55 relating to hepatitis B vaccination for students enrolled in
66 certain health-related courses of study at an institution of higher

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 51.933, Education Code, is amended by
1010 adding Subsection (b-1) to read as follows:
1111 (b-1) A rule adopted under Subsection (b) that requires a
1212 hepatitis B vaccination for students may apply only to students
1313 enrolled in a course of study that involves potential exposure to
1414 human or animal blood or bodily fluids.
1515 SECTION 2. Not later than November 1, 2009, the executive
1616 commissioner of the Health and Human Services Commission shall
1717 adopt rules as required by Subsection (b-1), Section 51.933,
1818 Education Code, as added by this Act.
1919 SECTION 3. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2009.
