| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 11.391(a), Alcoholic Beverage Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (a) An applicant for a permit issued under this code for a |
|---|
| 16 | 16 | | location not previously licensed for the on-premises consumption of |
|---|
| 17 | 17 | | alcoholic beverages must [shall], not later than the 60th day |
|---|
| 18 | 18 | | before the date the permit [application] is issued [filed], |
|---|
| 19 | 19 | | prominently post an outdoor sign at the location stating that |
|---|
| 20 | 20 | | alcoholic beverages are intended to be served on the premises, the |
|---|
| 21 | 21 | | type of permit, and the name and business address of the applicant. |

| 22 | 22 | | SECTION 2. Section 61.381(a), Alcoholic Beverage Code, is |
|---|
| 23 | 23 | | amended to read as follows: |
|---|
| 24 | 24 | | (a) An applicant for a license issued under this code for a |
|---|
| 25 | 25 | | location not previously licensed for the on-premises consumption of |
|---|
| 26 | 26 | | alcoholic beverages must [shall], not later than the 60th day |
|---|
| 27 | 27 | | before the date the license [application] is issued [filed], |
|---|
| 28 | 28 | | prominently post an outdoor sign at the location stating that |
|---|

| 31 | 31 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 32 | 32 | | to an application for an alcoholic beverage permit or license filed |
|---|
| 33 | 33 | | on or after the effective date of this Act. An application filed |
|---|
| 34 | 34 | | before the effective date of this Act is governed by the law in |
|---|
| 35 | 35 | | effect immediately before the effective date of this Act, and that |
|---|
| 36 | 36 | | law is continued in effect for that purpose. |

| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2011. |
