7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Chapter 1152, Acts of the 78th Legislature, |
---|
9 | 9 | | Regular Session, 2003, is amended by adding Section 9A to read as |
---|
10 | 10 | | follows: |
---|
11 | 11 | | Sec. 9A. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER |
---|
12 | 12 | | DISTRICTS. (a) As soon as practicable after the effective date of |
---|
13 | 13 | | the Act by which this section is enacted into law, the board shall: |
---|
14 | 14 | | (1) divide the district into five single-member |
---|
15 | 15 | | districts for electing directors; and |
---|
16 | 16 | | (2) assign each of the existing board positions to one |
---|
17 | 17 | | of the new single-member districts. |
---|
18 | 18 | | (b) In dividing the district into single-member districts |
---|
19 | 19 | | under Subsection (a) of this section, the board shall: |
---|
20 | 20 | | (1) take into account the existing at-large board |
---|
21 | 21 | | position elected by the voters of the Santa Gertrudis Independent |
---|
22 | 22 | | School District; and |
---|
23 | 23 | | (2) draw the single-member districts in a manner that |
---|
24 | 24 | | retains the existing district lines as closely as possible. |
---|
25 | 25 | | (c) If the district annexes territory, the annexed |
---|
26 | 26 | | territory becomes part of one or more of the single-member |
---|
27 | 27 | | districts as determined by the board. |
---|
28 | 28 | | (d) One director shall be elected from each single-member |
---|
29 | 29 | | district. |
---|
30 | 30 | | (e) To be a candidate for or to serve as a director, a person |
---|
31 | 31 | | must be a registered voter in the single-member district the person |
---|
32 | 32 | | represents or seeks to represent. |
---|
33 | 33 | | (f) A person shall indicate on the application for a place |
---|
34 | 34 | | on the ballot the single-member district the person seeks to |
---|
35 | 35 | | represent. |
---|
36 | 36 | | (g) After each federal decennial census or as needed, the |
---|
37 | 37 | | board may redraw the single-member districts to reflect population |
---|
38 | 38 | | changes. A director in office on the effective date of a change in |
---|
39 | 39 | | the boundaries of a single-member district, or a director elected |
---|
40 | 40 | | or appointed before the effective date of the change whose term of |
---|
41 | 41 | | office begins on or after the effective date of the change, shall |
---|
42 | 42 | | serve for the remainder of the director's term in the single-member |
---|
43 | 43 | | district to which elected or appointed even though the change in |
---|
44 | 44 | | boundaries places the director's residence outside the district to |
---|
45 | 45 | | which the director was elected or appointed. |
---|

87 | 87 | | (2) Section 8, Chapter 1162, Acts of the 78th |
---|
88 | 88 | | Legislature, Regular Session, 2003. |

89 | 89 | | SECTION 4. (a) The change in law made by this Act applies |
---|
90 | 90 | | only to a director elected or appointed to serve on the board of |
---|
91 | 91 | | directors of the Kenedy County Groundwater Conservation District on |
---|
92 | 92 | | or after the effective date of this Act. |
---|
93 | 93 | | (b) The change in law made by this Act does not affect the |
---|
94 | 94 | | term of office of a director serving on the board of directors of |
---|
95 | 95 | | the Kenedy County Groundwater Conservation District on the |
---|
96 | 96 | | effective date of this Act. |
---|
97 | 97 | | SECTION 5. This Act takes effect immediately if it receives |
---|
98 | 98 | | a vote of two-thirds of all the members elected to each house, as |
---|
99 | 99 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
100 | 100 | | Act does not receive the vote necessary for immediate effect, this |
---|
101 | 101 | | Act takes effect September 1, 2009. |
