| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (b), Section 28.009, Education Code, |
|---|
| 10 | 10 | | is amended to read as follows: |
|---|
| 11 | 11 | | (b) The agency shall coordinate with the Texas Higher |
|---|
| 12 | 12 | | Education Coordinating Board as necessary in administering this |
|---|
| 13 | 13 | | section. The commissioner may adopt rules as necessary concerning |
|---|
| 14 | 14 | | the duties under this section of a school district. The Texas |
|---|
| 15 | 15 | | Higher Education Coordinating Board may adopt rules as necessary |
|---|
| 16 | 16 | | concerning the duties under this section of a public institution of |
|---|
| 17 | 17 | | higher education. |
|---|
| 18 | 18 | | SECTION 2. Effective September 1, 2009, Subsection (c), |
|---|
| 19 | 19 | | Section 28.009, Education Code, is amended to read as follows: |
|---|
| 20 | 20 | | (c) Each school district shall annually report to the |
|---|
| 21 | 21 | | agency: |
|---|
| 22 | 22 | | (1) the number of district students, including career |
|---|
| 23 | 23 | | and technical students, who have participated in the program [and |
|---|
| 24 | 24 | | earned college credit]; and |
|---|
| 25 | 25 | | (2) the [cumulative number of] courses in which |
|---|
| 26 | 26 | | participating district students [have enrolled and college credit |
|---|
| 27 | 27 | | hours the students] have earned high school credit under this |
|---|
| 28 | 28 | | section. |
|---|
| 29 | 29 | | SECTION 3. Effective September 1, 2011, Subsection (c), |
|---|
| 30 | 30 | | Section 28.009, Education Code, is amended to read as follows: |
|---|
| 31 | 31 | | (c) The commissioner and the Texas Higher Education |
|---|
| 32 | 32 | | Coordinating Board shall share data as necessary to enable school |
|---|
| 33 | 33 | | districts to comply with this subsection. Each school district |
|---|
| 34 | 34 | | shall annually report to the agency: |
|---|
| 35 | 35 | | (1) the number of district students, including career |
|---|
| 36 | 36 | | and technical students, who have participated in the program and |
|---|
| 37 | 37 | | earned college credit; and |
|---|
| 38 | 38 | | (2) the cumulative number of courses in which |
|---|
| 39 | 39 | | participating district students have enrolled and college credit |
|---|
| 40 | 40 | | hours the students have earned. |

| 41 | 41 | | SECTION 4. Effective September 1, 2011, Section 28.009, |
|---|
| 42 | 42 | | Education Code, is amended by adding Subsection (c-1) to read as |
|---|
| 43 | 43 | | follows: |
|---|
| 44 | 44 | | (c-1) The Texas Higher Education Coordinating Board shall |
|---|
| 45 | 45 | | collect student course credit data from public institutions of |
|---|
| 46 | 46 | | higher education as necessary for purposes of Subsection (c). |
|---|
| 47 | 47 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2009. |
