99 relating to obsolete or redundant reporting requirements
1010 applicable to health and human services agencies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 531, Government Code, is
1313 amended by adding Section 531.0145 to read as follows:
1414 Sec. 531.0145. OBSOLETE OR REDUNDANT REPORTING
1515 REQUIREMENTS. (a) Not later than December 1, 2009, the executive
1616 commissioner shall:
1717 (1) examine the health and human services agency
1818 reporting requirements established by a state statute enacted
1919 before January 1, 2007, and not amended since that date, and
2020 identify each reporting requirement that the executive
2121 commissioner determines:
2222 (A) is not necessary to accomplish the objectives
2323 of the statute that contains the reporting requirement;
2424 (B) is redundant of other statutory reporting
2525 requirements; or
2626 (C) is required under statute to be provided at a
2727 frequency for which data is not available;
2828 (2) provide to the governor, the lieutenant governor,
2929 the speaker of the house of representatives, the chairs of the
3030 Senate Health and Human Services Committee, House Human Services
3131 Committee, and House Public Health Committee, or those committees'
3232 successors, the state auditor's office, the Legislative Budget
3333 Board, the Texas State Library and Archives Commission, and the
3434 Sunset Advisory Commission an initial report that includes:
3535 (A) each statutory reporting requirement for
3636 which the executive commissioner made the determination described
3737 by Subdivision (1); and
3838 (B) the justification for the executive
3939 commissioner's determination for each reporting requirement;
4040 (3) publish a copy of the initial report in the Texas
4141 Register; and
4242 (4) post a copy of the initial report on the
4343 commission's Internet website.
4444 (b) Not later than the 60th day after the date the executive
4545 commissioner issues the initial report under Subsection (a)(2), the
4646 executive commissioner shall hold a public hearing on the report.
4747 (c) The executive commissioner may not include in the
4848 initial report issued under Subsection (a)(2) a reporting
4949 requirement that:
5050 (1) is required by federal law; or
5151 (2) applies to another state agency in addition to a
5252 health and human services agency.
5353 (d) Not later than the 60th day after the date the executive
5454 commissioner issues the initial report under Subsection (a)(2), the
5555 governor, the lieutenant governor, the speaker of the house of
5656 representatives, the chairs of the Senate Health and Human Services
5757 Committee, House Human Services Committee, and House Public Health
5858 Committee, or those committees' successors, and any other person
5959 may submit to the executive commissioner any comments on the
6060 reporting requirements identified by the executive commissioner,
6161 including comments indicating the person believes a specific
6262 reporting requirement is necessary and should continue to be
6363 required under statute.
6464 (e) Not later than May 1, 2010, and after considering the
6565 comments provided under Subsection (d), the executive commissioner
6666 shall:
6767 (1) issue a final report listing the reporting
6868 requirements the executive commissioner determines:
6969 (A) are not necessary to accomplish the
7070 objectives of the statute that contains the reporting requirement;
7171 (B) are redundant of other statutory reporting
7272 requirements; or
7373 (C) are required under statute to be provided at
7474 a frequency for which data is not available and recommending the
7575 frequency at which the reporting requirement could be fulfilled;
7676 (2) provide to the governor, the lieutenant governor,
7777 the speaker of the house of representatives, the chairs of the
7878 Senate Health and Human Services Committee, House Human Services
7979 Committee, and House Public Health Committee, or those committees'
8080 successors, the state auditor's office, the Legislative Budget
8181 Board, the Texas State Library and Archives Commission, and the
8282 Sunset Advisory Commission a list of each statutory reporting
8383 requirement for which the executive commissioner made the
8484 determination described by Subdivision (1) and, for each statutory
8585 reporting requirement, the justification for the executive
8686 commissioner's determination; and
8787 (3) publish in the Texas Register and post on the
8888 commission's Internet website a list of each statutory reporting
8989 requirement for which the executive commissioner made the
9090 determination described by Subdivision (1).
9191 (f) For each reporting requirement included in the final
9292 report under Subsection (e)(1), it is the intent of the 81st
9393 Legislature that the 82nd Legislature consider repealing the
9494 reporting requirement or amending a statute to decrease the
9595 frequency of the reporting requirement.
9696 (g) This section expires September 1, 2012.
9797 SECTION 2. This Act takes effect September 1, 2009.
