| 10 | 10 | | relating to the electronic distribution of information to |
|---|
| 11 | 11 | | legislators by state agencies. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Sections 2052.002(a) and (c), Government Code, |
|---|
| 14 | 14 | | are amended to read as follows: |
|---|
| 15 | 15 | | (a) To avoid waste in the duplication and distribution of |
|---|
| 16 | 16 | | state agency publications, a state agency that issues a publication |
|---|
| 17 | 17 | | relating to the work of the agency and distributes the publication |
|---|
| 18 | 18 | | to members of the legislature shall send to each member before |
|---|
| 19 | 19 | | distributing the publication an electronic [a written] notice to |
|---|
| 20 | 20 | | determine whether the member wants to receive the publication. |
|---|
| 21 | 21 | | (c) A member who elects to receive the publication shall |
|---|
| 22 | 22 | | notify the state agency. The member may notify the agency |
|---|
| 23 | 23 | | electronically. |
|---|
| 24 | 24 | | SECTION 2. Section 2052.0021(d), Government Code, is |
|---|
| 25 | 25 | | amended to read as follows: |
|---|
| 26 | 26 | | (d) At the time a report required by law is ready for |
|---|
| 27 | 27 | | distribution outside the state agency, the agency shall send |
|---|
| 28 | 28 | | written notice to each member of the legislature that the report is |
|---|
| 29 | 29 | | available. The agency shall send the notice [by mail or, if it is |
|---|
| 30 | 30 | | acceptable to the member,] electronically. The notice must briefly |
|---|
| 31 | 31 | | describe the subject matter of the report and state: |
|---|
| 32 | 32 | | (1) the manner in which the member may obtain the |
|---|
| 33 | 33 | | report electronically; and |
|---|
| 34 | 34 | | (2) that the agency will send a printed copy of the |
|---|
| 35 | 35 | | report to the member at the request of the member. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2011. |
