99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the extent of extraterritorial jurisdiction for certain
1212 municipalities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 42.021, Local Government Code, is
1515 amended by adding Subsection (c) to read as follows:
1616 (c) Regardless of Subsection (a), the extraterritorial
1717 jurisdiction of a municipality is the unincorporated area that is
1818 contiguous to the corporate boundaries of the municipality and that
1919 is located within three miles of those boundaries if the
2020 municipality:
2121 (1) has a population of not less than 20,000 or more
2222 than 29,000; and
2323 (2) is located in a county that has a population of
2424 45,000 or more and borders the Trinity River.
2525 SECTION 2. This Act takes effect September 1, 2011.
