121 the likelihood of harm to the public.
2222 (d-1) A parole panel that, as a condition of release,
2323 requires an inmate to complete a specific department rehabilitation
2424 program shall specify a range of dates, based on the date the inmate
2525 is likely to have completed the specified program, during which the
2626 department may release the inmate, if the inmate has:
2727 (1) successfully completed the program specified by
2828 the parole panel; and
2929 (2) satisfied all other conditions of release
3030 specified by the parole panel.
3131 (d-2) The range of dates specified by the parole panel under
3232 Subsection (d-1) may not begin earlier than the 45th day before any
3333 applicable release date established for the inmate and must be a
3434 range of at least 30 days.
3535 SECTION 2. The change in law made by this Act applies to any
3636 inmate who is confined in a facility operated by or under contract
3737 with the Texas Department of Criminal Justice on or after the
3838 effective date of this Act, regardless of when the inmate's period
3939 of confinement began.
4040 SECTION 3. This Act takes effect September 1, 2009.
