| 5 | 5 | | relating to the use of personal leave by a public school employee. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 22.003, Education Code, is amended by |
|---|
| 8 | 8 | | amending Subsection (a) and adding Subsection (f) to read as |
|---|
| 9 | 9 | | follows: |
|---|
| 10 | 10 | | (a) A state minimum personal leave program consisting of |
|---|
| 11 | 11 | | five days per year personal leave with no limit on accumulation and |
|---|
| 12 | 12 | | transferable among districts shall be provided for school district |
|---|
| 13 | 13 | | employees. School districts may provide additional personal leave |
|---|
| 14 | 14 | | beyond this minimum. The board of trustees of a school district may |
|---|
| 15 | 15 | | adopt a policy governing an employee's use of personal leave |
|---|
| 16 | 16 | | granted under this subsection, except that the policy may not |
|---|
| 17 | 17 | | restrict: |
|---|
| 18 | 18 | | (1) the purposes for which the leave may be used; or |
|---|
| 19 | 19 | | (2) the order in which an employee may use the state |
|---|
| 20 | 20 | | minimum personal leave and any additional personal leave provided |
|---|
| 21 | 21 | | by the school district. |
|---|
| 22 | 22 | | (f) A public school employee who retains any sick leave |
|---|
| 23 | 23 | | accumulated under former Section 13.904(a), as that section existed |
|---|
| 24 | 24 | | on January 1, 1995, is entitled to use the sick leave provided under |
|---|
| 25 | 25 | | that section or the personal leave provided under Subsection (a) in |
|---|
| 26 | 26 | | any order to the extent that the leave the employee uses is |
|---|
| 27 | 27 | | appropriate to the purpose of the leave. |
|---|
| 28 | 28 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 29 | 29 | | school year. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
