99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 38.103, Education Code,
1111 is amended to read as follows:
1212 Sec. 38.103. REPORTING OF PHYSICAL FITNESS [SUMMARY]
1313 RESULTS.
1414 SECTION 2. Subsection (a), Section 38.103, Education Code,
1515 is amended to read as follows:
1616 (a) A school district shall provide [compile] the results of
1717 individual student performance on the physical fitness assessment
1818 required by this subchapter [and provide summary results,
1919 aggregated by grade level and any other appropriate category
2020 identified by commissioner rule,] to the agency. The [summary]
2121 results may not contain the names of individual students or
2222 teachers or a student's social security number or date of birth.
2323 SECTION 3. This Act applies beginning with the 2011-2012
2424 school year.
2525 SECTION 4. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2011.
