9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The heading to Section 38.103, Education Code, |

11 | 11 | | is amended to read as follows: |

12 | 12 | | Sec. 38.103. REPORTING OF PHYSICAL FITNESS [SUMMARY] |

14 | 14 | | SECTION 2. Subsection (a), Section 38.103, Education Code, |
---|
15 | 15 | | is amended to read as follows: |

16 | 16 | | (a) A school district shall provide [compile] the results of |
---|
17 | 17 | | individual student performance on the physical fitness assessment |
---|
18 | 18 | | required by this subchapter [and provide summary results, |
---|
19 | 19 | | aggregated by grade level and any other appropriate category |
---|
20 | 20 | | identified by commissioner rule,] to the agency. The [summary] |
---|
21 | 21 | | results may not contain the names of individual students or |
---|
22 | 22 | | teachers or a student's social security number or date of birth. |
---|
23 | 23 | | SECTION 3. This Act applies beginning with the 2011-2012 |
---|
24 | 24 | | school year. |
---|
25 | 25 | | SECTION 4. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2011. |
