88 AN ACT
99 relating to awards for certain members of the state military forces
1010 who were inducted into or served in federal military service in
1111 support of Operations Iraqi Freedom, New Dawn, and Enduring
1212 Freedom.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 431.134(a), Government Code, is amended
1515 to read as follows:
1616 (a) The adjutant general may adopt rules and regulations
1717 relating to the:
1818 (1) Texas Faithful Service Medal, which shall be
1919 awarded to a member of the state military forces who has completed
2020 five years of honorable service during which the person has shown
2121 fidelity to duty, efficient service, and great loyalty to the
2222 state;
2323 (2) Federal Service Medal, which shall be awarded to a
2424 person who was inducted into federal service from the state
2525 military forces between June 15, 1940, and January 1, 1946, or after
2626 June 1, 1950, if the service was for more than 90 days;
2727 (3) Texas Medal of Merit, which may be presented to a
2828 member of the military forces of this state, another state, or the
2929 United States who performs outstanding service or attains
3030 extraordinary achievement in behalf of the state or United States;
3131 (4) Texas Outstanding Service Medal, which may be
3232 presented to a member of the military forces of this state, another
3333 state, or the United States who has performed service in a superior
3434 and clearly outstanding manner;
3535 (5) Texas State Guard Service Medal, which shall be
3636 awarded to a person who completes three consecutive years of
3737 honorable service in the Texas State Guard during which the person
3838 has shown fidelity to duty, efficient service, and great loyalty to
3939 the state;
4040 (6) Texas Desert Shield/Desert Storm Campaign Medal,
4141 which shall be awarded to a person who was inducted into federal
4242 service from the Texas National Guard after August 1, 1990, in
4343 support of Operation Desert Shield or Operation Desert Storm,
4444 without regard to the place that the person was deployed while
4545 serving on active federal military duty;
4646 (7) Texas Humanitarian Service Medal, which shall be
4747 awarded to a person who:
4848 (A) does not meet the criteria for an award of the
4949 federal Humanitarian Service Medal;
5050 (B) is a member of the state military forces; and
5151 (C) while serving on state active duty or active
5252 duty under state authority in accordance with Title 32 of the United
5353 States Code, participates satisfactorily in defense support to a
5454 mission under civilian authority to protect life or property during
5555 or soon after a natural disaster or civil unrest in the state;
5656 (8) Texas Cavalry Medal, which shall be awarded to a
5757 person who:
5858 (A) served on or after September 11, 2001, in the
5959 124th Cavalry, Texas Army National Guard; and
6060 (B) served in a hostile fire zone as designated
6161 by the United States secretary of defense;
6262 (9) Texas Combat Service Ribbon, which shall be
6363 awarded to a member of the Texas National Guard who served, after
6464 September 11, 2001, in a hostile fire zone as designated by the
6565 United States secretary of defense;
6666 (10) Texas Purple Heart Medal, which shall be awarded
6767 to a person who, after September 11, 2001:
6868 (A) was inducted into federal service from the
6969 Texas National Guard; and
7070 (B) meets the criteria for an award of the
7171 federal Purple Heart Medal;
7272 (11) Texas Superior Service Medal, which shall be
7373 awarded to:
7474 (A) a member of the state military forces who
7575 has:
7676 (i) completed 30 or more years of honorable
7777 state service or a combination of state and federal service; and
7878 (ii) continually demonstrated superior
7979 performance and service while assigned to key leadership positions
8080 demanding responsibility; or
8181 (B) a civilian who has contributed significant
8282 service to the state military forces; [and]
8383 (12) Texas Homeland Defense Service Medal, which shall
8484 be awarded to a member of the state military forces who served:
8585 (A) on or after September 11, 2001;
8686 (B) on state active duty or active duty under
8787 state authority in accordance with Title 32 of the United States
8888 Code; and
8989 (C) satisfactorily in defense support to a
9090 mission in the state under civilian authority;
9191 (13) Texas Iraqi Campaign Medal, which shall be
9292 awarded to a person who was inducted into federal military service
9393 from the Texas National Guard or to a member of the Texas National
9494 Guard who served in federal military service, without regard to the
9595 place that the person was deployed while serving on active federal
9696 military duty, after:
9797 (A) March 19, 2003, in support of Operation Iraqi
9898 Freedom; or
9999 (B) August 31, 2010, in support of Operation New
100100 Dawn; and
101101 (14) Texas Afghanistan Campaign Medal, which shall be
102102 awarded to a person who was inducted into federal military service
103103 from the Texas National Guard or to a member of the Texas National
104104 Guard who served in federal military service after October 6, 2001,
105105 in support of Operation Enduring Freedom, without regard to the
106106 place that the person was deployed while serving on active federal
107107 military duty.
108108 SECTION 2. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2011.
