99 AN ACT
1010 relating to creating an account to promote continuing education for
1111 certain child care providers.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 42.0521, Human Resources Code, is
1414 amended to read as follows:
1515 Sec. 42.0521. EARLY CHILD CARE DEVELOPMENT ACCOUNT; DEPOSIT
1616 OF FEES. (a) The early child care development account is an
1717 account in the general revenue fund that may be appropriated only to
1818 the department for the purposes and activities authorized by this
1919 section and for reasonable administrative expenses under this
2020 chapter.
2121 (b) The account consists of:
2222 (1) the [The] fees authorized by this chapter and
2323 received by the department;
2424 (2) all money appropriated for the purposes of this
2525 section;
2626 (3) any gifts, grants, or donations received for the
2727 purposes of this section; and
2828 (4) interest earned on money in the account.
2929 (c) The account is exempt from the application of Section
3030 403.095, Government Code.
3131 (d) The purpose of the account is to support continuing
3232 education initiatives that:
3333 (1) implement infant and toddler child care best
3434 practices for caregivers of children from birth to age three;
3535 (2) promote the development of secure, consistent,
3636 responsive relationships and attachments between child care
3737 workers and the infants and toddlers in their care; and
3838 (3) provide training and knowledge on the importance
3939 of the emotional development of infants and toddlers [shall be
4040 deposited in the general revenue fund].
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
