99 AN ACT
1010 relating to the electronic distribution of information to
1111 legislators by state agencies.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 2052.002(a) and (c), Government Code,
1414 are amended to read as follows:
1515 (a) To avoid waste in the duplication and distribution of
1616 state agency publications, a state agency that issues a publication
1717 relating to the work of the agency and distributes the publication
1818 to members of the legislature shall send to each member before
1919 distributing the publication an electronic [a written] notice to
2020 determine whether the member wants to receive the publication.
2121 (c) A member who elects to receive the publication shall
2222 notify the state agency. The member may notify the agency
2323 electronically.
2424 SECTION 2. Section 2052.0021(d), Government Code, is
2525 amended to read as follows:
2626 (d) At the time a report required by law is ready for
2727 distribution outside the state agency, the agency shall send
2828 written notice to each member of the legislature that the report is
2929 available. The agency shall send the notice [by mail or, if it is
3030 acceptable to the member,] electronically. The notice must briefly
3131 describe the subject matter of the report and state:
3232 (1) the manner in which the member may obtain the
3333 report electronically; and
3434 (2) that the agency will send a printed copy of the
3535 report to the member at the request of the member.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2011.
