7	7	relating to the eligibility of certain postdoctoral fellows and
8	8	graduate students to participate in health benefit programs at
9	9	public institutions of higher education.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter C, Chapter 1551, Insurance Code, is
12	12	amended by adding Section 1551.1022 to read as follows:
13	13	Sec. 1551.1022. PARTICIPATION ELIGIBILITY: CERTAIN
14	14	POSTDOCTORAL FELLOWS AND GRADUATE STUDENTS. An individual is
15	15	eligible to participate in the group benefits program as if the
16	16	individual were an employee, regardless of whether the individual
17	17	actually serves as an employee, if the individual, at an
18	18	institution of higher education:
19	19	(1) holds a postdoctoral fellowship; or
20	20	(2) holds other fellowships awarded to the individual
21	21	on a competitive basis that, either singly or in combination, are
22	22	valued at not less than $10,000.
23	23	SECTION 2. Subchapter C, Chapter 1601, Insurance Code, is
24	24	amended by adding Section 1601.1021 to read as follows:
25	25	Sec. 1601.1021. PARTICIPATION ELIGIBILITY: CERTAIN
26	26	POSTDOCTORAL FELLOWS AND GRADUATE STUDENTS. An individual is
27	27	eligible to participate in the uniform program as if the individual
28	28	were an employee, regardless of whether the individual actually
29	29	serves as an employee, if the individual, at an institution in a
30	30	system:
31	31	(1) holds a postdoctoral fellowship; or
32	32	(2) holds other fellowships awarded to the individual
33	33	on a competitive basis that, either singly or in combination, are
34	34	valued at not less than $10,000.
35	35	SECTION 3. Effective January 1, 2010, Section 1601.101(d),
36	36	Insurance Code, is repealed.
37	37	SECTION 4. (a) The board of trustees of the Employees
38	38	Retirement System of Texas shall include coverage under Section
39	39	1551.1022, Insurance Code, as added by this Act, in an insurance
40	40	policy or contract or evidence of coverage delivered, issued for
41	41	delivery, or renewed on or after January 1, 2010. The board of
42	42	trustees may include coverage under Section 1551.1022, Insurance
43	43	Code, as added by this Act, in an insurance policy or contract or an
44	44	evidence of coverage delivered, issued for delivery, or renewed
45	45	before January 1, 2010, if the board of trustees determines that the
46	46	coverage may reasonably be included.
47	47	(b) The governing board of The University of Texas System or
48	48	The Texas A&M University System, as applicable, shall include
49	49	coverage under Section 1601.1021, Insurance Code, as added by this
50	50	Act, in an insurance policy or contract or evidence of coverage
51	51	delivered, issued for delivery, or renewed on or after January 1,
52	52	2010. The governing board of a system may include coverage under
53	53	Section 1601.1021, Insurance Code, as added by this Act, in an
54	54	insurance policy or contract or an evidence of coverage delivered,
55	55	issued for delivery, or renewed before January 1, 2010, if the
56	56	governing board determines that the coverage may reasonably be
57	57	included.
58	58	SECTION 5. Except as provided by this Act, this Act takes
59	59	effect September 1, 2009.
