| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Chapter 461, Transportation Code, is amended by |

| 15 | 15 | | adding Section 461.009 to read as follows: |

| 16 | 16 | | Sec. 461.009. ELIGIBILITY OF VISITORS TO USE CERTAIN PUBLIC |

| 17 | 17 | | TRANSPORTATION SERVICES FOR PEOPLE WITH DISABILITIES. (a) In this |

| 18 | 18 | | section: |
|---|
| 19 | 19 | | (1) "Provider" means a public transportation provider |
|---|
| 20 | 20 | | that provides public transportation services designed for people |
|---|
| 21 | 21 | | with disabilities who are unable to use the provider's bus or rail |
|---|
| 22 | 22 | | services. |
|---|
| 23 | 23 | | (2) "Services" means public transportation services |
|---|
| 24 | 24 | | provided by a public transportation provider and designed for |
|---|
| 25 | 25 | | people with disabilities who are unable to use the provider's bus or |
|---|
| 26 | 26 | | rail services. |
|---|
| 27 | 27 | | (b) A provider shall determine if an individual who resides |
|---|
| 28 | 28 | | outside of the provider's service area and who seeks to use the |
|---|
| 29 | 29 | | provider's services while visiting the provider's service area is |
|---|
| 30 | 30 | | eligible to use the services not later than two business days after |
|---|
| 31 | 31 | | the date the individual gives the provider the appropriate notice |
|---|
| 32 | 32 | | and submits any required documentation. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2011. |
