55 relating to revenue received from the provision of pay telephone
66 service to inmates confined in facilities operated by the Texas
77 Department of Criminal Justice.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (c), Section 495.025, Government
1010 Code, as added by Chapter 100 (S.B. 1580), Acts of the 80th
1111 Legislature, Regular Session, 2007, is reenacted to read as
1212 follows:
1313 (c) The department shall transfer 50 percent of all
1414 commissions paid to the department by a vendor under this section to
1515 the compensation to victims of crime fund established by Subchapter
1616 B, Chapter 56, Code of Criminal Procedure, and the other 50 percent
1717 to the credit of the undedicated portion of the general revenue
1818 fund, except that the department shall transfer the first $10
1919 million of the commissions collected in any given year under a
2020 contract awarded under this section to the compensation to victims
2121 of crime fund established by Subchapter B, Chapter 56, Code of
2222 Criminal Procedure. This section does not reduce any
2323 appropriation to the department.
2424 SECTION 2. Notwithstanding Chapter 1418 (H.B. 3107), Acts
2525 of the 80th Legislature, Regular Session, 2007, money dedicated by
2626 Subsection (c), Section 495.025, Government Code, as added by
2727 Chapter 100 (S.B. 1580), Acts of the 80th Legislature, Regular
2828 Session, 2007, to the compensation to victims of crime fund
2929 established by Subchapter B, Chapter 56, Code of Criminal
3030 Procedure, is rededicated by this Act.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
