99 AN ACT
1010 relating to access to the criminal history record information of
1111 certain persons by the Texas Facilities Commission.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter F, Chapter 411, Government Code, is
1414 amended by adding Section 411.1391 to read as follows:
1515 Sec. 411.1391. ACCESS TO CRIMINAL HISTORY RECORD
1616 INFORMATION: TEXAS FACILITIES COMMISSION. (a) The Texas Facilities
1717 Commission is entitled to obtain from the department criminal
1818 history record information maintained by the department that
1919 relates to a person who:
2020 (1) is an employee or an applicant for employment with
2121 the commission;
2222 (2) is a consultant, intern, or volunteer for the
2323 commission or an applicant to serve as a consultant, intern, or
2424 volunteer;
2525 (3) proposes to enter into a contract with or has a
2626 contract with the commission to perform services for or supply
2727 goods to the commission; or
2828 (4) is an employee or subcontractor, or an applicant
2929 to be an employee or subcontractor, of a contractor that provides
3030 services to the commission.
3131 (b) Criminal history record information obtained by the
3232 Texas Facilities Commission under Subsection (a) may not be
3333 released or disclosed to any person except:
3434 (1) on court order; or
3535 (2) with the consent of the person who is the subject
3636 of the criminal history record information.
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2011.
