55 relating to the board of directors of the Kenedy County Groundwater
66 Conservation District.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 1152, Acts of the 78th Legislature,
99 Regular Session, 2003, is amended by adding Section 9A to read as
1010 follows:
1111 Sec. 9A. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
1212 DISTRICTS. (a) As soon as practicable after the effective date of
1313 the Act by which this section is enacted into law, the board shall:
1414 (1) divide the district into five single-member
1515 districts for electing directors; and
1616 (2) assign each of the existing board positions to one
1717 of the new single-member districts.
1818 (b) In dividing the district into single-member districts
1919 under Subsection (a) of this section, the board shall:
2020 (1) take into account the existing at-large board
2121 position elected by the voters of the Santa Gertrudis Independent
2222 School District; and
2323 (2) draw the single-member districts in a manner that
2424 retains the existing district lines as closely as possible.
2525 (c) If the district annexes territory, the annexed
2626 territory becomes part of one or more of the single-member
2727 districts as determined by the board.
2828 (d) One director shall be elected from each single-member
2929 district.
3030 (e) To be a candidate for or to serve as a director, a person
3131 must be a registered voter in the single-member district the person
3232 represents or seeks to represent.
3333 (f) A person shall indicate on the application for a place
3434 on the ballot the single-member district the person seeks to
3535 represent.
3636 (g) After each federal decennial census or as needed, the
3737 board may redraw the single-member districts to reflect population
3838 changes. A director in office on the effective date of a change in
3939 the boundaries of a single-member district, or a director elected
4040 or appointed before the effective date of the change whose term of
4141 office begins on or after the effective date of the change, shall
4242 serve for the remainder of the director's term in the single-member
4343 district to which elected or appointed even though the change in
4444 boundaries places the director's residence outside the district to
4545 which the director was elected or appointed.
4646 SECTION 2. Chapter 1162, Acts of the 78th Legislature,
4747 Regular Session, 2003, is amended by adding Section 8A to read as
4848 follows:
4949 Sec. 8A. METHOD OF ELECTING DIRECTORS: SINGLE-MEMBER
5050 DISTRICTS. (a) As soon as practicable after the effective date of
5151 the Act by which this section is enacted into law, the board shall:
5252 (1) divide the district into five single-member
5353 districts for electing directors; and
5454 (2) assign each of the existing board positions to one
5555 of the new single-member districts.
5656 (b) In dividing the district into single-member districts
5757 under Subsection (a) of this section, the board shall:
5858 (1) take into account the existing at-large board
5959 position elected by the voters of the Santa Gertrudis Independent
6060 School District; and
6161 (2) draw the single-member districts in a manner that
6262 retains the existing district lines as closely as possible.
6363 (c) If the district annexes territory, the annexed
6464 territory becomes part of one or more of the single-member
6565 districts as determined by the board.
6666 (d) One director shall be elected from each single-member
6767 district.
6868 (e) To be a candidate for or to serve as a director, a person
6969 must be a registered voter in the single-member district the person

8484 SECTION 3. The following laws are repealed:
8585 (1) Section 9, Chapter 1152, Acts of the 78th
8686 Legislature, Regular Session, 2003; and
8787 (2) Section 8, Chapter 1162, Acts of the 78th
8888 Legislature, Regular Session, 2003.
8989 SECTION 4. (a) The change in law made by this Act applies
9090 only to a director elected or appointed to serve on the board of
9191 directors of the Kenedy County Groundwater Conservation District on
9292 or after the effective date of this Act.
9393 (b) The change in law made by this Act does not affect the
9494 term of office of a director serving on the board of directors of
9595 the Kenedy County Groundwater Conservation District on the
9696 effective date of this Act.
9797 SECTION 5. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2009.
