| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (c), Section 495.025, Government |
|---|
| 10 | 10 | | Code, as added by Chapter 100 (S.B. 1580), Acts of the 80th |
|---|
| 11 | 11 | | Legislature, Regular Session, 2007, is reenacted to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (c) The department shall transfer 50 percent of all |
|---|
| 14 | 14 | | commissions paid to the department by a vendor under this section to |
|---|
| 15 | 15 | | the compensation to victims of crime fund established by Subchapter |
|---|
| 16 | 16 | | B, Chapter 56, Code of Criminal Procedure, and the other 50 percent |
|---|
| 17 | 17 | | to the credit of the undedicated portion of the general revenue |
|---|
| 18 | 18 | | fund, except that the department shall transfer the first $10 |
|---|
| 19 | 19 | | million of the commissions collected in any given year under a |
|---|
| 20 | 20 | | contract awarded under this section to the compensation to victims |
|---|
| 21 | 21 | | of crime fund established by Subchapter B, Chapter 56, Code of |
|---|
| 22 | 22 | | Criminal Procedure. This section does not reduce any |
|---|
| 23 | 23 | | appropriation to the department. |
|---|
| 24 | 24 | | SECTION 2. Notwithstanding Chapter 1418 (H.B. 3107), Acts |
|---|
| 25 | 25 | | of the 80th Legislature, Regular Session, 2007, money dedicated by |
|---|
| 26 | 26 | | Subsection (c), Section 495.025, Government Code, as added by |
|---|
| 27 | 27 | | Chapter 100 (S.B. 1580), Acts of the 80th Legislature, Regular |
|---|
| 28 | 28 | | Session, 2007, to the compensation to victims of crime fund |
|---|
| 29 | 29 | | established by Subchapter B, Chapter 56, Code of Criminal |
|---|
| 30 | 30 | | Procedure, is rededicated by this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
