99 AN ACT
1010 relating to the liability of and payment of legal fees for
1111 court-appointed trustees of certain facilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 242, Health and Safety
1414 Code, is amended by adding Section 242.0947 to read as follows:
1515 Sec. 242.0947. IMMUNITY FROM CIVIL LIABILITY; PAYMENT OF
1616 CERTAIN LEGAL FEES INCURRED BY TRUSTEE. (a) This section applies
1717 only to a trustee appointed under Section 242.094 to operate:
1818 (1) a nursing or convalescent home; or
1919 (2) an assisted living facility as authorized under
2020 Section 247.003(b).
2121 (b) A trustee is not liable for civil damages for an act or
2222 omission committed in good faith in the official scope of the
2323 trustee's duties.
2424 (c) The trustee is entitled to payment for reasonable legal
2525 fees actually incurred by the trustee in fulfilling the trustee's
2626 duties.
2727 (d) Notwithstanding Section 242.096(b), a trustee of a home
2828 may use the emergency assistance funds available under Section
2929 242.096 to pay reasonable legal fees actually incurred by the
3030 trustee in fulfilling the trustee's duties. Notwithstanding
3131 Section 242.096(c), a court may order the department to disburse
3232 emergency assistance funds to the trustee to pay reasonable legal
3333 fees actually incurred by the trustee in fulfilling the trustee's
3434 duties.
3535 (e) Notwithstanding Section 242.0965(b), a trustee of an
3636 assisted living facility may use the emergency assistance funds
3737 available under Section 242.0965 to pay reasonable legal fees
3838 actually incurred by the trustee in fulfilling the trustee's
3939 duties. Notwithstanding Section 242.0965(c), a court may order the
4040 department to disburse emergency assistance funds to the trustee to
4141 pay reasonable legal fees actually incurred by the trustee in
4242 fulfilling the trustee's duties.
4343 SECTION 2. Subchapter D, Chapter 252, Health and Safety
4444 Code, is amended by adding Section 252.0935 to read as follows:
4545 Sec. 252.0935. IMMUNITY FROM CIVIL LIABILITY; PAYMENT OF
4646 CERTAIN LEGAL FEES INCURRED BY TRUSTEE. (a) This section applies
4747 only to a trustee appointed under Section 252.093 to operate a
4848 facility.
4949 (b) A trustee is not liable for civil damages for an act or
5050 omission committed in good faith in the official scope of the
5151 trustee's duties.
5252 (c) The trustee is entitled to payment for reasonable legal
5353 fees actually incurred by the trustee in fulfilling the trustee's
5454 duties.
5555 (d) Notwithstanding Section 252.095(c), a trustee may use
5656 the emergency assistance funds available under Section 252.095 to
5757 pay reasonable legal fees actually incurred by the trustee in
5858 fulfilling the trustee's duties. Notwithstanding Section
5959 252.095(d), a court may order the department to disburse emergency
6060 assistance funds to the trustee to pay reasonable legal fees
6161 actually incurred by the trustee in fulfilling the trustee's
6262 duties.
6363 SECTION 3. (a) Subsection (b), Section 242.0947, and
6464 Subsection (b), Section 252.0935, Health and Safety Code, as added
6565 by this Act, apply only to an act or omission by a trustee that
6666 occurs on or after the effective date of this Act. An act or
6767 omission that occurred before the effective date of this Act is
6868 governed by the law in effect immediately before the effective date
6969 of this Act, and the former law is continued in effect for that
7070 purpose.
7171 (b) Subsections (c), (d), and (e), Section 242.0947, and
7272 Subsections (c) and (d), Section 252.0935, Health and Safety Code,
7373 as added by this Act, apply only to legal fees incurred by a trustee
7474 on or after the effective date of this Act. Legal fees incurred by a
7575 trustee before the effective date of this Act are governed by the
7676 law in effect when the fees were incurred, and the former law is
7777 continued in effect for that purpose.
7878 SECTION 4. This Act takes effect September 1, 2011.
