| 10 | 10 | | relating to creating an account to promote continuing education for |
|---|
| 11 | 11 | | certain child care providers. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 42.0521, Human Resources Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | Sec. 42.0521. EARLY CHILD CARE DEVELOPMENT ACCOUNT; DEPOSIT |
|---|
| 16 | 16 | | OF FEES. (a) The early child care development account is an |
|---|
| 17 | 17 | | account in the general revenue fund that may be appropriated only to |
|---|
| 18 | 18 | | the department for the purposes and activities authorized by this |
|---|
| 19 | 19 | | section and for reasonable administrative expenses under this |
|---|
| 20 | 20 | | chapter. |
|---|
| 21 | 21 | | (b) The account consists of: |
|---|
| 22 | 22 | | (1) the [The] fees authorized by this chapter and |
|---|
| 23 | 23 | | received by the department; |
|---|
| 24 | 24 | | (2) all money appropriated for the purposes of this |
|---|
| 25 | 25 | | section; |
|---|
| 26 | 26 | | (3) any gifts, grants, or donations received for the |
|---|
| 27 | 27 | | purposes of this section; and |
|---|
| 28 | 28 | | (4) interest earned on money in the account. |
|---|
| 29 | 29 | | (c) The account is exempt from the application of Section |
|---|
| 30 | 30 | | 403.095, Government Code. |
|---|
| 31 | 31 | | (d) The purpose of the account is to support continuing |
|---|
| 32 | 32 | | education initiatives that: |
|---|
| 33 | 33 | | (1) implement infant and toddler child care best |
|---|
| 34 | 34 | | practices for caregivers of children from birth to age three; |
|---|
| 35 | 35 | | (2) promote the development of secure, consistent, |
|---|
| 36 | 36 | | responsive relationships and attachments between child care |
|---|
| 37 | 37 | | workers and the infants and toddlers in their care; and |
|---|
| 38 | 38 | | (3) provide training and knowledge on the importance |
|---|
| 39 | 39 | | of the emotional development of infants and toddlers [shall be |
|---|
| 40 | 40 | | deposited in the general revenue fund]. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2009. |
