| 5 | 5 | | relating to hepatitis B vaccination for students enrolled in |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 51.933, Education Code, is amended by |
|---|
| 10 | 10 | | adding Subsection (b-1) to read as follows: |
|---|
| 11 | 11 | | (b-1) A rule adopted under Subsection (b) that requires a |
|---|
| 12 | 12 | | hepatitis B vaccination for students may apply only to students |
|---|
| 13 | 13 | | enrolled in a course of study that involves potential exposure to |
|---|
| 14 | 14 | | human or animal blood or bodily fluids. |
|---|
| 15 | 15 | | SECTION 2. Not later than November 1, 2009, the executive |
|---|
| 16 | 16 | | commissioner of the Health and Human Services Commission shall |
|---|
| 17 | 17 | | adopt rules as required by Subsection (b-1), Section 51.933, |
|---|
| 18 | 18 | | Education Code, as added by this Act. |
|---|
| 19 | 19 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2009. |
