| 11 | 11 | | certain persons by the Texas Facilities Commission. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter F, Chapter 411, Government Code, is |
|---|
| 14 | 14 | | amended by adding Section 411.1391 to read as follows: |
|---|
| 15 | 15 | | Sec. 411.1391. ACCESS TO CRIMINAL HISTORY RECORD |
|---|
| 16 | 16 | | INFORMATION: TEXAS FACILITIES COMMISSION. (a) The Texas Facilities |
|---|
| 17 | 17 | | Commission is entitled to obtain from the department criminal |
|---|
| 18 | 18 | | history record information maintained by the department that |
|---|
| 19 | 19 | | relates to a person who: |
|---|
| 20 | 20 | | (1) is an employee or an applicant for employment with |
|---|
| 21 | 21 | | the commission; |
|---|
| 22 | 22 | | (2) is a consultant, intern, or volunteer for the |
|---|
| 23 | 23 | | commission or an applicant to serve as a consultant, intern, or |
|---|
| 24 | 24 | | volunteer; |
|---|
| 25 | 25 | | (3) proposes to enter into a contract with or has a |
|---|
| 26 | 26 | | contract with the commission to perform services for or supply |
|---|
| 27 | 27 | | goods to the commission; or |
|---|
| 28 | 28 | | (4) is an employee or subcontractor, or an applicant |
|---|
| 29 | 29 | | to be an employee or subcontractor, of a contractor that provides |
|---|
| 30 | 30 | | services to the commission. |
|---|
| 31 | 31 | | (b) Criminal history record information obtained by the |
|---|
| 32 | 32 | | Texas Facilities Commission under Subsection (a) may not be |
|---|
| 33 | 33 | | released or disclosed to any person except: |
|---|
| 34 | 34 | | (1) on court order; or |
|---|
| 35 | 35 | | (2) with the consent of the person who is the subject |
|---|
| 36 | 36 | | of the criminal history record information. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2011. |
